He announced how the court would rule in a future case.\u00a0<\/p>\n<p>Alito made the stunning pronouncement that if Yeshiva University loses to the YU Pride Alliance in New York state courts, the Supreme Court will \u201clikely\u201d take the case and \u201cYeshiva would likely win.\u201d<\/p>\n<p>That is the big news, not the court\u2019s procedural decision to postpone intervening until Yeshiva has exhausted state-court remedies. Alito\u2019s prediction should buoy the hopes of believers everywhere, no matter their religion.<\/p>\n<p>Christianity is 2,000 years old, and Jewish teachings are even older.\u00a0<a href=\"https:\/\/nypost.com\/2022\/06\/23\/americas-religious-history-is-more-complicated-than-the-supreme-courts-liberal-justices-understand\/\">LGBTQ advocates are demanding these faiths change their tenets<\/a> overnight to accommodate gay rights, and many politicians agree. The court\u2019s view is: not so fast.<\/p>\n<p>LGBTQ advocates sued Yeshiva to <a href=\"https:\/\/nypost.com\/2021\/04\/27\/yeshiva-university-students-sue-to-start-lgbtq-club\/\">compel it to recognize the YU Pride Alliance <\/a>as a university club with funding and listing in school publications. Yeshiva refused, explaining that its mission \u201cis to instill Torah values in its students.\u201d Yeshiva welcomes LGBTQ students, but it will not put the university\u2019s imprimatur on clubs or activities \u2014 such as gambling, video games or sex outside traditional marriage \u2014 that violate timeless Torah values.<\/p>\n<p>A New York state trial court in June ordered Yeshiva to recognize the club. <a href=\"https:\/\/nypost.com\/2022\/09\/09\/supreme-court-temporarily-lets-yeshiva-u-block-lgbtq-club\/\">Yeshiva asked the US Supreme Court<\/a> to intervene.\u00a0On Wednesday, the<a href=\"https:\/\/nypost.com\/2022\/09\/14\/supreme-court-sides-with-lgbtq-group-at-yeshiva-university\/\"> justices\u00a0voted 5-4 to hold off <\/a>until the university has exhausted all avenues at the state level. The vote was widely reported as a defeat for Yeshiva.\u00a0Only in the short run. It was a procedural victory for YU Pride Alliance (and federalism), but it will be short-lived.<\/p>\n<p>Alito, penning a dissent that Justices Clarence Thomas, Neil Gorsuch and Amy Coney Barrett joined,\u00a0laid the groundwork for the university\u2019s ultimate victory on the merits.<\/p>\n<figure class=\"wp-block-image size-large\"><a href=\"https:\/\/nypost.com\/wp-content\/uploads\/sites\/2\/2022\/09\/justice-alito.jpg\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"682\" src=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2022\/09\/justice-alito.jpg\" alt=\"Alito questioned in his dissent whether the First Amendment permits a state to force a Jewish school like Yeshiva to instruct against an \" incorrect \/><\/a><figcaption>Alito questioned in his dissent whether the First Amendment permits a state to force a Jewish school like Yeshiva to instruct against an \u201cincorrect\u201d interpretation of the Torah.<\/figcaption><figcaption><span class=\"credit\">Erin Schaff\/Pool via REUTERS\/File Photo<\/span><\/figcaption><\/figure>\n<p>He asked: \u201cDoes the First Amendment permit a State to force a Jewish school to instruct its students in accordance with an interpretation of the Torah that the school . . . has concluded\u00a0is incorrect?\u201d The answer, he said, \u201cis surely \u2018no.\u2019\u201d<\/p>\n<p>Alito\u2019s prediction is important news for Christian colleges and universities across America facing similar legal challenges.<\/p>\n<p>The American Civil Liberties Union invariably sides with LGBTQ advocates, claiming they\u2019re battling intolerant people who use religion as an excuse to discriminate.<\/p>\n<p>The ACLU is wrong. The battle isn\u2019t about a single right; it\u2019s about two: the right of LGBTQ individuals to be protected from bias and the First Amendment right of all Americans to practice their religion.<\/p>\n<aside class=\"single__inline-module alignright\">\n\t<\/aside>\n<p>To protect religious freedom, the federal Department of Education has routinely granted exemptions to religious colleges and universities to practice their religious tenets, even when they conflict with LGBTQ rights protected under Title IX.<\/p>\n<p>The exemption applies to 120 of the 5,300 institutions of higher education in America \u2014 leaving LGBTQ rights protected on the vast majority of campuses and LGBTQ students free to choose them.<\/p>\n<p>The\u00a0Religious Exemption Accountability Project, an advocacy group, is suing to overturn exemptions. The Biden administration has also launched civil-rights investigations against several of the colleges.<\/p>\n<p>Some Christian schools are modifying their codes of conduct,\u00a0reports the<a href=\"https:\/\/www.americanbar.org\/groups\/crsj\/publications\/human_rights_magazine_home\/intersection-of-lgbtq-rights-and-religious-freedom\/lgbtq-students-at-religious-educational-institutions\/\" target=\"_blank\" rel=\"noreferrer noopener\"> American Bar Association<\/a>, by lifting their ban on same-sex dating while continuing to bar all sex outside traditional marriage.\u00a0Shirley Hoogstra, president of the Council for Christian Colleges and Universities, <a href=\"https:\/\/www.patheos.com\/blogs\/anxiousbench\/2019\/12\/fairness-for-all\/\" target=\"_blank\" rel=\"noreferrer noopener\">has urged members<\/a> to find \u201ccommon ground\u201d with LGBTQ advocates without abandoning their key beliefs.<\/p>\n<p>These Christian colleges and universities are siding with Yeshiva. Their fates are linked. At stake is the freedom to teach religious beliefs on a campus that puts them into practice.<\/p>\n<p>Advocating for LGBTQ rights is popular, while the left considers religious rights second-class.\u00a0But the Supreme Court is poised to correct that. The court\u2019s majority apparently understands what politicians ignore: When it comes to rights, you can\u2019t pick and choose.
