Brian Kemp\u2019s motion to quash a subpoena for him to testify before the special purpose grand jury in the probe of the 2020 election.<\/p>\n<p>Robert McBurney, a Superior Court of <a href=\"https:\/\/www.theepochtimes.com\/t-fulton-county\">Fulton County<\/a> judge, denied Kemp\u2019s motion, which invoked sovereign immunity and claimed that the Superior Court of Fulton County did not have jurisdiction to issue or enforce the subpoena.<\/p>\n<p>\u201cThe Court finds that it does enjoy jurisdiction and that the subpoena should not be quashed,\u201d the judge wrote in the ruling.<\/p>\n<p>However, McBurney delayed the governor\u2019s appearance before the grand jury to a date \u201csoon after the 8 November 2022 general election,\u201d in which Kemp will face Democrat Stacey Abrams.<\/p>\n<p>He postponed the date because Kemp is in the midst of a campaign for reelection and to avoid the case being used to influence the election results, the judge wrote.<\/p>\n<p>McBurney also declined to quash a subpoena for lawyer Kenneth Chesebro, who represented the Trump campaign.
