Now that the worst modern legal precedent is gone,<\/em> <a href=\"https:\/\/www.theamericanconservative.com\/issue\/september-october-2022\/\"><em>we asked TAC contributors<\/em><\/a><em>: Which bad decision should the Supreme Court overturn next?<\/em><\/p>\n<p class=\"has-drop-cap\">The month before he was elected mayor of New York, Eric Adams\u00a0<a href=\"https:\/\/twitter.com\/ericadamsfornyc\/status\/1450967702093320203?s=20&amp;t=doAU5yeBeESsR-xSnDZuGA\">tweeted<\/a>\u00a0the Big Apple would \u201cremain a sanctuary city\u201d under his administration. He had\u00a0<a href=\"https:\/\/www.scribd.com\/document\/510477583\/WeRISE\">previously promised<\/a>\u00a0to \u201cseverely restrict cooperation\u201d between the New York Police Department and Immigration and Customs Enforcement (ICE)\u2014including ensuring that ICE is removed from all city buildings and facilities\u2014and\u00a0<a href=\"https:\/\/www.facebook.com\/NYCMayor\/posts\/10156944689551166\">voiced support<\/a>\u00a0for giving driver\u2019s licenses to illegal aliens. As mayor, he allowed a bill to pass providing more than\u00a0<a href=\"https:\/\/www.nbcnews.com\/politics\/politics-news\/new-york-city-mayor-eric-adams-allows-noncitizen-voting-bill-n1287225\">800,000 noncitizens<\/a>\u00a0access to the ballot box for municipal elections shortly after taking office.<\/p>\n<div class=\"o-ad o-ad--center  js-ad\">\n<div class=\"o-ad__border\">\n        <span class=\"o-ad__border-label\">Advertisement<\/span><\/p><\/div>\n<\/p><\/div>\n<p>But Adams sang a different tune about immigration this summer. During a press conference in July, he bemoaned the influx of illegal aliens that had proven a \u201c<a href=\"https:\/\/nypost.com\/2022\/07\/19\/adams-calls-on-biden-as-nyc-shelters-overrun-with-migrants\/\">real burden<\/a>\u201d on the city\u2019s safety net and public services after nearly 3,000 asylum-seeking migrants had arrived in just a few weeks. An\u00a0<a href=\"https:\/\/www.theepochtimes.com\/exclusive-nyc-agency-struggles-to-cope-with-drastic-influx-of-asylum-seekers-urges-staff-to-work-overtime-leaked-email-shows_4638651.html?welcomeuser=1\">email obtained<\/a>\u00a0by\u00a0<em>The Epoch Times<\/em>\u00a0sent by New York City\u2019s Human Resources Administration urged all able staff to work overtime to deal with a \u201cdrastic influx of asylum seekers\u201d in Manhattan and the outer boroughs, indicating the crisis was even worse than Adams had admitted.<\/p>\n<p>The cause of Adams\u2019s woes is simple. These people are going to New York City specifically and the United States in general because they know they\u2019ll get access to public services and benefits typically reserved for citizens. In other words, the incumbent order incentivizes mass lawbreaking. One source of those incentives is a little-known Supreme Court case,\u00a0<em>Plyler v. Doe.<\/em><\/p>\n<p>In 1982, the Court struck down a Texas statute that denied access to taxpayer-funded K-12 education to children brought into the country illegally. It also struck down the Tyler Independent School District\u2019s policy of charging an annual $1,000 tuition fee for each student not \u201clegally admitted\u201d into the U.S. to compensate for lost state funding.\u00a0<\/p>\n<p>The Court argued that illegal aliens are people \u201cin any ordinary sense of the term\u201d and, as such, afforded Fourteenth Amendment protections. In the <a href=\"https:\/\/caselaw.findlaw.com\/us-supreme-court\/457\/202.html\">majority opinion<\/a>, Justice William J. Brennan Jr. wrote that such policies would likely lead to \u201cthe creation and perpetuation of a subclass of illiterates within our boundaries, surely adding to the problems and costs of unemployment, welfare, and crime.\u201d\u00a0<\/p>\n<p>The decision in\u00a0<em>Plyler<\/em>\u00a0effectively abstracted the Constitution so as to cover every sentient biped with a prefrontal cortex, exploding the preambular statement that restricted it \u201cto ourselves and our posterity\u201d\u2014to America and Americans. It also meant similar laws anywhere in the U.S would be struck down.\u00a0<\/p>\n<section class=\"c-subscribe-email\">\n<div class=\"l-container\">\n<div class=\"c-subscribe-email__wrap\">\n<h4 class=\"c-subscribe-email__heading\">Subscribe Today<\/h4>\n<h5 class=\"c-subscribe-email__subheading\">Get weekly emails in your inbox<\/h5>\n<\/p><\/div>\n<\/p><\/div>\n<\/section>\n<p>Proposition 187, for example, was California\u2019s attempt in the 1990s to eliminate the incentives that cause illegal immigration. Indeed, Eric Adams today sounds a lot like Gov. Pete Wilson then, who also railed against the burden of mass immigration on public services such as schools. After the proposition passed with 59 percent of the vote and propelled Wilson to reelection, U.S. District Court Judge Mariana R. Pfaelzer declared the law unconstitutional. She\u00a0<a href=\"https:\/\/www.edweek.org\/education\/judge-rejects-prop-187-bans-on-calif-services\/1995\/11\">cited<em>\u00a0Plyler<\/em><\/a>\u00a0to make her case.<\/p>\n<p>The policies implemented by Texas and Proposition 187 in California were\u00a0<em>reactions<\/em>\u00a0to the federal government\u2019s failures to curb illegal immigration amid surges. And while <em>Plyler<\/em>\u00a0tied states\u2019 hands in restricting immigration, the precedent it set was\u00a0extended\u00a0beyond K-12 to allow illegal aliens to\u00a0<a href=\"https:\/\/www.fairus.org\/issue\/societal-impact\/in-state-tuition-illegal-aliens\">pay in-state tuition<\/a>\u00a0rates for college, with at least 18 states passing such laws.\u00a0<\/p>\n<p>Ironically, Brennan\u2019s feared \u201csubclass\u201d has materialized anyway. Latinos, who were at the center of these debates, lag across the country in math and English proficiency. A culture of academic affirmative action has arisen to accommodate lowered expectations. In Oregon, <a href=\"https:\/\/www.dailymail.co.uk\/news\/article-9879959\/Oregon-scraps-requirement-high-school-students-prove-proficiency-math-reading-writing.html\">for example<\/a>, as part of the state\u2019s efforts to bolster graduation rates among \u201cstudents of color,\u201d it is no longer required to demonstrate proficiency in math, reading, and writing to receive a high school diploma. Why bother? After all, math is now <a href=\"https:\/\/www.washingtonexaminer.com\/restoring-america\/equality-not-elitism\/woke-math-how-critical-race-theory-found-its-way-into-math-curriculum\">considered racist<\/a> in schools, and universities like Rutgers have changed their <a href=\"https:\/\/freebeacon.com\/campus\/rutgers-declares-grammar-racist\/\">English grammar rules<\/a> for the same reason.<em>Plyler<\/em>, of course, doesn\u2019t bear the blame for all of this\u2014but it has created incentives that, as Adams admitted, burden the system and necessarily lead to lower standards for everyone. It also raises the question of whether nations are homes that owe something to their people or merely boarding houses and bordellos for a never-ending flow of strangers. Overturning <em>Plyler<\/em> wouldn\u2019t fix everything overnight, but it would be a big step in the right direction after so many wrong turns.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Overturning Roe seemed like a pipe dream until it finally happened.
