Credit: Franmarie Metzler, U.S. House of Representatives<\/figcaption><\/figure>\n<p><strong>Overview<\/strong><\/p>\n<p>On the day before President Biden announced that he is \u201cforgiving\u201d part or all of the student loans of nearly everyone who owes them, his administration released a legal memo declaring that he had the authority to do this under a 2003 law.<\/p>\n<p>That claim is belied by Congressional records recently unearthed by Just Facts. These reveal that Congress voted to pass the law by a margin of more than 500 to 1 because it did not authorize any actions that would cost money.<\/p>\n<p>In contrast, Biden\u2019s decision to cancel student loans and alter their payment terms will cost from $605 billion to more than $1 trillion over the next 10 years. That amounts to an average cost of roughly $4,700 to $7,700 for every household in the United States.<\/p>\n<p>Before this, both Biden and Trump took similarly illegal actions to cancel interest on student loans, costing tens of billions of dollars.<\/p>\n<p>The illegality of these actions is confirmed by the text of the law and Supreme Court decisions on similar cases dealing with presidential power grabs.<\/p>\n<p><strong>Interest Cancellations<\/strong><\/p>\n<p>When the Covid-19 pandemic <a href=\"https:\/\/web.archive.org\/web\/20200311204240\/https:\/www.who.int\/dg\/speeches\/detail\/who-director-general-s-opening-remarks-at-the-media-briefing-on-covid-19---11-march-2020\">began<\/a> in March 2020, the Trump administration <a href=\"https:\/\/www2.ed.gov\/news\/newsletters\/edreview\/2020\/0320.html\">announced<\/a> that federal student loan borrowers won\u2019t be charged any interest on their loans for \u201cat least 60 days.\u201d The administration <a href=\"https:\/\/crsreports.congress.gov\/product\/pdf\/lsb\/lsb10568#page=2\">cited no<\/a> legal authority for this decision, but within a week, Congress passed and President Trump <a href=\"https:\/\/www.congress.gov\/bill\/116th-congress\/house-bill\/748\/actions\">signed<\/a> a Covid relief <a href=\"https:\/\/www.congress.gov\/bill\/116th-congress\/house-bill\/748\/text\">law<\/a> that suspended all federal student loan interest and payments for about six months through September 30, 2020.<\/p>\n<p>After that, Trump and Biden <a href=\"https:\/\/crsreports.congress.gov\/product\/pdf\/lsb\/lsb10568#page=2\">extended<\/a> this policy for nearly two years even though Congress didn\u2019t pass another law to extend the timeframe. Consequently, <a href=\"https:\/\/www.justfacts.com\/education#loans_history\">only 1%<\/a> of all federal student loans are now actively being repaid:<\/p>\n<p><a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2022\/09\/student_loans_repayment_2017-2022Q2.png\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-10588\" src=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2022\/09\/student_loans_repayment_2017-2022Q2.png\" alt=\"\" width=\"607\" height=\"441\" srcset=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2022\/09\/student_loans_repayment_2017-2022Q2.png 977w, https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2022\/09\/student_loans_repayment_2017-2022Q2-300x218-1.png 300w, https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2022\/09\/student_loans_repayment_2017-2022Q2-768x557-1.png 768w, https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2022\/09\/student_loans_repayment_2017-2022Q2-640x464-1.png 640w\" \/><\/a><\/p>\n<p>The <a href=\"https:\/\/www.gao.gov\/products\/gao-22-105365\">U.S. Government Accountability Office<\/a> estimates that these interest cancellations have cost $102 billion.