Kathy Hochul\u2019s administration and the\u00a0<a class=\"editor-rtfLink\" href=\"https:\/\/cannabis.ny.gov\/system\/files\/documents\/2022\/02\/cannabis-management-fact-sheet-social-equity_0_0.pdf\" target=\"_blank\" rel=\"noopener\">Office of Cannabis Management<\/a>\u00a0began accepting applications from \u201cjustice-involved\u201d individuals last week. Such applicants must show proof of profitable business experience for at least two years. The office said it would prioritize women, minorities, veterans, and distressed farmers previously charged with marijuana convictions before March 31, 2021. Relatives of convicted individuals, including parents, guardians, children, spouses, and dependents, are also eligible for priority.<\/p>\n<p>Non-profit organizations could also be eligible if they \u201cintentionally serve justice-involved individuals and communities with historically high rates of arrest, conviction, incarceration or other indicators of law enforcement activity for marijuana-related offenses.\u201d<\/p>\n<p>The move comes after New York lawmakers passed the <a href=\"https:\/\/cannabis.ny.gov\/marihuana-regulation-and-taxation-act-mrta\">Marijuana Regulation &#038; Taxation Act<\/a> last year, which created a new Office of Cannabis Management that emphasizes \u201csocial and economic equality\u201d for those disproportionately impacted by the war on drugs. The law would automatically expunge past marijuana convictions and invest 40% of the tax revenue into rebuilding such communities affected by individuals who were \u201charmed\u201d by the War on Drugs.<\/p>\n<p>\u201cWe think that leaning into folks who are not only justice-involved but have that business experience means that we\u2019re going to find a bunch of applicants who have gone through some significant challenges to still open and operate successful businesses,\u201d Office of Cannabis Management executive director Chris Alexander told\u00a0<a class=\"editor-rtfLink\" href=\"https:\/\/www.politico.com\/news\/2022\/08\/27\/new-york-cannabis-social-equity-00053549\" target=\"_blank\" rel=\"noopener\">Politico<\/a>. \u201cWe just took a different approach.\u201d<\/p>\n<p>Alexander said that the office had taken measures to remove barriers from the application process that would otherwise be \u201coverly burdensome\u201d or require hiring consultants or attorneys for completion. But applicants won\u2019t receive a refund of the $2,000 application and licensing fee.<\/p>\n<p>Those who pass through the application process would be entitled to receive aid from a $200 million Social Equity Cannabis Investment Fund, which would set up nearly 150 applicants with a retail location and financing.<\/p>\n<p>Fox Business\u00a0<a class=\"editor-rtfLink\" href=\"https:\/\/www.foxbusiness.com\/lifestyle\/retail-cannabis-licenses-ny-prior-marijuana-convictions\" target=\"_blank\" rel=\"noopener\">reported<\/a>\u00a0that when New York lawmakers signed the 2021 marijuana bill, the governor\u2019s office estimated it would create approximately 60,000 jobs and generate up to $350 million in annual tax revenue.<\/p>\n<p>New York Governor candidate Lee Zeldin denounced Hochul\u2019s legislation saying it would only fuel a coalition of criminals.<\/p>\n<p>\u201cThe Criminals for Kathy coalition is growing,\u201d Zeldin said in a March 11\u00a0<a class=\"editor-rtfLink\" href=\"https:\/\/twitter.com\/leezeldin\/status\/1502324521981861889?ref_src=twsrc%5Etfw%7Ctwcamp%5Etweetembed%7Ctwterm%5E1502324521981861889%7Ctwgr%5Ef87333ea370a5706be829267808f63fd94587cb0%7Ctwcon%5Es1_&amp;ref_url=https%3A%2F%2Fwww.marijuanamoment.net%2Fmost-new-york-voters-oppose-prioritizing-marijuana-licenses-for-people-with-previous-convictions-poll-finds%2F\" target=\"_blank\" rel=\"noopener\">tweet<\/a>.\u201d Cannabis dispensary licenses are going to start getting distributed in NY, &#038; the Hochul admin will be giving FIRST PRIORITY to people previously convicted for marijuana offenses. Hochul\u2019s criminal first agenda is so wrong for NY.\u201d<\/p>\n<p>A Siena College Research Institute\u00a0<a class=\"editor-rtfLink\" href=\"https:\/\/scri.siena.edu\/2022\/03\/28\/hochul-has-commanding-lead-over-williams-with-cuomo-in-race-hochul-leads-38-30-other-two-way-behind\/\" target=\"_blank\" rel=\"noopener\">survey<\/a>\u00a0that polled 804 registered New Yorkers revealed that only 33% are in favor of prioritizing giving previously convicted marijuana-related offenders a head start on obtaining dispensary licenses. While 54% opposed and 13% said they were unsure.<\/p>\n<p>\u201cGiving first dibs on marijuana licenses to those previously convicted divides Democrats and New York City voters.
