Pennsylvania Democrats, led by Governor Tom Wolf, are unconstitutionally flouting the law by failing to adopt uniform rules for how elections in the Keystone State are run,\u201d said RNC Chairwoman Ronna McDaniel in a statement. \u201cThis lawsuit will ensure that Pennsylvania voters have confidence in their elections and underscores the Republican Party\u2019s commitment to making it easier to vote and harder to cheat in Pennsylvania and nationwide.\u201d<\/p>\n<p>According to the RNC press release, the lawsuit seeks to challenge \u201cthe illegal and unfair practice of some [Pennsylvania] counties allowing voters to \u2018cure\u2019 defective mail ballots while others do not.\u201d<\/p>\n<p>\u201cPennsylvania law does not permit counties to contact voters and allow them to cure their ballots,\u201d the document reads. \u201cMany counties in Pennsylvania follow the law and do not allow for curing;\u00a0however, others have implemented a curing process, largely in secrecy, that varies by county.\u201d<\/p>\n<p>Ballot curing is a process by which someone \u201cfixes\u201d an absentee ballot that has a noticeable defect, such as missing personal information.<\/p>\n<p>As noted in the <a href=\"https:\/\/prod-media-assets.protectthevote.com\/media\/document\/news\/Petition_for_Review_as_filed_with_the_Court_cljv6yt1.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">lawsuit<\/a>, \u201c[i]n 2020, the Pennsylvania Supreme Court unanimously held that \u2018the<br \/>Election Code provides procedures for casting and counting a vote by mail\u2019 but does not provide for a notice and opportunity to cure procedure for a voter who fails to comply with the requirements for voting by mail or absentee.\u201d<\/p>\n<p>\u201cThe [Pennsylvania] Supreme Court further stated that \u2018[t]o the extent that a voter is at risk of having his or her ballot rejected\u2019 due to failure to comply with the Election Code\u2019s signature and secrecy ballot requirements for mail-in and absentee ballots, \u2018the decision to provide a \u201cnotice and opportunity to cure\u201d procedure to alleviate that risk is one best suited for the Legislature,&#8217;\u201d the lawsuit reads.<\/p>\n<p>\u201cIt is the Pennsylvania legislature\u2019s responsibility to uniformly enact these procedures and for them to apply across the state. The U.S. Constitution is clear that state legislatures should set the rules for how elections are run,\u201d the RNC said. <\/p>\n<p>Pennsylvania Democratic Gov. Tom Wolf has regularly blocked efforts by the state\u2019s GOP-controlled legislature to bring transparency and security to state and local elections. Last year, Wolf <a href=\"https:\/\/www.nbcphiladelphia.com\/news\/politics\/tom-wolf-vetoes-republican-bill-voter-id-elections-changes\/2864487\/\" target=\"_blank\" rel=\"noreferrer noopener\">vetoed<\/a> legislation that would have \u201cmandated voter identification in all elections,\u201d among \u201ca host of other changes to election law.\u201d<\/p>\n<p>\u201cGovernor Tom Wolf has vetoed and opposed Pennsylvania Republican-led legislation to remedy [the issue of ballot curing],\u201d the RNC said in conclusion. \u201cNow, a coalition of Republican groups and concerned citizens are stepping in to protect and standardize Pennsylvania elections.\u201d<\/p>\n<hr class=\"wp-block-separator\" \/>\n<p>\n  Shawn Fleetwood is a Staff Writer for The Federalist and a graduate of the University of Mary Washington.
