said John Kirby, the National Security Council\u2019s coordinator for strategic communications. \u201cSuffice it to say, there&#8217;s still gaps, and we&#8217;re just not there yet \u2026 there&#8217;s still quite a bit of work for our diplomats to do.\u201d<\/p>\n<p>After Iran and EU negotiators agreed last month on what was supposed to be a \u201cfinal text,\u201d Iran requested new provisions to impose a \u201cheavy price\u201d if some future U.S. president exited the deal, as President Donald Trump did in 2018.<\/p>\n<p>And Tehran also wanted assurances that should the U.S. reimpose sanctions, other Western companies would still be permitted to do business with Iran.<\/p>\n<p>The eleventh-hour Iranian demands were described as \u201c<a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/policy\/defense-national-security\/biden-administration-iran-nuclear-backwards\">not constructive<\/a>\u201d by Vedant Patel, deputy spokesperson at the State Department.<\/p>\n<p>\u201cIt is unfortunate that Iran&#8217;s response was, to us, took us backward. And we, of course, are not going to conclude a deal that is not in the U.S. national security interest. But this is something that we&#8217;re continuing to pursue,\u201d he said at briefings. \u201cIran&#8217;s response did not put us in a position to close the deal.\u201d<\/p>\n<p>Many experts argue the time when it made any sense to return to the original agreement has long passed, especially since some of the key provisions, such as restrictions on advanced centrifuges, <a class=\"Link\" href=\"https:\/\/www.fdd.org\/wp-content\/uploads\/2021\/02\/fdd-visual-key-sunsets-under-the-jcpoa-and-unsc-resolution-2231-2-scaled.jpg\">are set to expire<\/a> or \u201csunset\u201d in the next year or two.<\/p>\n<p>\u201cIran\u2019s nuclear progress since 2015, and particularly since Biden\u2019s election, is beyond the point of containment,\u201d according to a <a class=\"Link\" href=\"https:\/\/www.fdd.org\/analysis\/2022\/08\/18\/another-iran-deal-looking-back-and-looking-ahead\/\">recent analysis<\/a> by the Foundation for the Defense of Democracies. \u201cThe regime\u2019s nuclear advances have rendered a return to the old agreement futile.\u201d<\/p>\n<p>In February, Sen. Bob Menendez (D-NJ), chairman of the Foreign Relations Committee, an opponent of the original deal, delivered a <a class=\"Link\" href=\"https:\/\/www.c-span.org\/video\/?517604-5\/senator-bob-menendez-irans-nuclear-program\">floor speech<\/a> pointing out that according to the IAEA, Iran is now enriching uranium beyond any civilian application, up to 60% purity, and is a short, technical step away from the 90% needed for a nuclear bomb.<\/p>\n<p>\u201cIn other words, Iran has already done most of the heavy lifting,\u201d Menendez said. \u201cIran\u2019s consistent obfuscation, continual stalling, and outlandish demands have left us flying blind.\u201d<\/p>\n<p>Iran\u2019s \u201cbreakout time\u201d \u2014 the time it would take for it to produce a nuclear bomb \u2014 has shrunk from an estimated four weeks earlier this year, practically to zero.<\/p>\n<p>Congressional opposition to a revived deal has been building, notably among Democrats as well as Republicans, as Iran has continued to attack U.S. interests in the region and more details of the potential deal leak out.<\/p>\n<p>According to an <a class=\"Link\" href=\"https:\/\/jinsa.org\/jinsa_report\/iranian-leaks-reveal-biden-admin-efforts-to-circumvent-congress-review\/\">analysis<\/a> by the Jewish Institute for National Security of America, Iran\u2019s chief negotiator, Ali Bagheri Kani, told the Iranian Parliament last month that U.S. sanctions relief is designed partially to circumvent congressional review under the 2015 <a class=\"Link\" href=\"https:\/\/www.foreign.senate.gov\/imo\/media\/doc\/ONE%20PAGER-Iran%20Nuclear%20Agreement%20Review%20Act%20of%202015.pdf\">Iran Nuclear Agreement Review Act<\/a>, which requires the president to submit to Congress any agreement and all related documents.<\/p>\n<p>\u201cThe Iranians disclosed that the first step of the deal before the State Department submits the text to Congress, would entail President Biden lifting sanctions under three executive orders,\u201d the JINSA analysis said, citing a leaked audio recording. \u201cIn total, over 170 individuals and entities could be removed from U.S. sanctions before congressional review.\u201d<\/p>\n<p>\u201cLet me make this clear. This deal with Iran will be dead on arrival in a Republican-controlled Congress, and Congress will strengthen sanctions against Iran,\u201d said Rep. Mike Rogers (R-AL), lead Republican on the House Armed Services Committee. \u201cAny assurances to the contrary that the Biden administration gives to Mullahs in Tehran is worth less than the paper it\u2019s written on.\u201d<\/p>\n<p>But blocking the deal may not hinge on Republicans controlling Congress.<\/p>\n<p>A growing number of Democrats are becoming uneasy over the outlines of a deal that seems to give away too much for too little.<\/p>\n<p>In a <a class=\"Link\" href=\"https:\/\/gottheimer.house.gov\/uploadedfiles\/letter_to_president_regarding_potential_return_to_jcpoa.pdf\">letter<\/a> this month, 50 members of Congress, 34 Democrats and 16 Republicans, wrote President Joe Biden saying they were \u201cdeeply concerned about multiple provisions that reportedly may be contained in the final language of any agreement\u201d and requesting the White House \u201cprovide Congress with the full text of any proposal to rejoin the Iran nuclear agreement \u2026 including any side agreements, and consult with Congress prior to reentering that agreement.\u201d<\/p>\n<p>Iranian intransigence has stalled the negotiations once again, with the best guess being that the soonest a deal could be struck is after the November midterm elections.<\/p>\n<p>Meanwhile, Iran continues what the U.S. calls its \u201cmalign activities,\u201d <a class=\"Link\" href=\"https:\/\/www.justice.gov\/opa\/pr\/member-irans-islamic-revolutionary-guard-corps-irgc-charged-plot-murder-former-national\">plotting to assassinate<\/a> former national security adviser John Bolton, <a class=\"Link\" href=\"https:\/\/www.centcom.mil\/MEDIA\/STATEMENTS\/Statements-View\/Article\/3137354\/statement-regarding-precision-strikes-in-syria\/\">targeting U.S. troops<\/a> in Syria, and <a class=\"Link\" href=\"https:\/\/www.centcom.mil\/MEDIA\/PRESS-RELEASES\/Press-Release-View\/Article\/3144141\/statement-from-the-centcom-commander-regarding-irgc-attempt-to-seize-us-unmanne\/\">seizing a U.S. drone ship<\/a> in the Arabian Gulf.<\/p>\n<p>The White House argued the events are not linked.<\/p>\n<p>\u201cThe JCPOA is to deal with the Iranian pursuit of a nuclear weapons capability and only that,\u201d said NSC spokesman Kirby. \u201cIt&#8217;s not meant to deal with other Iranian malign activities.\u201d<\/p>\n<p>But Republicans are vowing to do everything possible to kill the deal for good.<\/p>\n<p>\u201cIran\u2019s attempts to assassinate American officials and dissidents on American soil should immediately disqualify them from any sanctions relief from the United States,\u201d Rogers said.<\/p>\n<p>\u201cYet, the Biden administration is working overtime to broker a deal that will provide billions of dollars to the world\u2019s largest state sponsor of terrorism.