<\/p>\n<p><strong>Loan Cancellations<\/strong><\/p>\n<p>In August 2022\u2014after <a href=\"https:\/\/www.businessinsider.com\/aoc-student-loan-forgiveness-left-unsaid-state-of-the-union-2022-3\">heavy pressure<\/a> from the <a href=\"https:\/\/www.democrats.senate.gov\/news\/press-releases\/schumer-warren-jayapal-pressley-omar-porter-urge-president-biden-to-deliver-on-promise-to-cancel-student-debt\">left-most faction<\/a> of the Democratic party and <a href=\"https:\/\/news.gallup.com\/poll\/391733\/biden-job-approval-down-among-younger-generations.aspx\">falling support<\/a> from young voters\u2014Biden <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/statements-releases\/2022\/08\/24\/fact-sheet-president-biden-announces-student-loan-relief-for-borrowers-who-need-it-most\/\">announced<\/a> that he is:<\/p>\n<ul>\n<li>cancelling up to $20,000 of student loan debt for people who have received Pell grants, the <a href=\"https:\/\/crsreports.congress.gov\/product\/pdf\/R\/R45418\">largest source<\/a> of federal tuition handouts for low-income college students.<\/li>\n<li>cancelling up to $10,000 of federal student loan debt for other borrowers who did not receive Pell grants.<\/li>\n<li>making these cancellations applicable to individuals currently earning up to $125,000 per year and couples earning up to $250,000, regardless of their future earnings capacity.<\/li>\n<li>altering loan repayment terms \u201cfor both current and future borrowers\u201d in ways that will reduce the average annual student loan payment \u201cby more than $1,000.\u201d<\/li>\n<\/ul>\n<p>On the day before Biden announced those actions, his administration released a <a href=\"https:\/\/www2.ed.gov\/policy\/gen\/leg\/foia\/secretarys-legal-authority-for-debt-cancellation.pdf\">legal memo<\/a> declaring that he had the authority to do all this under the Higher Education Relief Opportunities for Students Act of 2003, or \u201cHEROES\u201d Act.<\/p>\n<p><strong>The Legislative Record<\/strong><\/p>\n<p>The HEROES Act of 2003 was <a href=\"https:\/\/www.congress.gov\/bill\/108th-congress\/house-bill\/1412\/text?r=1&amp;s=1\">sponsored<\/a> by Republican John Kline of Minnesota, who had served <a href=\"https:\/\/news.va.gov\/76700\/veteranoftheday-marine-corps-veteran-john-kline\/\">25 years<\/a> as a U.S. Marine. When he <a href=\"https:\/\/www.congress.gov\/congressional-record\/volume-149\/issue-48\/extensions-of-remarks-section\/article\/E561-4\">introduced<\/a> the bill in the House of Representatives, he declared that it would help \u201cthe troops who protect and defend the United States.\u201d<\/p>\n<p>At that time, many college students and recent grads who were members of the National Guard and Reserves were <a href=\"https:\/\/www.congress.gov\/congressional-record\/volume-149\/issue-52\/house-section\/article\/H2522-5\">being deployed<\/a> to carry out Operation Iraqi Freedom and anti-terror operations in response to the slaughter of <a href=\"https:\/\/www.britannica.com\/event\/September-11-attacks\">2,977 people<\/a> on 9\/11.<\/p>\n<p>Stating that the bill was \u201csimple in its purpose\u201d and \u201cspecific in its intent,\u201d Kline explained that it will \u201cassist students who are being called up to active duty or active service\u201d and those who are impacted by \u201ca war, military contingency operation or a national emergency.\u201d He also emphasized that the bill would do this \u201cwithout affecting the integrity\u201d of student loan programs.<\/p>\n<p>Demonstrating just how simple and specific the bill was, the <a href=\"https:\/\/www.congress.gov\/bill\/108th-congress\/house-bill\/1412\/all-actions?r=1&amp;overview=closed&amp;s=1#tabs\">official legislative record<\/a> shows that the House of Representatives passed it by a vote of 421\u20131 with only \u201cforty minutes of debate.\u201d The Senate then passed it \u201cwithout amendment by unanimous consent.\u201d If all 100 senators were present, this is a margin of 521 to 1.<\/p>\n<p>The only legislator to <a href=\"https:\/\/clerk.house.gov\/Votes\/200396\">vote against<\/a> it in all of Congress was George Miller, a Democrat from California.<\/p>\n<p><strong>The Debate<\/strong><\/p>\n<p>What took place during the 40 minutes of House debate is even more telling. A <a href=\"https:\/\/www.congress.gov\/congressional-record\/volume-149\/issue-52\/house-section\/article\/H2522-5\">transcript<\/a> of this debate was recently unearthed by <a href=\"https:\/\/www.justfacts.com\/\">Just Facts<\/a>, and it shows that the bill did not authorize any actions that would cost money.