Mayorkas. \u201cConsistent with America\u2019s bedrock values, we will not penalize individuals for choosing to access the health benefits and other supplemental government services available to them.\u201d<\/p>\n<p>The new rule is slated to go into effect on Dec. 23.<\/p>\n<p>\u201cPublic charge\u201d rules have been a concept in immigration law for decades, referring to someone who is considered likely to rely on welfare programs as a condition to deny someone permanent residency.<\/p>\n<p>Under the Biden administration\u2019s rule, green card applicants are only considered a public charge if \u201cthey are likely at any time to become primarily dependent on the government\u201d for assistance.
