The bill overwhelmingly advanced out of the House Energy and Commerce Committee at the end of July.<\/p>\n<p>Although a bipartisan group of lawmakers claimed in a <a href=\"https:\/\/energycommerce.house.gov\/newsroom\/press-releases\/bipartisan-ec-leaders-hail-committee-passage-of-the-american-data-privacy\" target=\"_blank\" rel=\"noopener\">statement<\/a> that the bill \u201cputs people back in control of their online data,\u201d the current version exempts government agencies \u2014 as well as any \u201cperson\u201d or \u201centity\u201d involved with \u201ccollecting, processing, or transferring\u201d relevant data on behalf of a government agency \u2014 from its definition of a \u201ccovered entity.\u201d<\/p>\n<p>Indeed, progressive nonprofit Consumer Watchdog provided The Daily Wire with a letter sent to House Speaker Nancy Pelosi (D-CA) noting that the American Data Privacy and Protection Act is weaker than the California Consumer Privacy Act and could supersede the existing law.<\/p>\n<p>\u201cA major loophole in the ADPPA allows companies who contract with government entities for data collection to avoid its protections,\u201d the group\u2019s letter explained. \u201cIn contrast, under California law, companies that contract with the government are covered businesses that must comply with the law. Sensitive personal information residents choose to protect from companies and the government under the CCPA would be exposed under the ADPPA. That means unfettered access by governments to mass data collection by tech companies like Google.\u201d<\/p>\n<p>In one recent example, Amazon smart doorbell company Ring <a href=\"https:\/\/www.dailywire.com\/news\/amazon-handed-over-ring-doorbell-footage-to-authorities\" target=\"_blank\" rel=\"noopener\">said<\/a> in a letter to Sen. Ed Markey (D-MA) that the firm had provided law enforcement with videos from user devices in emergency situations nearly one dozen times since the beginning of 2022. Ring explained that it had made a \u201cgood-faith determination that there was an imminent danger of death or serious physical injury\u201d to parties needing information on short notice.<\/p>\n<p>\u201cOnce data gets into other hands, it goes everywhere and is hard to track,\u201d the letter from Consumer Watchdog added. \u201cPurchasing data is one way governments circumvent the constitutional protections that require them to seek judicial approval through warrants before they violate our Fourth Amendment rights against unreasonable searches. But, under California\u2019s law, any resident who exercised their opt-out choice is protected from a government\u2019s extra-judicial purchase of their private information. ADPPA would overturn that protection.\u201d<\/p>\n<p>According to a <a href=\"https:\/\/www.latimes.com\/politics\/story\/2022-09-06\/congress-mulls-data-privacy-bill-that-would-void-california-tougher-protections\" target=\"_blank\" rel=\"noopener\">report<\/a> from the Los Angeles Times, Pelosi has committed to ensuring that the Golden State \u201ccontinues offering and enforcing the nation\u2019s strongest privacy rights\u201d and will work with Rep. Frank Pallone (D-NJ), a sponsor of the legislation, to address concerns.<\/p>\n<p>While the American Data Privacy and Protection Act does not entirely ban online targeted advertising \u2014 which is often the impetus behind sites\u2019 collection of user data \u2014 it bans such advertising directed toward children or based upon \u201csensitive covered data,\u201d including health information and precise geolocation. President Joe Biden <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/speeches-remarks\/2022\/03\/01\/remarks-of-president-joe-biden-state-of-the-union-address-as-delivered\/\" target=\"_blank\" rel=\"noopener\">called for<\/a> a similar law in his most recent State of the Union address.<\/p>\n<p>\u201cIt\u2019s time to strengthen privacy protections, ban targeted advertising to children, demand tech companies stop collecting personal data on our children,\u201d he said.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The American Data Privacy and Protection Act, a key piece of federal online privacy legislation, appears to have a carveout for organizations gathering data for the government.