<\/p>\n<p>Kline opened the debate by having a clerk read the text of bill. Kline then stated that the HEROES Act would relieve financial burdens on soldiers \u201cwhile they defend our nation\u201d and again emphasized that it will do this \u201cwithout affecting the integrity\u201d of student loan programs.<\/p>\n<p>In response, Democrat Tim Ryan of Ohio noted that under the bill, the \u201cinterest\u201d on these loans \u201cwill still be accruing; so this is a great first step, but I think we can do much better.\u201d He then recommended that Congress pass an additional bill that will pay for this interest. \u201cI have a bill that is the Active Reservists and National Guard Student Loan Relief Act which would do this,\u201d said Ryan, \u201cand I think we should look into it.\u201d<\/p>\n<p>After a few others spoke, Ryan explained that \u201cunder the current legislation that we are dealing with,\u201d a reservist in his district named Krista Rosado who was called to active duty for up to two years \u201cwill accrue over $1,400 in additional interest on her loan. So when she does get back from service, she will owe this money.\u201d He then stated:<\/p>\n<blockquote>\n<p>I think the natural next step for us to take is to say to Krista, thank you for your service, thank you for your sacrifice, and we will take care of the interest on your loan while you were over serving your country.<\/p>\n<\/blockquote>\n<p>Republican John Boehner of Ohio then replied to Ryan that \u201cwe have worked on his important addition to this bill, but under the 1973 Budget Act we are required to find offsets.\u201d This <a href=\"https:\/\/www.gao.gov\/assets\/aimd-98-213r.pdf\">means<\/a> that other spending must be reduced so that the bill doesn\u2019t increase the federal deficit.<\/p>\n<p>Boehner then added that Ryan\u2019s bill would cost about $10 million and \u201cwe will continue to work with you to try to find these offsets under the Budget Act so that we can, in fact, bring this bill to the floor.\u201d Ultimately, Ryan\u2019s bill <a href=\"https:\/\/www.congress.gov\/bill\/108th-congress\/house-bill\/1168\/actions?q=%7B%22search%22%3A%5B%22Active+Reservists+and+National+Guard+Student+Loan+Relief+Act%22%2C%22Active%22%2C%22Reservists%22%2C%22and%22%2C%22National%22%2C%22Guard%22%2C%22Student%22%2C%22Loan%22%2C%22Relief%22%2C%22Act%22%5D%7D&amp;r=1&amp;s=3\">never passed<\/a>.<\/p>\n<p>That exchange, along with many other statements during the debate, prove that the HEROES Act only allowed for the <a href=\"https:\/\/www.thefreedictionary.com\/deferral\">deferral<\/a> or <a href=\"https:\/\/www.thefreedictionary.com\/forbearance\">forbearance<\/a> of student loans\u2014not the cancellation of interest, much less cancelling the actual loans. These actions cost money, thus impairing the integrity of the program.<\/p>\n<p>The debate also reveals that the bill applies to active-duty soldiers and people who are specifically harmed by a national disaster, not virtually everyone who owes student loans.<\/p>\n<p>A few excerpts from many statements in <a href=\"https:\/\/www.congress.gov\/congressional-record\/volume-149\/issue-52\/house-section\/article\/H2522-5\">the debate<\/a> that confirm the above include the following:<\/p>\n<ul>\n<li>\u201ctheir loan payments are deferred until they return\u201d<\/li>\n<li>\u201cforbear a loan as our servicemen and servicewomen are activated\u201d<\/li>\n<li>\u201cspecific needs of each student whose education is interrupted when they are called to service\u201d<\/li>\n<li>\u201cdisrupted by a national disaster\u201d<\/li>\n<li>\u201cin the case of a national emergency,\u201d the Secretary of Education \u201ccan, in fact, defer these payments\u201d<\/li>\n<\/ul>\n<p><strong>The Law<\/strong><\/p>\n<p>The text of the HEROES Act mirrors the debate. It states that <a href=\"https:\/\/www.congress.gov\/bill\/108th-congress\/house-bill\/1412\/text?r=1&amp;s=1\">the law<\/a>:<\/p>\n<ul>\n<li>applies to student loan borrowers who:\n<ul>\n<li>are \u201cserving on active duty during a war or other military operation,\u201d<\/li>\n<li>live or work in a \u201cdisaster area.