The Crossfire Hurricane investigation was plagued with problems from the outset. The reasons for opening the investigation were bunk. Those problems continued as the investigation went on, with claims of Trump\/Russia collusion proven unverified or outright false. (Thus the targeting of Flynn for a Logan Act violation.) <\/span><\/p>\n<p>That developed into the Carter Page FISA applications, first submitted to the Foreign Intelligence Surveillance Court (FISC) in October 2016, and which relied substantially on the Steele Dossiers (aka Steele Reports). The FISA applications were renewed three times &#8211; more on that later. Each application had its own problems, from FBI lawyers lying about Carter Page to the Court being generally misled. <\/p>\n<p>Realizing its own misconduct, the FBI made Danchenko a paid CHS in March 2017 &#8211; just before the third FISA warrant was submitted in April 2017. This would allow Comey\u2019s FBI to work directly with Danchenko in support of its counter-intelligence investigation against President Trump. <\/p>\n<p>Danchenko being a CHS also served another purpose: it protected the Bureau and the Mueller Special Counsel from revealing their \u201csources and methods.\u201d How do you hide misconduct? Bury the witness.<\/p>\n<p><span>(Read again Inspector General Horowitz\u2019s <\/span><a href=\"https:\/\/www.justice.gov\/storage\/120919-examination.pdf\" rel=\"\">report <\/a><span>concerning the Carter Page FISA warrants. Did Horowitz know that Danchenko was a CHS?)<\/span><\/p>\n<p>Context helps &#8211; here\u2019s a brief timeline of the Danchenko interviews and other important events: <\/p>\n<ul>\n<li>\n<p><strong>October 2016:<\/strong><span> The first Carter Page FISA warrant is submitted to the FISC.<\/span><\/p>\n<\/li>\n<li>\n<p><strong>January 12, 2017:<\/strong><span> The application for the second FISA warrant is submitted to the FISC.<\/span><\/p>\n<\/li>\n<li>\n<p><strong>January 24-25, 2017:<\/strong><span> Danchenko is first interviewed by the FBI. At those meetings, he made false statements that he spoke to Sergei Millian by phone <\/span><em>and<\/em><span> that Millian agreed to meet him in New York. Both those claims were false.<\/span><\/p>\n<\/li>\n<li>\n<p><strong>March 2017: Danchenko is hired by the FBI as a CHS.<\/strong><\/p>\n<\/li>\n<li>\n<p><strong>March 16, 2017:<\/strong><span> Danchenko lies to FBI agents that \u201che received a late July 2016 telephone call from an individual who Danchenko believed was \u2018probably\u2019 [Millian&#8221;], when in truth and in fact, and as the defendant well knew, [Millian] never called Danchenko.\u201d<\/span><\/p>\n<\/li>\n<li>\n<p><strong>April 7, 2017:<\/strong><span> The application for the third FISA warrant is submitted to the FISC.<\/span><\/p>\n<\/li>\n<li>\n<p><strong>May 9, 2017:<\/strong><span> President Trump fires FBI Director James Comey.<\/span><\/p>\n<\/li>\n<li>\n<p><strong>May 17, 2017:<\/strong><span> Robert Mueller is appointed Special Counsel.<\/span><\/p>\n<\/li>\n<li>\n<p><strong>May 18, 2017:<\/strong><span> Danchenko falsely states to FBI agents that he \u201c\u2018was under the impression\u2019 that a late July 2016 telephone call he received was from [Millian&#8217;]\u201d when in fact Millian never called Danchenko.<\/span><\/p>\n<\/li>\n<li>\n<p><strong>June 15, 2017:<\/strong><span> Danchenko lies to FBI agents that he had never \u201cspoken with PR Executive-1\u201d (Dolan) about the dossier allegations.<\/span><\/p>\n<\/li>\n<li>\n<p><strong>June 29, 2017:<\/strong><span> The application for the <\/span><strong>fourth FISA warrant<\/strong><span> is submitted to the FISC.<\/span><\/p>\n<\/li>\n<li>\n<p><strong>October 24, 2017:<\/strong><span> Danchenko lies to FBI agents, stating that he had spoken to Millian \u201con the telephone on more than one occasion.\u201d<\/span><\/p>\n<\/li>\n<li>\n<p><strong>November 16, 2017:<\/strong><span> Danchenko lies to the FBI against, stating \u201che had spoken to [Millian] on the telephone\u201d when he knew he never did.<\/span><\/p>\n<\/li>\n<li>\n<p><strong>December 9, 2019:<\/strong><span> The Horowitz report is released, detailing the DOJ\/FBI\/Mueller FISA abuse.<\/span><\/p>\n<\/li>\n<li>\n<p><strong>October 19, 2020:<\/strong><span> John Durham is <\/span><a href=\"https:\/\/www.justice.gov\/file\/1370931\/download\" rel=\"\">appointed <\/a><span>Special Counsel.<\/span><\/p>\n<\/li>\n<li>\n<p><strong>October 2020:<\/strong><span> Danchenko is terminated as a CHS.