Punishments could include suspending or revoking a doctor\u2019s license to practice medicine in the state.<\/p>\n<\/section>\n<section data-v-f313b7e6=\"\"><\/section>\n<section data-v-f313b7e6=\"\">\n<p>The legislation defines disinformation as falsehoods &#8220;deliberately disseminated with malicious intent or an intent to mislead,&#8221; and misinformation as spreading information &#8220;that is contradicted by contemporary scientific consensus contrary to the standard of care.&#8221;<\/p>\n<\/section>\n<section data-v-f313b7e6=\"\">\n<figure class=\"kg-card kg-embed-card\">\n<blockquote class=\"twitter-tweet\" data-width=\"550\">\n<p lang=\"en\" dir=\"ltr\">BREAKING: <a href=\"https:\/\/twitter.com\/hashtag\/AB2098?src=hash&amp;ref_src=twsrc%5Etfw\">#AB2098<\/a>, which would punish doctors for Covid misinformation, just passed the Senate without any discussion or debate. If enacted, the law will likely face a legal challenge over freedom of speech concerns<\/p>\n<\/section>\n<section data-v-f313b7e6=\"\">\n<p>Other states have sought to <a href=\"https:\/\/www.medpagetoday.com\/special-reports\/exclusives\/97237\">protect doctors<\/a> who have advocated for treatments involving hydroxychloroquine, ivermectin, and other medications from punishment by regulatory boards.<\/p>\n<\/section>\n<section data-v-f313b7e6=\"\">\n<figure class=\"kg-card kg-embed-card\">\n<blockquote class=\"twitter-tweet\" data-width=\"550\">\n<p lang=\"en\" dir=\"ltr\">We don\u2019t need <a href=\"https:\/\/twitter.com\/hashtag\/AB2098?src=hash&amp;ref_src=twsrc%5Etfw\">#AB2098<\/a> because there is no misinformation crisis. There\u2019s a crisis of institutional credibility. The public has lost faith in the medical establishment, and censorship will not rebuild that trust. This was similar to a warning from the American Medical Association that spreading disinformation violates the code of ethics that licensed doctors agree to follow.<\/p>\n<\/section>\n<section data-v-f313b7e6=\"\">\n<p>The Federation of State Medical Boards wrote in <a href=\"https:\/\/www.fsmb.org\/siteassets\/advocacy\/policies\/ethics-committee-report-misinformation-april-2022-final.pdf\">April<\/a>, &#8220;Inaccurate information spread by physicians can have pernicious influences on individuals with widespread negative impact, especially through the ubiquity of smartphones and other internet-connected devices on wrists, desktops, and laptops reaching across thousands of miles to other individuals in an instant. Physicians\u2019 status and titles lend credence to their claims.&#8221;<\/p>\n<\/section>\n<section data-v-f313b7e6=\"\">\n<p>According to the <em><a href=\"https:\/\/www.nytimes.com\/2022\/08\/29\/technology\/california-doctors-covid-misinformation.html\">New York Times<\/a>, <\/em>the legislation was originally part of <a href=\"https:\/\/www.nytimes.com\/2022\/08\/22\/us\/california-covid-legislation.html\">Covid-related bills<\/a> proposed by a legislative working group with many of the most contentious bills having stalled or died, including one that would have required all California schoolchildren to be vaccinated.<\/p>\n<\/section>\n<section data-v-f313b7e6=\"\">\n<p>State Senator Richard Pan, a Democrat from Sacramento and a co-author of the bill said, &#8220;In order for a patient to give informed consent, they have to be well informed,&#8221; and added that the law was intended to address &#8220;the most egregious cases&#8221; of deliberately misleading patients.<\/p>\n<\/section>\n<section data-v-f313b7e6=\"\">\n<p>A group called the Physicians for Informed Consent opposed the legislation, saying it would silence doctors, and filed <a href=\"https:\/\/physiciansforinformedconsent.org\/physicians-for-informed-consent-sues-medical-board-of-california-argues-board-is-violating-the-first-amendment-of-the-u-s-constitution\/\">a lawsuit<\/a> this month to seek an injunction preventing the Medical Board of California from disciplining doctors based on accusations of disinformation.
