Becerra<\/em><\/a> that \u201ca Catholic healthcare network and a group of nearly 19,000 healthcare professionals cannot be required to carry out these procedures in violation of their deeply held beliefs and professional medical judgment,\u201d <a href=\"https:\/\/www.becketlaw.org\/media\/federal-court-strikes-down-transgender-mandate\/\">according to the Becket Fund for Religious Liberty<\/a>, a nonprofit law firm that <a href=\"https:\/\/www.becketlaw.org\/about-us\/mission\/\" target=\"_blank\" rel=\"noreferrer noopener\">seeks<\/a> to protect religious freedom.<\/p>\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\">\n<div class=\"wp-block-embed__wrapper\">\n<span class=\"VNUt4SKT6ZmM3sXLGB0gPA8wpIWhfDaHvkzcqJbEi7x2url9QFe51\"><\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\"><a href=\"https:\/\/twitter.com\/hashtag\/BREAKING?src=hash&amp;ref_src=twsrc%5Etfw\">#BREAKING<\/a>: A federal appeals court just blocked the Biden Admin\u2019s controversial plan to force doctors to perform gender-transitions against their conscience and medical judgment. <\/p>\n<p>This is a HUGE win for doctors, patients, &#038; <a href=\"https:\/\/twitter.com\/hashtag\/ReligiousFreedom?src=hash&amp;ref_src=twsrc%5Etfw\">#ReligiousFreedom<\/a> \ud83e\uddf5<a href=\"https:\/\/t.co\/A2fL48ZV25\">https:\/\/t.co\/A2fL48ZV25<\/a><\/p>\n<p>\u2014 Luke Goodrich (@LukeWGoodrich) <a href=\"https:\/\/twitter.com\/LukeWGoodrich\/status\/1563296010763325441?ref_src=twsrc%5Etfw\">August 26, 2022<\/a><\/p><\/blockquote>\n<p><\/span>\n<\/div>\n<\/figure>\n<p>HHS originally mandated that physicians perform wrongly named \u201csex-reassignment\u201d surgeries as part of Obamacare in May 2016. \u201cThe requirement would have forced doctors to perform these procedures on any patient, including on children, even if the procedures went against their conscience and professional medical judgment,\u201d <a href=\"https:\/\/www.becketlaw.org\/media\/federal-court-strikes-down-transgender-mandate\/\">Becket<\/a> said following Friday\u2019s ruling. <\/p>\n<p>An association that included thousands of health care professionals, two hospitals, and eight states <a href=\"https:\/\/www.becketlaw.org\/case\/franciscanalliance\/#:~:text=Status,conscience%20and%20experienced%20professional%20judgment.\">challenged<\/a> the original Obamacare mandate in August 2016 in a Texas district court. A <a href=\"https:\/\/becketpdf.s3.amazonaws.com\/62-Order-Granting-Injunction.pdf\">preliminary ruling<\/a> was issued in December 2016 maintaining that this was \u201cunlawful overreach by a\u00a0federal agency,\u201d which the court confirmed in 2019. But because the court did not \u201cissue an order permanently stopping the government from imposing this unlawful mandate on religious hospitals and doctors,\u201d Becket \u201cappealed on behalf of the challengers.\u201d <\/p>\n<p>Since the 2016 Obamacare mandate and subsequent Supreme Court decision in <em>Bostock v. Clayton County<\/em>, President Joe Biden\u2019s HHS has continued to shoehorn so-called \u201cgender identity\u201d into the definition of sex discrimination in health care. In March, HHS issued a notice saying  that \u201c[a]ttempts to restrict\u201d transgender surgeries are \u201cdangerous,\u201d and earlier this month, the department filed a \u201cNotice of Proposed Rulemaking,\u201d which, if enacted, would require hospitals to perform both mutilative transgender surgeries and abortions.<\/p>\n<p>Friday\u2019s \u201cruling is a major victory for conscience rights and compassionate medical care in America,\u201d said Becket counsel Joseph Davis in a <a href=\"https:\/\/www.becketlaw.org\/media\/federal-court-strikes-down-transgender-mandate\/\">press release<\/a>. \u201cDoctors cannot do their jobs and comply with the Hippocratic Oath if the government requires them to perform harmful, irreversible procedures against their conscience and medical expertise.\u201d<\/p>\n<p>Davis added that this legal victory \u201censures that these doctors and hospitals may continue to do this critical work in accordance with their conscience and professional medical judgment.\u201d<\/p>\n<p>This isn\u2019t the first time Becket has battled with the Department of Health and Human Services over religious liberty. In 2013, the firm filed a <a href=\"https:\/\/www.becketlaw.org\/case\/littlesisters\/\">lawsuit<\/a> on behalf of the Catholic organization <a href=\"https:\/\/littlesistersofthepoor.org\/\">Little Sisters of the Poor<\/a> to challenge an HHS mandate that said employers must provide contraceptives in their health insurance plans. After lengthy court battles that included even the Supreme Court, the Catholic organization prevailed.<\/p>\n<hr class=\"wp-block-separator\" \/>\n<p>\n  Sophia is an intern at The Federalist and a student at Le Moyne College.
