That order mandated all federal departments to \u201cconsider ways to expand citizens\u2019 opportunities to register to vote and to obtain information about, and participate in, the electoral process.\u201d Among these included the DOJ\u2019s 15-page \u201cstrategic plan\u201d on how the agency intends to comply with Biden\u2019s executive order.<\/p>\n<p>Instead of releasing the documents FGA requested pursuant to federal open records laws, however, the Biden DOJ released only a few records pertaining to the order, <a href=\"https:\/\/thefga.org\/fga-vs-doj\/\" target=\"_blank\" rel=\"noreferrer noopener\">most of which were heavily redacted.<\/a><\/p>\n<p>In one of the emails dated June 11, 2021, for example, Special Assistant to the Deputy White House Counsels Devontae Freeland writes to a redacted list of administration officials about the submission of June 15 interim reports regarding Biden\u2019s executive order.<\/p>\n<p>\u201cThank you for your work on the Promoting Access to Voting EO implementation plans,\u201d Freeland <a href=\"https:\/\/thefga.org\/wp-content\/uploads\/2022\/09\/CRT-9-8-22-Production-FGA_section-15.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">wrote<\/a>. \u201cThe interim reports, which are due this Tuesday 6\/15, can be submitted by email [redacted] as a Word doc. Don\u2019t hesitate to reach out if you have questions or concerns.\u201d<\/p>\n<p>In a <a href=\"https:\/\/thefga.org\/wp-content\/uploads\/2022\/09\/CRT-9-8-22-Production-FGA_section-16.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">separate email chain<\/a> dated June 21, 2021, Freeland discusses a proposed Zoom meeting between members of the administration and numerous \u201celection officials\u201d and \u201cnonprofit organizations\u201d engaged in \u201cvoting rights advocacy\u201d and those with \u201cexpertise in reaching out to \u2026 particular populations of voters who may be more difficult to reach.\u201d<\/p>\n<p>According to Freeland, the goal of the meeting was to purportedly garner \u201crecommendations\u201d and \u201cthoughts on best practices\u201d on how to best fulfill the requests in Biden\u2019s order.<\/p>\n<p>\u201cWe believe that these sessions will provide some helpful feedback as you further refine the strategic plans due to the Assistant to the President for Domestic Policy on September 23, 2021,\u201d the email reads.<\/p>\n<p>While the emails don\u2019t specify which election officials or nonprofits took part in the meeting, Freeland does say that the administration reached out to \u201c10 pragmatic state and local officials, from different parts of the country, serving very different constituencies,\u201d with the group including \u201cDemocrats and Republicans and those with no partisan affiliation.\u201d<\/p>\n<p>\u201cThe American people deserve to know if the Biden Administration\u2019s unprecedented action is fair and non-partisan, or if it is designed to help one political party over the other,\u201d said FGA President and CEO Tarren Bragdon in a <a href=\"https:\/\/thefga.org\/press\/doj-continues-to-suppress-documents-involving-voter-registration-projects\/\" target=\"_blank\" rel=\"noreferrer noopener\">statement<\/a>. \u201cWhy are they ignoring public record requests for strategic plans on federal voter registration efforts? Why are they treating these documents like they are classified information dealing with nuclear weapons? Midterms are approaching, and the DOJ\u2019s failure to disclose information raises troubling issues. They need to reveal these public documents to keep our elections fair.\u201d<\/p>\n<p>FGA sued the DOJ in April 2022 after the agency failed to respond to the organization\u2019s July 2021 open records requests related to Biden\u2019s order. Nearly a year later, on July 12, 2022, a federal district court judge <a href=\"https:\/\/thefga.org\/fga-vs-doj\/\" target=\"_blank\" rel=\"noreferrer noopener\">ordered<\/a> the DOJ to turn over the documents before the midterm elections. The DOJ did so, but with heavy redactions that defy the intent of the order.<\/p>\n<p>In addition to the Sept. 8 document dump, FGA is also scheduled to receive documents from the DOJ on Sept. 20 and Oct. 20, with the group set to publish such records on Sept. 27 and Oct. 25, respectively.<\/p>\n<p>Additional organizations that have filed <a href=\"https:\/\/thefederalist.com\/2022\/07\/20\/federal-court-orders-doj-release-docs-on-bidens-takeover-of-elections\/\" target=\"_blank\" rel=\"noreferrer noopener\">lawsuits<\/a> against the Biden administration for refusing to comply with open records requests related to Biden\u2019s directive include the American Accountability Foundation (AAF) and the Center for Renewing America (CRA). Filed against agencies including the Departments of Labor, Defense, and Education in the U.S. District Court for the District of Columbia, the litigation has yet to compel the administration to turn over federal records that would show how public employees are carrying out Biden\u2019s order.<\/p>\n<hr class=\"wp-block-separator\" \/>\n<p>Shawn Fleetwood is a Staff Writer for The Federalist and a graduate of the University of Mary Washington.
