But Biden also inadvertently admitted his recent vote-buying scheme to \u201cforgive\u201d student loans is against the law.<\/p>\n<p>When Biden <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/speeches-remarks\/2022\/08\/25\/remarks-by-president-biden-announcing-student-loan-debt-relief-plan\/\" target=\"_blank\" rel=\"noreferrer noopener\">announced<\/a> plans to \u201cforgive\u201d $10,000 in student loans ($20,000 for Pell Grant recipients) for certain borrowers last month, it was an obvious political ploy to give young voters money and wink at them to remember it on Election Day. It was a crime against the word \u201cforgiveness,\u201d since neither the universities nor government lenders are \u201cforgiving\u201d anything, but rather are charging taxpaying bystanders to pay students\u2019 debts. Above all, it was <a href=\"https:\/\/thefederalist.com\/2022\/08\/24\/bidens-student-loan-forgiveness-is-an-unjust-cynical-abuse-of-power\/\" target=\"_blank\" rel=\"noreferrer noopener\">unconstitutional and illegal<\/a>, considering the Constitution\u2019s demand that \u201cNo Money shall be drawn from the Treasury, but in Consequence of Appropriations made by Law\u201d and the fact that the president has no legislative authority to dictate those appropriations.<\/p>\n<p>But the Biden administration has never been one to let the Constitution get in the way, so Biden\u2019s Education Department\u2019s Office of the General Counsel threw together a hogwash argument <a href=\"https:\/\/www2.ed.gov\/policy\/gen\/leg\/foia\/secretarys-legal-authority-for-debt-cancellation.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">claiming<\/a> that the Covid-19 \u201cemergency\u201d authorized the plan. Even The Atlantic <a href=\"https:\/\/www.theatlantic.com\/ideas\/archive\/2022\/09\/biden-student-debt-forgiveness-covid-relief-legal\/671329\/\" target=\"_blank\" rel=\"noreferrer noopener\">admitted<\/a>, \u201cBiden\u2019s Student-Debt Rescue Plan Is a Legal Mess.\u201d <\/p>\n<p>\u201c[W]e have determined that the Higher Education Relief Opportunities for Students (\u2018HEROES\u2019) Act of 2003 grants the Secretary authority that could be used to effectuate a program of targeted loan cancellation directed at addressing the financial harms of the COVID-19 pandemic,\u201d General Counsel Lisa Brown wrote. The HEROES Act is a <a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/PLAW-108publ76\/pdf\/PLAW-108publ76.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">law<\/a> passed shortly after 9\/11, designed to support members of the military by allowing the education secretary to provide student loan-related relief \u201cto respond to a war or other military operation or national emergency.\u201d Brown claimed that the never-ending Covid \u201cpandemic\u201d was justification enough that \u201cthis authority could be used to effectuate a program of categorical debt cancellation directed at addressing the financial harms caused by the COVID-19 pandemic.\u201d<\/p>\n<p>But now \u2014 if the pandemic is \u201cover,\u201d as Biden has finally acknowledged \u2014 doesn\u2019t that mean Biden\u2019s Education Department can no longer use it as a \u201cnational emergency\u201d to try to justify its power grab? Even if the HEROES Act <em>could<\/em> be legally stretched to include Covid-related student-debt handouts, Biden just rendered his own agency\u2019s legal argument null.<\/p>\n<p>It\u2019s also senseless to declare the pandemic any more \u201cover\u201d now than it was less than a month ago. The New York Times <a href=\"https:\/\/www.nytimes.com\/interactive\/2021\/us\/covid-cases.html\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a> the daily average number of Covid deaths at 463 on Aug. 25, the day Biden announced his student loan ploy. On Sept. 18, the day his \u201c60 Minutes\u201d interview aired, the daily average was 464.<\/p>\n<p>Even Biden himself had previously expressed doubts multiple times since he was elected about a president\u2019s authority to write checks from taxpayers to student borrowers. <\/p>\n<p>\u201cI\u2019m going to get in trouble for saying this. \u2026 For example, it\u2019s arguable that the president may have the executive power to forgive up to $50,000 in student debt,\u201d he <a href=\"https:\/\/www.foxnews.com\/politics\/biden-once-doubted-he-authority-grant-student-loan-debt-handout-executive-action\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a> in December 2020. \u201cWell, I think that\u2019s pretty questionable. I\u2019m unsure of that. I\u2019d be unlikely to do that.\u201d<\/p>\n<p>In February 2021, he commented, \u201cI\u2019m prepared to write off a $10,000 debt, but not 50 [thousand dollars]. \u2026 Because I don\u2019t think I have the authority to do it by signing the pen.\u201d The next day, the White House insisted the $10,000 figure \u201cwas not meant as a descriptor for executive action but to reflect his endorsement of achieving that goal through legislation,\u201d <a href=\"https:\/\/www.politico.com\/news\/2021\/02\/17\/student-loan-forgiveness-biden-469677\" target=\"_blank\" rel=\"noreferrer noopener\">according<\/a> to Politico.<\/p>\n<p>Even Democrat House Speaker Nancy Pelosi jumped in to <a href=\"https:\/\/www.cnbc.com\/2021\/07\/28\/pelosi-says-biden-doesnt-have-authority-to-cancel-student-debt-.html\" target=\"_blank\" rel=\"noreferrer noopener\">say<\/a> in July 2021, \u201cThe president can\u2019t do it,\u201d referring to the use of taxpayer dollars to pay off student borrowers\u2019 debts. \u201cThat\u2019s not even a discussion.\u201d<\/p>\n<p>The illegality of Biden\u2019s student debt \u201cforgiveness\u201d was no secret to anyone with a working knowledge of the U.S. Constitution.
