{"id":1628549,"date":"2022-08-31T16:18:48","date_gmt":"2022-08-31T20:18:48","guid":{"rendered":"https:\/\/www.conservativenewsdaily.net\/breaking-news\/?p=1628549"},"modified":"2022-08-31T16:19:15","modified_gmt":"2022-08-31T20:19:15","slug":"california-bill-would-put-new-rules-on-using-artistic-expressions-in-court","status":"publish","type":"post","link":"https:\/\/www.conservativenewsdaily.net\/breaking-news\/california-bill-would-put-new-rules-on-using-artistic-expressions-in-court\/","title":{"rendered":"California Bill Would Put New Rules On Using Artistic Expressions In Court"},"content":{"rendered":"<aside class=\"mashsb-container mashsb-main mashsb-stretched\"><div class=\"mashsb-box\"><div class=\"mashsb-count mash-medium\" style=\"float:left\"><div class=\"counts mashsbcount\">24<\/div><span class=\"mashsb-sharetext\">SHARES<\/span><\/div><div class=\"mashsb-buttons\"><a class=\"mashicon-facebook mash-medium mash-nomargin mashsb-noshadow\" href=\"https:\/\/www.facebook.com\/sharer.php?u=https%3A%2F%2Fwww.conservativenewsdaily.net%2Fbreaking-news%2Fcalifornia-bill-would-put-new-rules-on-using-artistic-expressions-in-court%2F\" target=\"_top\" rel=\"nofollow\"><span class=\"icon\"><\/span><span class=\"text\">Facebook<\/span><\/a><a class=\"mashicon-twitter mash-medium mash-nomargin mashsb-noshadow\" href=\"https:\/\/twitter.com\/intent\/tweet?text=&amp;url=https:\/\/www.conservativenewsdaily.net\/breaking-news\/?p=1628549&amp;via=ConservNewsDly\" target=\"_top\" rel=\"nofollow\"><span class=\"icon\"><\/span><span class=\"text\">Twitter<\/span><\/a><a class=\"mashicon-subscribe mash-medium mash-nomargin mashsb-noshadow\" href=\"#\" target=\"_top\" rel=\"nofollow\"><span class=\"icon\"><\/span><span class=\"text\">Subscribe<\/span><\/a><div class=\"onoffswitch2 mash-medium mashsb-noshadow\" style=\"display:none\"><\/div><\/div>\n            <\/div>\n                <div style=\"clear:both\"><\/div><\/aside>\n            <!-- Share buttons by mashshare.net - Version: 4.0.47--><p class=\"p2\">The <a href=\"https:\/\/www.dailywire.com\/topic\/california\" target=\"_blank\" rel=\"noopener\">California<\/a> legislature recently unanimously passed a measure that would put new regulations on how creative expression can be used in court.<\/p>\n<p class=\"p2\">The bill, <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billNavClient.xhtml?bill_id=202120220AB2799\" target=\"_blank\" rel=\"noopener\">AB 2799<\/a>, would put new rules on using rap lyrics, as well as many other forms of creativity, as evidence in court.<\/p>\n<p class=\"p2\">If a party wishes to use \u201ca form of creative expression\u201d as evidence, the bill would require the court, \u201cwhile balancing the probative value of that evidence against the substantial danger of undue prejudice,\u201d to consider that the ability of such evidence to prove a point is \u201cminimal\u201d unless other details are met about the creative work.<\/p>\n<p class=\"p2\">The court must also consider that the judge or jury might \u201ctreat the expression as evidence of the defendant\u2019s propensity for violence or general criminal disposition,\u201d and the evidence might introduce \u201cracial bias into the proceedings.\u201d<\/p>\n<p class=\"p2\">The bill also defines \u201ccreative expression\u201d in broad terms and would apply to various forms of art, stating that it is \u201cthe expression or application of creativity or imagination in the production or arrangement of forms, sounds, words, movements, or symbols, including, but not limited to, music, dance, performance art, visual art, poetry, literature, film, and other such objects or media.\u201d<\/p>\n<p class=\"p2\">Under the new legislation, determinations concerning such evidence must be made away from the jury as well.<\/p>\n<p class=\"p2\">Democratic Assemblyman Reginald Jones-Sawyer introduced the bill in February. \u201cWhat you write could ultimately be used against you, and that could inhibit creative expression,\u201d Jones-Sawyer <a href=\"https:\/\/www.nytimes.com\/2022\/08\/26\/arts\/music\/california-rap-lyrics-bill-young-thug.html\" target=\"_blank\" rel=\"noopener\">told<\/a> The New York Times, stating that the legislation came down to a consideration of First Amendment rights.<\/p>\n<p class=\"p2\">\u201cThis is America,\u201d he said. \u201cYou should be able to have that creativity.\u201d<\/p>\n<p class=\"p2\">\u201cPeople were going to jail merely because of their appearance,\u201d Jones-Sawyer noted. \u201cWe weren\u2019t trying to get people off the hook. We\u2019re just making sure that biases, especially racial biases toward African Americans, weren\u2019t used against them in a court of law.\u201d<\/p>\n<p class=\"p2\">The bill now heads to the desk of <a href=\"https:\/\/www.dailywire.com\/topic\/gavin-newsom\" target=\"_blank\" rel=\"noopener\">Governor Gavin Newsom<\/a> (D) for signature or veto. He could also decide not to take either action on the legislation by September 30, which would mean it would automatically turn into law.<\/p>\n<p class=\"p2\">Newsom\u2019s office would not discuss pending measures, telling the Times, \u201c[a]s will [sic] all measures that reach the governor\u2019s desk, it will be evaluated on its merits.\u201d<\/p>\n<p class=\"p2\">The bill is especially <a href=\"https:\/\/www.nytimes.com\/2022\/05\/09\/us\/young-thug-arrested-gang.html\" target=\"_blank\" rel=\"noopener\">timely<\/a> as Fani Willis, a Georgia district attorney, <a href=\"https:\/\/www.newsweek.com\/rap-lyrics-cant-used-against-artists-california-lawmakers-decide-1738119\" target=\"_blank\" rel=\"noopener\">used<\/a> music videos and lyrics as evidence in cases for rappers Young Thug and Gunna.<\/p>\n<p class=\"p2\">\u201cI have some legal advice,\u201d she <a href=\"https:\/\/www.instagram.com\/p\/Ch3GCTLPBQJ\/?utm_source=ig_embed&amp;utm_campaign=embed_video_watch_again\" target=\"_blank\" rel=\"noopener\">told<\/a> the press this week, \u201cdon\u2019t confess to crimes on rap lyrics if you do not want them used, or at least get out of my county.\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The California legislature recently unanimously passed a measure that would put new regulations on how creative expression can be used in court.
