In a separate order, Judge Aileen Cannon ordered the DOJ to stop its review of the materials that were taken from Trump\u2019s Florida residence last month, while the DOJ has indicated it will appeal.<\/p>\n<p>With the order, Dearie will\u00a0\u201creview all of the materials seized\u201d during the <a href=\"https:\/\/www.theepochtimes.com\/t-fbi\">FBI<\/a> raid and will have to verify documents in a property inventory to reflect the \u201cproperty seized.\u201d The judge also is tasked with carrying out a \u201cprivilege review\u201d of the items that were taken and has to inform the court if there are\u00a0\u201cprivilege disputes between the parties.\u201d<\/p>\n<p>Dearie was appointed by President Ronald Reagan in 1986 for New York. He retired in 2011 and is now a senior judge in the district.<\/p>\n<p>Dearie was the former U.S. Attorney for the Eastern District of New York. He became the chief judge of the\u00a0Eastern District from 2007 to 2011, and he remains an active judge on senior status.<\/p>\n<p>Notably, he served on the\u00a0Foreign Intelligence Surveillance (FISA) court for several years. He was one of several judges who approved warrants for the FBI\u2019s surveillance targeting former Trump aide Carter Page in 2016 as part of the bureau\u2019s Crossfire Hurricane investigation, which triggered Trump\u2019s allegations of malfeasance against the federal law enforcement agency.<\/p>\n<p>Federal investigators ultimately determined that an FBI lawyer, Kevin Clinesmith, altered an email to support the surveillance application. (Marco Bello\/Reuters)<\/figure>\n<p>A separate judge <a href=\"https:\/\/www.theepochtimes.com\/mkt_app\/federal-judge-unseals-more-portions-of-trump-search-warrant-affidavit_4728628.html?utm_source=andshare\">released more portions<\/a> of the affidavit used to secure the Mar-a-Lago search warrant, showing that some of the documents seized at Trump\u2019s home were labeled \u201cFISA,\u201d indicating they relate to information that was derived from foreign sources. It\u2019s not clear if those documents pertained to the Page investigation, though Trump and a former top aide of his, Kash Patel, have <a href=\"https:\/\/www.theepochtimes.com\/trump-says-he-declassified-fbi-crossfire-hurricane-materials-in-january-2021_4673516.html\">indicated<\/a> that he declassified records relating to Crossfire Hurricane.<\/p>\n<h2>Praise<\/h2>\n<p>After the special master ruling Thursday, Dearie was praised by lawyers who had argued cases in front of him.<\/p>\n<p>The judge is \u201cone of the few judges who both sides want to appear in front of. He is held in the highest regard by attorneys. He\u2019s someone who actually listens to the lawyers and considers what they have to say before he makes a decision,\u201d Lindsay Gerdes, a former Brooklyn federal prosecutor, <a href=\"https:\/\/www.politico.com\/news\/2022\/09\/15\/brooklyn-judge-raymond-dearie-mar-a-lago-00057085\">told<\/a> Politico.<\/p>\n<p>\u201cHe works incredibly well with parties, but doesn\u2019t tolerate nonsense,\u201d Richard Garbarini of Garbarini Fitzgerald P.C. told the news outlet. \u201cHe will not allow parties, or attorneys, to play games, or play fast-and-loose with the rules.\u201d<\/p>\n<p>Before Thursday\u2019s order, the DOJ had proposed Barbara Jones, a Clinton appointee and former federal judge, and former\u00a0federal appeals court judge Thomas Griffith. Trump\u2019s team, meanwhile, also proposed Florida-based attorney Thomas Huck.<\/p>\n<p>Trump\u2019s lawyers objected to both the DOJ\u2019s submissions, while government prosecutors objected to Huck but agreed with the Dearie proposal.<\/p>\n<p>At the same time, while the DOJ submitted its picks in the special master case, it simultaneously asked Judge Cannon to throw out the order.