\u201d<\/li>\n<li>\u201csuffered direct economic hardship as a direct result of a war or other military operation or national emergency\u2026.\u201d<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li>gives the Secretary of Education the ability to \u201cwaive or modify\u201d provisions of student loans to help such \u201caffected individuals.\u201d<\/li>\n<\/ul>\n<ul>\n<li>won\u2019t impair \u201cthe integrity of the student financial assistance programs.\u201d<\/li>\n<\/ul>\n<p><strong>Supreme Court Decisions<\/strong><\/p>\n<p>Confirming the illegality of Biden\u2019s and Trump\u2019s actions, the U.S. Supreme Court has a issued an array of rulings that have addressed similar power grabs by federal agencies <a href=\"https:\/\/www.whitehouse.gov\/about-the-white-house\/our-government\/the-executive-branch\/\">under<\/a> the authority of presidents. These include but are not limited to:<\/p>\n<ul>\n<li>the 1994 case of <em><a href=\"https:\/\/www.law.cornell.edu\/supremecourt\/text\/512\/218\">MCI v. AT&#038;T<\/a><\/em>, in which the Court ruled that a law allowing the Federal Communications Commission to \u201cmodify any requirement\u201d of a tariff filing provision for phone companies did not allow the FCC to cancel certain tariffs, since the word \u201cmodify\u201d means \u201cto change moderately or in minor fashion,\u201d not to \u201cfundamentally\u201d alter a law.<\/li>\n<\/ul>\n<ul>\n<li>the 2000 case of <em><a href=\"https:\/\/www.law.cornell.edu\/supremecourt\/text\/529\/120\">FDA Brown &#038; Williamson<\/a><\/em>, in which the Court ruled that \u201cCongress could not have intended to delegate a decision of such economic and political significance to an agency in so cryptic a fashion.\u201d<\/li>\n<\/ul>\n<ul>\n<li>the 2001 case of <em><a href=\"https:\/\/www.law.cornell.edu\/supremecourt\/text\/531\/457\">EPA v. American Trucking<\/a><\/em>, where the Court held that Congress \u201cdoes not alter the fundamental details of a regulatory scheme in vague terms or ancillary provisions\u2014it does not, one might say, hide elephants in mouseholes.\u201d<\/li>\n<\/ul>\n<ul>\n<li>in the 2022 case of <em><a href=\"https:\/\/www.law.cornell.edu\/supremecourt\/text\/20-1530\">West Virginia v. EPA<\/a><\/em>, in which the Court ruled that \u201cboth separation of powers principles and a practical understanding of legislative intent make us \u2018reluctant to read into ambiguous statutory text\u2019 the delegation claimed to be lurking there,\u201d and \u201cto convince us otherwise, something more than a merely plausible textual basis for the agency action is necessary. The agency instead must point to \u2018clear congressional authorization\u2019 for the power it claims.\u201d<\/li>\n<\/ul>\n<p><strong>Who Pays?<\/strong><\/p>\n<p>Biden administration officials <a href=\"https:\/\/www.newsbusters.org\/blogs\/nb\/curtis-houck\/2022\/08\/25\/checkmate-jacqui-heinrich-karine-jean-pierre-spar-over-legality\">have<\/a> repeatedly <a href=\"https:\/\/www.foxnews.com\/politics\/harris-dodges-question-who-will-pay-student-loan-handout\">dodged<\/a> questions about who will pay for Biden\u2019s actions, but the fact is that when people don\u2019t pay back student loans because politicians \u201cforgive\u201d them, this debt is transferred to other people who did not borrow the money.<\/p>\n<p>In the words of the <a href=\"https:\/\/www.gao.gov\/assets\/gao-19-484t.pdf\">U.S. Government Accountability Office<\/a>, \u201cWhen borrowers do not make payments on their federal student loans, and the loans are in default, the federal government and taxpayers are left with the costs.\u201d<\/p>\n<p>The Penn Wharton Budget Model <a href=\"https:\/\/budgetmodel.wharton.upenn.edu\/issues\/2022\/8\/26\/biden-student-loan-forgiveness\">estimates<\/a> that Biden\u2019s student loan cancellations and payment reductions will cost $605 billion to more than $1 trillion over the next 10 years. This amounts to an average cost of roughly <a href=\"https:\/\/www.justfacts.com\/education#loans_forgiveness\">$4,700 to $7,700<\/a> for every household in the United States.