In a <a href=\"https:\/\/corporate.mcdonalds.com\/corpmcd\/en-us\/our-stories\/article\/ourstories.leaders-california.html\" target=\"_blank\" rel=\"noopener\">letter<\/a> denouncing the legislation, McDonald\u2019s USA President Joe Erlinger noted that the provisions impose \u201chigher costs on one type of restaurant, while sparing another.\u201d<\/p>\n<p>\u201cIf you are a small business owner running two restaurants that are part of a national chain, like McDonald\u2019s, you can be targeted by the bill,\u201d Erlinger explained. \u201cBut if you own 20 restaurants that are not part of a large chain, the bill does not apply to you.\u201d<\/p>\n<p>Erlinger postulated that \u201cbackroom politicking\u201d could explain the carveout for restaurants with a bakery. \u201cThis is a clear example of picking \u2018winners\u2019 and \u2018losers,\u2019 which is not the appropriate role of government,\u201d he commented.<\/p>\n<p>An <a href=\"https:\/\/esd.dof.ca.gov\/LegAnalysis\/getPdf\/066D8BA5-C012-ED11-913B-00505685B5D1\" target=\"_blank\" rel=\"noopener\">analysis<\/a> from the California Department of Finance said that the legislation introduces a \u201cfragmented regulatory and legal environment for employers\u201d that could \u201craise long-term costs across industries.\u201d There are more than 40,000 McDonald\u2019s restaurants as of 2021, according to the company\u2019s most recent federal <a href=\"https:\/\/sec.report\/Document\/0000063908-22-000011\/#i763292934bfc4351a657f87d3d00c5f6_16\" target=\"_blank\" rel=\"noopener\">filings<\/a>, with 93% of locations constituting franchises.<\/p>\n<p>\u201cThis should raise alarm bells across the country,\u201d Erlinger said of the legislation. \u201cBut this isn\u2019t just a cautionary tale for California\u2019s customers, workers, and business owners. Proponents of this bill have made it clear they want to see it expand across the country, regardless of whether Governor Newsom signs the bill into law. That would be terrible.\u201d<\/p>\n<p>California has implemented multiple restrictive labor laws in recent years. In 2019, Newsom approved <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billTextClient.xhtml?bill_id=201920200AB5\" target=\"_blank\" rel=\"noopener\">AB 5<\/a> \u2014 a piece of legislation that claimed workers are \u201cexploited\u201d through their classification as independent contractors instead of employees. Although a California court granted Uber and Lyft an <a href=\"https:\/\/www.dailywire.com\/news\/uber-lyft-avoid-state-wide-shutdown-amidst-legal-battle-with-california\" target=\"_blank\" rel=\"noopener\">emergency stay<\/a> in 2020 over a lawsuit that would have pressed the companies to conform to the law, the Supreme Court recently declined to hear the case, leading to the end of the stay and provoking independently employed truckers to <a href=\"https:\/\/www.dailywire.com\/news\/california-tells-truckers-blockading-port-over-harsh-labor-law-to-comply-and-move-forward\" target=\"_blank\" rel=\"noopener\">shut down major ports<\/a> in protest.<\/p>\n<p>Newsom\u2019s office said in a statement that AB 5 was enacted with \u201csufficient time for affected parties to understand the requirements of the law\u201d and urged the trucking industry to \u201cmove forward\u201d in supporting the change.<\/p>\n<p>\u201cCalifornia is committed to supporting our truck drivers and ensuring our state\u2019s truck drivers receive the protections and compensation they are entitled to,\u201d the statement added. \u201cThis administration has employment tax incentives, small-business financing, and technical assistance resources to support this essential industry.\u201d<\/p>\n<p>The new minimum wage legislation also comes days after the California Air Resources Board <a href=\"https:\/\/www.dailywire.com\/news\/california-expected-to-ban-sale-of-new-gas-cars\" target=\"_blank\" rel=\"noopener\">issued new rules<\/a> requiring 35% of new vehicles to produce zero emissions by 2026 \u2014 a standard that will rise to a 68% benchmark by 2030 and a 100% level by 2035.
