The only challenge to the petition was that it failed to include all the constitutional provisions that would be abrogated by the proposed amendments,\u201d the court ruled. \u201cWe disagree. Instead, we conclude that the proposed amendments would not abrogate any of the constitutional provisions identified by the challenger. The Board thus has a clear legal duty to certify the petition.\u201d<\/p>\n<p>The Thursday ruling affirming the measure was comprised of the court\u2019s four Democrat-appointed justices and one Republican-appointed justice, with the remaining two Republican appointees dissenting.<\/p>\n<p>Last week, the proposed amendment was thought to be dead after the Board of Canvassers got deadlocked in a 2-2 vote on whether to place it on the ballot for the upcoming 2022 midterms, with the board\u2019s two Republicans siding \u201cwith a wording-related challenge from opposition group Defend Your Vote.\u201d<\/p>\n<p>\u201c[Defend Your Vote] argued PTV\u2019s petition language did not list everything in the constitution it would change or cancel \u2013 or in legal terms, \u2018alter and abrogate,&#8217;\u201d a local Michigan news outlet <a href=\"https:\/\/www.msn.com\/en-us\/news\/politics\/voting-rights-amendment-will-be-on-ballot-michigan-supreme-court-rules\/ar-AA11Cgsg\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a>. <\/p>\n<p>If Michigan voters pass the initiative this fall, the <a href=\"https:\/\/www.michigan.gov\/sos\/-\/media\/Project\/Websites\/sos\/24delrio\/Promote_the_Vote_MI_747933_7.pdf?rev=9ba411c28362403596ab25d86a13ec09&amp;hash=BD4E77884AE6A746E291C34D79304CC5\" target=\"_blank\" rel=\"noreferrer noopener\">proposed constitutional amendment<\/a> would completely overhaul the state\u2019s election laws. Among the changes are requiring state-funded \u201cabsentee ballot drop boxes\u201d and \u201cpostage for applications and ballots,\u201d allowing for private \u201cdonations to fund elections,\u201d and providing voters with a \u201cright\u201d to\u00a0fill out a single absentee ballot application \u201cto vote absentee in all [future] elections.\u201d This would keep mass mail-in balloting, the least secure form of elections, in place after such measures caused a chaotic 2020 election.<\/p>\n<p>The proposed initiative also seeks to empower Michigan\u2019s secretary of state in auditing election results. If approved by voters come November, the provision would mandate that only the secretary of state \u201cshall conduct election audits,\u201d while simultaneously prohibiting any \u201cofficer or member of the governing body of a national, state, or local political party, and no political party precinct delegate, [from having] any role in the direction, supervision, or conduct of an election audit.\u201d<\/p>\n<p>Michigan\u2019s current secretary of state, Democrat Jocelyn Benson, has made headlines recently after a U.S. district court judge <a href=\"https:\/\/thefederalist.com\/2022\/08\/26\/judge-denies-michigan-secretary-of-states-motion-to-dismiss-lawsuit-removing-26000-dead-registrants-from-voter-rolls\/\" target=\"_blank\" rel=\"noreferrer noopener\">denied<\/a> her attempts to dismiss a lawsuit by the Public Interest Legal Foundation\u2019s (PILF) over Benson\u2019s \u201cfailure to remove dead registrants from the state\u2019s voter rolls.\u201d<\/p>\n<hr class=\"wp-block-separator\" \/>\n<p>\n  Shawn Fleetwood is a Staff Writer for The Federalist and a graduate of the University of Mary Washington.
