In that decision, the high court\u2019s originalist-leaning 6-3 majority found it unconstitutional for the government to require people to demonstrate a \u201cproper cause\u201d in order to obtain a license to carry a gun outside of their homes.<\/p>\n<p>Instead of demanding that license applicants prove they have a good cause, the CCIA prevents those who already hold a license from carrying a handgun in designated \u201csensitive locations,\u201d including, but not limited to, public transportation, public parks, and all \u201cprivate property open to the public.\u201d It also automatically applies the \u201crestricted locations\u201d status to all private properties, where one may not carry concealed weapons unless property owners give \u201cexpress content\u201d for them to do so.<\/p>\n<figure id=\"attachment_4731061\" class=\"wp-caption alignnone\"><a href=\"https:\/\/img.theepochtimes.com\/assets\/uploads\/2022\/09\/14\/GettyImages-1419726238-1200x800.jpg\"><figcaption class=\"wp-caption-text\"><noscript><img loading=\"lazy\" decoding=\"async\" class=\"size-large wp-image-4731061\" src=\"https:\/\/img.theepochtimes.com\/assets\/uploads\/2022\/09\/14\/GettyImages-1419726238-1200x800.jpg\" alt=\"Epoch Times Photo\" width=\"640\" height=\"427\" \/><\/noscript><\/figcaption><\/a> People walk past a \u201cGun Free Zone\u201d sign at New York City\u2019s Times Square on Aug. 31, 2022. Santiago\/Getty Images)<\/figure>\n<p>In their complaint (<a href=\"https:\/\/www.saf.org\/wp-content\/uploads\/2022\/09\/001-Boron-v-Bruen-FILED-Civil-Cover-Sheet-Complaint-with-Ex.-A-C.pdf\">pdf<\/a>), the SAF argued that the new rule is just as unconstitutional as the now-nullified \u201cproper cause\u201d law.<\/p>\n<p>\u201cS51001 replaced one unconstitutional licensing scheme with another, and worse, implemented expansive new criminal laws that ban carry of firearms in so-called \u2018sensitive locations\u2019 and presumptively on most property in the state\u2014even for those who lawfully acquire and possess a license under the State\u2019s onerous new licensing scheme,\u201d the complaint read.<\/p>\n<p>\u201cThe State\u2019s designation of these \u2018sensitive\u2019 or \u2018restricted\u2019 locations constitutes a de facto ban on the carriage of loaded, operable handguns for self-defense,\u201d it added.<\/p>\n<p>According to the pro-gun right groups, the definition of \u201csensitive location\u201d is so broad that it effectively renders a valid concealed carry license meaningless. For example, the CCIA classifies \u201cpublic parks,\u201d which come in all shapes and sizes, as sensitive locations. This means one cannot legally conceal and carry a gun for self-defense in for example Adirondack Park, six million acres of wilderness covering roughly one-fifth of New York State\u2019s land area.<\/p>\n<p>The groups also took issue with the automatic designation of all private properties as \u201crestricted locations,\u201d arguing that it \u201cessentially deputizes all property owners in the State to effectuate a carry ban that the Supreme Court most recently invalidated.\u201d<\/p>\n<p>Brett Christian, who is listed as a plaintiff, claimed that the CCIA is preventing him from carrying his weapon for self-defense when going about his day-to-day life.<\/p>\n<p>Specifically, according to the complaint, Christian can no longer brings his gun with him during weekly visits to gas stations and monthly visits to hardware stores. Instead, he has to disable and store the gun before even walking into or driving his car near these \u201csensitive locations\u201d in order not to commit a criminal offense. He is also unable to carry for self-defense when visiting local parks or hiking on trails, including the Adirondacks, a place he plans to see again later this year.<\/p>\n<p>\u201cThe fact that New York\u2019s new regulatory scheme essentially prohibits lawful carry in most public places is outrageous,\u201d SAF founder and vice president Alan Gottlieb said. \u201cThe state is being too clever by half, and we\u2019re confident that the federal courts, with the recent guidance from the Supreme Court on Second Amendment jurisprudence, will bring a quick end to this nonsense.\u201d<\/p>\n<p>The CCIA took effect on Sept. 1 after <a href=\"https:\/\/ag.ny.gov\/press-release\/2022\/attorney-general-james-successfully-defends-new-yorks-gun-control-laws\">surviving a court challenge<\/a> to block its enactment by Gun Owners of America, a pro-Second Amendment organization based in Virginia.
