Stat. \u00a7 6.33(1)<\/a>).\u201d<\/p>\n<p>As <a href=\"https:\/\/www.eac.gov\/voters\/national-mail-voter-registration-form\" target=\"_blank\" rel=\"noreferrer noopener\">described<\/a> by the U.S. Election Assitance Commission, the National Mail Voter Registration Form \u201ccan be used to\u00a0register U.S. citizens to vote, to update registration information due to a change of name, make a change of address or to register with a political party.\u201d<\/p>\n<p>According to a WILL <a href=\"https:\/\/will-law.org\/will-sues-wec-over-illegal-use-of-voter-registration-form\/\" target=\"_blank\" rel=\"noreferrer noopener\">press release<\/a>, \u201cWEC\u2019s Election Manual states that the Form is approved for voter registration in Wisconsin.\u201d But while \u201cmost states accept the Form, made available by the United States Election Assistance Commission, Wisconsin is not required to allow the form to be used in [the] state.\u201d<\/p>\n<p>\u201c[T]he Form does not request information required by state law\u2014such as information relating to residency and criminal record, among others,\u201d the press release explains. \u201cAdditionally, because the Form requests information- relating to race and political party- not authorized by state statute, WEC must engage in rulemaking before approving these additional items.\u201d<\/p>\n<p>WILL originally sent a letter to WEC in late July that explained why use of the form in Wisconsin was illegal, with the legal group also requesting records under Wisconsin\u2019s Public Records Law \u201cshowing when and by whom the Form was approved for use in Wisconsin as set forth in WEC\u2019s Election Administration Manual.\u201d<\/p>\n<p>\u201c[G]iven that the Form fails to comply with Wisconsin law, the letter warned that absent either a legally sufficient explanation from WEC or withdrawal of approval of the form, a lawsuit would follow,\u201d the <a href=\"https:\/\/will-law.org\/wp-content\/uploads\/2022\/09\/2022-09-15-Summons-Complaint-w.-Exhibit-A-final.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">WILL lawsuit<\/a> reads. \u201cTo date WEC has not provided the records requested by Plaintiff\u2019s counsel. WEC did send an email on 9\/14\/22 responding to the Open Records Request but WEC did not identify or produce any documents showing when and by whom the Form was approved for use in Wisconsin. WEC has provided no other substantive response to the letter.\u201d<\/p>\n<p>\u201cWisconsin law is abundantly clear on the required content of voter registration forms in Wisconsin, yet WEC has somehow approved the use of a form that fails to meet those requirements,\u201d said WILL Deputy Counsel, Anthony LoCoco in a statement. \u201cIt is a shame that, once again, a voter has to go to court simply to ensure that WEC follows the Legislature\u2019s lawful commands.\u201d<\/p>\n<hr class=\"wp-block-separator\" \/>\n<p>\n  Shawn Fleetwood is a Staff Writer for The Federalist and a graduate of the University of Mary Washington.