<\/span><\/p>\n<\/li>\n<\/ul>\n<p><span>For background purposes, here\u2019s our discussion on the <\/span><a href=\"https:\/\/technofog.substack.com\/p\/the-igor-danchenko-indictment\" rel=\"\">Danchenko indictment<\/a><span> and <\/span><a href=\"https:\/\/technofog.substack.com\/p\/what-did-the-fbi-have-on-danchenko\" rel=\"\">what the FBI knew about Danchenko\u2019s Clinton connections<\/a><span>. Recall that Danchenko was indicted for multiple false statements given to federal officials during the Trump\/Russia investigation. Anyways, back to today\u2019s motion.<\/span><\/p>\n<p><strong>The Motion in Limine<\/strong><\/p>\n<p>When the Steele Reports were released, the media picked-up on the most salacious rumors, one that was utterly unbelievable: that Russian intelligence had a video of Trump involved with prostitutes at the Moscow Ritz-Carlton Hotel. Also known as the \u201cpee tape.\u201d <\/p>\n<p>The allegation came from Danchenko, who attributed it to his sources &#8211; one from the Ritz-Carlton, and another being Sergei Millian. Durham will refute it, as it expects to call at trial \u201cBernd Kuhlen,\u201d the then-general manager of the Ritz-Carlton, who will deny speaking with or ever meeting Danchenko \u201cin June 20165, or at any time.\u201d <\/p>\n<div class=\"captioned-image-container\">\n<figure><a class=\"image-link is-viewable-img image2\" target=\"_blank\" href=\"https:\/\/substackcdn.com\/image\/fetch\/f_auto,q_auto:good,fl_progressive:steep\/https%3A%2F%2Fbucketeer-e05bbc84-baa3-437e-9518-adb32be77984.s3.amazonaws.com%2Fpublic%2Fimages%2F4817287d-6486-423f-bf2d-0a28b2d46038_577x254.png\" rel=\"noopener\"><\/p>\n<div class=\"image2-inset\"><source type=\"image\/webp\" \/><img src width=\"577\" height=\"254\" data-attrs=\"{\" \/><\/p>\n<div class=\"image-link-expand\"><\/div>\n<\/div>\n<p><\/a><\/figure>\n<\/div>\n<p><span>As to Sergei Millian (more on him later), Durham will show that Danchenko falsely stated to the FBI that this information from Millian \u201ccame from a single ten, or fifteen minute anonymous phone call that allegedly took place in late-July 2016.\u201d That timing is of particular importance, as explained by Durham:<\/span><\/p>\n<div class=\"captioned-image-container\">\n<figure><a class=\"image-link is-viewable-img image2\" target=\"_blank\" href=\"https:\/\/substackcdn.com\/image\/fetch\/f_auto,q_auto:good,fl_progressive:steep\/https%3A%2F%2Fbucketeer-e05bbc84-baa3-437e-9518-adb32be77984.s3.amazonaws.com%2Fpublic%2Fimages%2Fdb81040f-7f29-446b-a265-cfcb2c74a703_587x295.png\" rel=\"noopener\"><\/p>\n<div class=\"image2-inset\"><source type=\"image\/webp\" \/><img src width=\"587\" height=\"295\" data-attrs=\"{\" \/><\/p>\n<div class=\"image-link-expand\"><\/div>\n<\/div>\n<p><\/a><\/figure>\n<\/div>\n<p>Then there are Danchenko\u2019s false statements about Charles Dolan, an influential Democrat executive with ties to the Clintons. Interestingly, it was Dolan who was given a tour of the Ritz-Carlton Presidential Suite, which was the supposed location of \u201cTrump\u2019s alleged lurid sexual activities.\u201d <\/p>\n<div class=\"subscription-widget-wrap\">\n<div class=\"subscription-widget show-subscribe\">\n<div class=\"preamble\">\n<p>The Reactionary is a reader-supported publication. According to Durham:<\/p>\n<blockquote>\n<p>the Government anticipates that Mr. Dolan will testify that (1) it was he and Mr. Kupka who attended a lunch with the Ritz-Carlton general manager and other hotel staff during the June 2016 Moscow trip and that [Danchenko] was not present, and (2) neither Donald Trump nor his purported sexual practices were ever discussed at that lunch.  Further, the Government also anticipates that Mr. Dolan will testify that Ritz-Carlton hotel staff did, in fact, provide the aforementioned tour of the presidential suite as part of the June 2016 trip and that, again, Donald Trump and his purported sexual practices were not discussed during that tour.<\/p>\n<\/blockquote>\n<p><span>What is Durham\u2019s theory on Danchenko\u2019s motive for lying about the Ritz-Carlton allegations? Because it reflects <\/span><strong>\u201ca deliberate effort to conceal from the FBI Charles Dolan\u2019s role as a source for the Steele Reports and to deceive the FBI regarding Millian\u2019s role (or lack thereof).