And a quality education requires input from those who know children best: their parents,\u201d Scott said in a <a href=\"https:\/\/www.scott.senate.gov\/media-center\/press-releases\/scott-introduces-bill-to-protect-parental-rights-combat-indoctrination-in-schools-\" target=\"_blank\" rel=\"noopener\">statement<\/a> announcing the bill. \u201cSadly, radical and secretive gender policies have shut parents out of the conversation and broken their trust. My bill will safeguard parental rights, improve the crucial relationship between parents and schools, and ensure that children can learn in an environment free from activist ideology.\u201d<\/p>\n<p>The text of the law states:<\/p>\n<p><em>As a condition of receiving Federal funds, any elementary school\u2026or school that consists of only middle grades\u2026 that receives Federal funds shall be required to obtain parental consent before\u2014<\/em><\/p>\n<p><em>(1) changing a minor child\u2019s gender markers, pronouns, or preferred name on any school form; or<\/em><\/p>\n<p><em>(2) allowing a child to change the child\u2019s sex based accommodations, including locker rooms or bathrooms<\/em><\/p>\n<p>\u201cThe law in the United States has long recognized the importance of parental rights,\u201d the bill says in its \u201cfindings\u201d section. \u201cA parent\u2019s right to oversee the care and education of their child is guaranteed by the Fourteenth Amendment.\u201d<\/p>\n<p>But \u201cpublic schools across the country are violating these fundamental parental and familial rights by deliberately hiding information about gender transitioning children from their parents,\u201d the bill states, citing several instances across the country in which schools instructed staff to conduct a student\u2019s gender transition without parental consent.<\/p>\n<p>First, the bill cited the <a href=\"https:\/\/www.montgomeryschoolsmd.org\/uploadedFiles\/students\/rights\/0504.21_GenderIdentityGuidelinesForStudents_Web.pdf\" target=\"_blank\" rel=\"noopener\">Montgomery County Public Schools<\/a> in Maryland, which published a document on Gender Identity that instructed school administrators to facilitate a \u201cgender support plan\u201d for transgender students that did not require parents to be involved. Second, the bill cited the <a href=\"https:\/\/www.washingtontimes.com\/news\/2022\/aug\/3\/iowa-school-district-sued-hiding-gender-support-pl\/\" target=\"_blank\" rel=\"noopener\">Linn-Mar Community School District<\/a> in Iowa, which was sued for creating similar \u201cgender support plans\u201d for students without parents\u2019 consent. Third, it cited the case of <a href=\"https:\/\/www.foxnews.com\/politics\/fairfax-county-public-schools-says-parent-consent-not-need-for-gender-change-on-school-forms\" target=\"_blank\" rel=\"noopener\">Fairfax County Public Schools in Virginia<\/a>, which mandated that all teachers complete a training program that required them to recognize the gender identity of transgender students, use their preferred name and pronouns in class and on official school records, and allow them to use locker rooms and bathrooms that comport with their selected gender identity, all without parental consent.<\/p>\n<p>Scott\u2019s legislation comes after Virginia Governor <a href=\"https:\/\/www.dailywire.com\/news\/virginia-replaces-democrats-mandatory-transgender-policy-with-parents-rights-manifesto\" target=\"_blank\" rel=\"noopener\">Glenn Youngkin<\/a> replaced a statewide transgender policy with one that prioritizes parents\u2019 rights.<\/p>\n<p>\u201cThe U.S. Constitution, the Virginia Constitution, federal law, state law, and relevant case law place beyond debate the rights of parents to be informed about their children and the limitations of government to usurp parents\u2019 rightful role,\u201d the document stated. \u201cAdditionally, decades of research conducted worldwide has consistently concluded that parental involvement in a child\u2019s education and development is paramount.\u201d<\/p>\n<p>The document requires parents to request in writing for schools to recognize a child\u2019s transgender identity; it requires teachers only to use the name in the student\u2019s official records; students are required to use locker rooms and bathrooms and compete in sports that comport with their biological sex; and \u201c[n]o policy, guidance, training, or other written material issued by the [School Division] may encourage or instruct teachers to conceal material information about a student from the student\u2019s parent.\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Senator Tim Scott\u00a0(R-SC) introduced a bill Tuesday to prevent schools from keeping a child\u2019s gender transition from their parents.
