Lindsey Graham (R-S.C.)\u00a0has lost his bid to\u00a0quash a subpoena for his testimony\u00a0before a special grand jury in <a href=\"https:\/\/www.theepochtimes.com\/t-georgia\">Georgia<\/a> that\u2019s probing possible unlawful interference\u00a0in the 2020\u00a0election.<\/p>\n<p>Federal judge Leigh Martin May denied Graham\u2019s motion on Thursday, stating that \u201cafter due consideration, the Court again declines to quash the subpoena in its entirety.\u201d<\/p>\n<p>The ruling came after lawyers for Graham last week <a href=\"https:\/\/www.washingtonexaminer.com\/policy\/courts\/graham-all-topic-off-limits-fulton-county\">asked the court<\/a> to ensure that all topics were off limits in the inquiry.<\/p>\n<p>However, the judge did grant Graham a partial victory by\u00a0limiting the scope of the subpoena; specifically stating that Graham may not be questioned over his \u201cinvestigatory fact-finding on telephone calls to Georgia election officials\u201d during his testimony.<\/p>\n<p>That was in reference to\u00a0phone calls Graham made to Georgia Secretary of State Brad Raffensperger and his staff in the weeks after the 2020 election between former President Donald Trump and President Joe Biden.<\/p>\n<p>Lawyers for Graham have contended that his phone calls to\u00a0Raffensperger were part of a\u00a0\u201clegislative fact-finding\u201d<\/p>\n<p>\u201cAs to the issue of partial quashal, the Court quashes the subpoena only as to questions about Senator Graham\u2019s investigatory fact-finding on the telephone calls to Georgia election officials, including how such information related to his decision to certify the results of the 2020 presidential election,\u201d Judge May\u00a0wrote\u00a0in a court order (<a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.gand.305825\/gov.uscourts.gand.305825.44.0.pdf\">pdf<\/a>).<\/p>\n<p>\u201cThe Court finds that this area of inquiry falls under the protection of the Speech or Debate Clause, which prohibits questions on legislative activity,\u201d Judge May wrote.<\/p>\n<p>However, the judge noted that when it comes to other categories of questioning, \u201cthe Court finds that they are not legislative, and the Speech or Debate Clause does not apply to them.\u201d<\/p>\n<p> \u2018Never Inserted Himself Into The Electoral Process\u2019 <\/p>\n<p>As such, Graham \u201cmay be questioned about any alleged efforts to encourage Secretary Raffensperger or others to throw out ballots or otherwise<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Sen.