<\/p>\n<p>Those costs will not be equally borne because some households pay <a href=\"https:\/\/www.justfacts.com\/taxes#distribution\">far more taxes<\/a> than others. However, even people who don\u2019t pay taxes will suffer the consequences of this spending. That\u2019s because the government is running <a href=\"https:\/\/www.justfacts.com\/nationaldebt#politics-current\">massive deficits<\/a>, so this money will be added to the national debt, which can <a href=\"https:\/\/www.justfacts.com\/nationaldebt#consequences\">manifest<\/a> in inflation, reduced standards of living, lower wages, or combinations of these and other harmful results.<\/p>\n<p>Those costs are in addition to ongoing taxpayer funding of higher education, which exceeds <a href=\"https:\/\/www.justfacts.com\/education#higher_spend_taxpayer\">$200 billion<\/a> per year. Contrary to the <a href=\"https:\/\/www.justfactsdaily.com\/leading-progressives-blame-the-wrong-culprit-for-rising-college-costs\">claims<\/a> of Elizabeth Warren, Bernie Sanders, and certain media outlets, average <a href=\"https:\/\/www.justfacts.com\/education#higher_spend_taxpayer\">government spending<\/a> for each college student has risen by 2.9 times per student since 1960, even after accounting for inflation:<\/p>\n<p><a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2022\/09\/government_spending_higher_education_student_1959-2022.png\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-10589\" src=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2022\/09\/government_spending_higher_education_student_1959-2022.png\" alt=\"\" width=\"605\" height=\"440\" srcset=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2022\/09\/government_spending_higher_education_student_1959-2022.png 974w, https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2022\/09\/government_spending_higher_education_student_1959-2022-300x218-1.png 300w, https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2022\/09\/government_spending_higher_education_student_1959-2022-768x559-1.png 768w, https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2022\/09\/government_spending_higher_education_student_1959-2022-640x466-1.png 640w\" \/><\/a><\/p>\n<p>Over the same period, colleges have greatly reduced <a href=\"https:\/\/www.justfacts.com\/education#higher_out_effort\">academic loads<\/a>, significantly <a href=\"https:\/\/www.gradeinflation.com\/\">inflated grades<\/a>, and failed to instill <a href=\"https:\/\/www.justfacts.com\/education#higher_out_skills\">practical and literacy skills<\/a> in large portions of their students.<\/p>\n<p><strong>Summary<\/strong><\/p>\n<p>When Biden announced that he is cancelling student loans, House Speaker Nancy Pelosi (D\u2013CA) <a href=\"https:\/\/www.speaker.gov\/newsroom\/82422-2\">praised<\/a> this as \u201ca strong step in Democrats\u2019 fight to expand access to higher education.\u201d Yet, a little more than a year earlier, Pelosi <a href=\"https:\/\/www.speaker.gov\/newsroom\/72821-2\">stated<\/a>:<\/p>\n<blockquote>\n<p>People think that the President of the United States has the power for debt forgiveness. He does not. He can postpone. He can delay. But he does not have that power. That has to be an act of Congress. (Hat tip: <a href=\"https:\/\/nypost.com\/2022\/08\/24\/pelosi-flip-flops-on-bidens-student-debt-forgiveness-plan\/\">Callie Patteson<\/a>)<\/p>\n<\/blockquote>\n<p>The Biden administration claims that the HEROES Acts of 2003 gives them that power, but Congressional records prove just the opposite is true. These include the introduction of the law, the debate of the law, the votes on the law, and the text of the law.<\/p>\n<p>Moreover, the Supreme Court has repeatedly affirmed that unless Congress clearly delegates such powers to the president, these types of actions are illegal.<\/p>\n<p>Unless Biden\u2019s student loan decrees are successfully challenged in court, the costs of them will fall on people who did not borrow the money.