\u201d<\/strong><\/p>\n<p>In support of the theory that Danchenko engaged in an \u201cover-arching \u2018plan\u2019 to deceive the FBI\u201d about his work for Orbis (the company who collected the information contained in the Steele Reports), Durham also plans to introduce:<\/p>\n<ul>\n<li>\n<p>Evidence that Danchenko \u201con multiple occasions communicated and emailed with, among others, Charles Dolan regarding his work for Steele and Orbis.\u201d<\/p>\n<\/li>\n<li>\n<p>\u201cEvidence that proves Dolan was aware of [Danchenko\u2019s] reporting was part of a \u2018related project against Trump\u2019 and that this work was being done on behalf of Steele and Orbis.\u201d<\/p>\n<\/li>\n<\/ul>\n<p>There\u2019s more. Back in February 2016, nearly a year before his FBI interview and months before he started collecting information for Christopher Steele, Danchenko told a former employer how to fabricate sources:<\/p>\n<div class=\"captioned-image-container\">\n<figure><a class=\"image-link image2\" target=\"_blank\" href=\"https:\/\/substackcdn.com\/image\/fetch\/f_auto,q_auto:good,fl_progressive:steep\/https%3A%2F%2Fbucketeer-e05bbc84-baa3-437e-9518-adb32be77984.s3.amazonaws.com%2Fpublic%2Fimages%2Ffbb131f7-364a-40c9-a0a3-815de8dd8b30_696x178.png\" rel=\"noopener\"><\/p>\n<div class=\"image2-inset\"><source type=\"image\/webp\" \/><img src width=\"696\" height=\"178\" data-attrs=\"{\" \/><\/p>\n<div><\/div>\n<\/div>\n<p><\/a><\/figure>\n<\/div>\n<p><span>The relevance of that e-mail? Danchenko\u2019s advice to \u201cattach multiple sources to information and obscure one\u2019s own role as a source for information is consistent with [Danchenko\u2019s] alleged false statements in which he denied or fabricated the roles of these individuals.\u201d<\/span><\/p>\n<p><strong>The E-Mails and Steele\u2019s Representations to the FBI<\/strong><\/p>\n<p>Also expected at trial, if allowed by the judge, are e-mails to\/from Danchenko where he discusses his unsuccessful efforts to reach Millian. <\/p>\n<div class=\"captioned-image-container\">\n<figure><a class=\"image-link is-viewable-img image2\" target=\"_blank\" href=\"https:\/\/substackcdn.com\/image\/fetch\/f_auto,q_auto:good,fl_progressive:steep\/https%3A%2F%2Fbucketeer-e05bbc84-baa3-437e-9518-adb32be77984.s3.amazonaws.com%2Fpublic%2Fimages%2Fbee2b8e2-a0fa-4988-aed6-8bce1950c42f_699x508.png\" rel=\"noopener\"><\/p>\n<div class=\"image2-inset\"><source type=\"image\/webp\" \/><img src width=\"699\" height=\"508\" data-attrs=\"{\" \/><\/p>\n<div class=\"image-link-expand\"><\/div>\n<\/div>\n<p><\/a><\/figure>\n<\/div>\n<p><span>Additionally, there\u2019s an email where Christopher Steele informed the FBI that Danchenko \u201chad met with Sergei Millian on two or three occasions &#8211; at least once in New York and once in Charleston, South Carolina.\u201d <\/span><\/p>\n<div class=\"captioned-image-container\">\n<figure><a class=\"image-link is-viewable-img image2\" target=\"_blank\" href=\"https:\/\/substackcdn.com\/image\/fetch\/f_auto,q_auto:good,fl_progressive:steep\/https%3A%2F%2Fbucketeer-e05bbc84-baa3-437e-9518-adb32be77984.s3.amazonaws.com%2Fpublic%2Fimages%2Fa7b98d4e-1c85-447b-b065-57c25ac8c7cd_741x365.png\" rel=\"noopener\"><\/p>\n<div class=\"image2-inset\"><source type=\"image\/webp\" \/><img src width=\"741\" height=\"365\" data-attrs=\"{\" \/><\/p>\n<div class=\"image-link-expand\"><\/div>\n<\/div>\n<p><\/a><\/figure>\n<\/div>\n<p><span>We brought up Mueller back at the introduction, and here\u2019s why. Steele relayed information to the Mueller Special Counsel about the Millian\/Danchenko meetings that they <\/span><em>knew was false<\/em><span>. Similarly, Danchenko revealed information that Steele\u2019s reporting was false. What did Team Mueller do with that information? They hid it from the FISA Court and from the public. Danchenko continued as a CHS throughout Mueller\u2019s service as Special Counsel. Danchenko couldn\u2019t be touched because of his status as CHS, thus protecting Mueller and the FBI. <\/span><\/p>\n<p><strong>Sergei Millian Will Not Testify at Trial.<\/strong><\/p>\n<p>Sergei Millian, a key witness for Durham, will not testify at trial. Millian is currently abroad. He has voiced his concerns for his safety, stating he does not trust the FBI. Can\u2019t really blame him at this point. At this point, Durham can\u2019t compel Millian\u2019s attendance. <\/p>\n<p>Certainly Millian is a key witness. But key doesn\u2019t mean necessarily mean essential. The Danchenko e-mails and inconsistent claims are damning enough, and he can be convicted in Millian\u2019s absence.
