The four-person Michigan Board of State Canvassers, tasked with certifying election petitions, came to a split decision last week, meaning the proposed amendment was stopped in its tracks.<\/p>\n<p>\u201cYou would not sign a mortgage that had this kind of mistake in it. You would not turn in a term paper with this kind of mistake in it,\u201d <a href=\"https:\/\/www.wxyz.com\/news\/michigan-supreme-court-to-decide-whether-the-abortion-rights-ballot-proposal-makes-it-onto-the-november-ballot\" target=\"_blank\" rel=\"noopener\">said<\/a> Tony Daunt, one of the two Republicans on the board to vote against approving the ballot petition.<\/p>\n<p>Bridge Michigan reporter Jonathan Oosting shared side-by-side images of one portion of text after a revised edition of the amendment moved words closer together in some sections.<\/p>\n<p lang=\"en\" dir=\"ltr\">Image 1: Michigan abortion rights petition drive given *conditional* format approval by Board of State Canvassers in March<\/p>\n<p>Image 2: The revised and circulated version, which is now being challenged because of spacing issues that appeared to merge several words together. <a href=\"https:\/\/t.co\/fjsZsbNjOE\">pic.twitter.com\/fjsZsbNjOE<\/a><\/p>\n<p>\u2014 Jonathan Oosting (@jonathanoosting) <a href=\"https:\/\/twitter.com\/jonathanoosting\/status\/1560318452736446472?ref_src=twsrc%5Etfw\">August 18, 2022<\/a><\/p>\n<p>The state\u2019s majority-Republican Supreme Court voted 5-2 to put the pro-abortion amendment on the ballot, despite the challenges arguing that its spacing makes the text unreadable.<\/p>\n<p>\u201cIn this case, the meaning of the words has not changed by the alleged insufficient spacing between them,\u201d the court wrote, <a href=\"https:\/\/www.cnn.com\/2022\/09\/08\/politics\/michigan-supreme-court-abortion-ballot-initiative\/index.html\" target=\"_blank\" rel=\"noopener\">according<\/a> to CNN. \u201cAssuming that the challengers\u2019 objection to the spacing represents a challenge to the \u2018form\u2019 of the petition that the Board properly considered, the petition has fulfilled all statutory form requirements, and the Board thus has a clear legal duty to certify the petition.\u201d<\/p>\n<p>Justice David Viviano, one of the dissenting justices, wrote that the \u201cfailure to include spaces\u201d makes the amendment hard to read and comes up short of the \u201cfull text\u201d requirement in the Michigan constitution. \u201c[I]t may have the right words in the right order\u2014as the majority here suggests\u2014but the lack of critical word spaces renders the remaining text much more difficult to read and comprehend \u2026\u201d wrote Viviano.<\/p>\n<p>A Michigan abortion ban from 1931 was set to go into effect following the Supreme Court\u2019s <a href=\"https:\/\/www.dailywire.com\/news\/united-states-supreme-court-overturns-roe-v-wade-leaves-abortion-restrictions-to-states\" target=\"_blank\" rel=\"noopener\">overturning<\/a> of <em>Roe v. Wade<\/em>, but the enforcement of that ban has been <a href=\"https:\/\/www.detroitnews.com\/story\/news\/local\/michigan\/2022\/09\/07\/judge-issues-permanent-injunction-blocking-enforcement-michigans-abortion-ban\/8013273001\/\" target=\"_blank\" rel=\"noopener\">blocked<\/a> by a permanent injunction issued by a Michigan Court of Claims judge. Now, Michigan voters will make their voices heard on the issue at the ballot box in November.<\/p>\n<p>The state\u2019s Democratic Governor <a href=\"https:\/\/www.dailywire.com\/topic\/gretchen-whitmer\">Gretchen Whitmer<\/a> has made abortion rights a <a href=\"https:\/\/www.dailywire.com\/news\/gretchen-whitmer-promises-she-will-fight-to-keep-abortion-legal-for-your-kids\" target=\"_blank\" rel=\"noopener\">centerpiece<\/a> of her re-election campaign after the Supreme Court\u2019s <em>Dobbs v. Jackson Women\u2019s Health Organization<\/em> ruling.
