Although frontman Kurt Cobain killed himself in 1994, Elden\u2019s latest suit named Nirvana members Dave Grohl and Krist Novoselic, Cobain\u2019s widow Courtney Love, and photographer Kirk Weddle as defendants<\/p>\n<p>\u201cPlaintiff fails to allege that he knew of a violation that occurred while he was a minor or an injury that forms the basis of the claim within 10 years of filing this action,\u201d Olguin wrote.<\/p>\n<p>The photo, which featured which depicted Elden swimming toward a dollar bill on a fish hook, was taken by Weddle in 1991 at the Pasadena Aquatic Center in California.<\/p>\n<p>Elden has lodged various versions of the same lawsuit only to have them <a href=\"https:\/\/www.dailywire.com\/news\/nirvana-wins-naked-baby-legal-battle-as-judge-dismisses-lawsuit\/\" target=\"_blank\" rel=\"noopener\">dismissed repeatedly<\/a>.<\/p>\n<p>In 2003, Elden, who was just 12 at the time, told Rolling Stone he was \u201cprobably gonna get some money from it.\u201d In 2016, he had the image tattooed on his chest.<\/p>\n<p>Elden\u2019s lawyer claimed in the suit filed last year that the statute of limitations should be extended because his injuries including emotional distress, lost earning capacity and \u201closs of enjoyment of life\u201d persisted into adulthood.<\/p>\n<p>Olguin said recognizing that argument would mean Elden could sue Nirvana anytime, for the rest of his life.<\/p>\n<p>The album, which features the songs \u201cSmells Like Teen Spirit\u201d and \u201cCome as You Are,\u201d sold more than 30 million copies and made Nirvana and Cobain, its singer and guitarist, superstars. But just three years later, Cobain killed himself with a shotgun blast to the head at age 27, according to police.<\/p>\n<p>He left a suicide note addressed to his imaginary friend\u00a0 Boddah that said he had not \u201cfelt the excitement of listening to as well as creating music \u2026 for many years.\u201d<\/p>\n<p>A toxicology report detected high levels of heroin in his body.<\/p>\n<p>Grohl, who was Nirvana\u2019s drummer, switched to guitar and went on to found rock giants the Foo Fighters.<\/p>\n<p><em>The National Suicide Prevention Lifeline is a free hotline for individuals in crisis or distress or for those looking to help someone else.
