Kincaid case, which became the first federal appellate court in the nation to find that the 1990 landmark federal law should include peopel who experience \u201cdiscomfort or distress that is caused by a discrepancy between a person\u2019s gender identity and that person\u2019s sex assigned at birth,\u201d according to the\u00a0<a class=\"editor-rtfLink\" href=\"https:\/\/www.glad.org\/wp-content\/uploads\/2021\/12\/Williams-v.-Kincaid-decision.pdf\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">filings<\/a><span data-preserver-spaces=\"true\">.<\/p>\n<p><span data-preserver-spaces=\"true\">Judge Diana Gribbon Motz wrote in the majority opinion that a gender dysphoria diagnosis \u201caffirms that a transgender person\u2019s medical needs are just as deserving of treatment and protection as anyone else\u2019s.\u201d<\/p>\n<p><span data-preserver-spaces=\"true\">Kesha Williams, the plaintiff, sued the Fairfax County sheriff, a prison deputy, and a prison nurse in Virginia, alleging violations against the ADA and Rehabilitation Act after authorities released Williams from a men\u2019s correctional facility. Williams, born as a biological male, began receiving medical treatment for gender dysphoria 15 years before his incarceration.<\/p>\n<p><span data-preserver-spaces=\"true\">Williams was initially assigned to the women\u2019s side of the Fairfax County jail when he arrived in 2018. Still, authorities moved Williams to the men\u2019s section after explaining to the nurse that Williams identified as transgender, but had not undergone genital surgery.<\/p>\n<p><span data-preserver-spaces=\"true\">The plaintiff sued the county jail based on \u201cexperienced delays in medical treatment for her gender dysphoria, harassment by other inmates, and persistent and intentional misgendering and harassment by prison deputies\u201d while spending six months in the detention center.<\/p>\n<p><span data-preserver-spaces=\"true\">Defendants in the case appealed that the ADA afforded Williams no basis for relief because \u201cgender dysphoria is not a \u2018disability\u2019 under the ADA\u201d and \u201cit is an identity disorder not resulting from physical impairments.\u201d\u00a0<\/p>\n<p><span data-preserver-spaces=\"true\">When Congress enacted ADA in 1990, it defined the term \u201cdisability\u201d as \u201ca physical or mental impairment that substantially limits one or more major life activities of such individual.\u201d However, the law excluded defining \u201cgender identity disorders.\u201d The appeals court held that the term should be understood as \u201cat the time of its enactment.\u201d<\/p>\n<p>However, the definition changed in 2013 when the Fourth Circuit noted that \u201cgender identity disorder\u201d had been removed from the Diagnostic and Statistical Manual of Mental Disorders (DSM) and added gender dysphoria, which means that someone with an \u201cincongruence between their assigned gender identity and assigned sex\u201d may experience \u201cclinically significant distress.\u201d<\/p>\n<p>Williams argued that gender dysphoria was not a gender identity disorder and, even if it were, that \u201cit results from a physical basis that places it outside the scope of the exclusion and ADA protection.\u201d<\/p>\n<p><span data-preserver-spaces=\"true\">Littler, a law firm focused on labor and employment laws, said that the Fourth Circuit\u2019s decision could have broad implications for employers in Maryland, North Carolina, South Carolina, Virginia, and West Virginia.<\/p>\n<p><span data-preserver-spaces=\"true\">\u201cUnder this decision, employees experiencing gender dysphoria are entitled to the protections of the ADA, including reasonable accommodation,\u201d the firm\u00a0<a class=\"editor-rtfLink\" href=\"https:\/\/www.littler.com\/publication-press\/publication\/fourth-circuit-first-rule-ada-protects-gender-dysphoria#:~:text=The%20Fourth%20Circuit%20is%20First%20to%20Rule%20that%20ADA%20Protects%20Gender%20Dysphoria,-By%20Yvette%20V&amp;text=On%20August%2016%2C%202022%2C%20the,protect%20individuals%20with%20gender%20dysphoria.\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">reports<\/a><span data-preserver-spaces=\"true\">.<\/p>\n<p><span data-preserver-spaces=\"true\">Such accommodations would include a request for \u201cgender dysphoria could conceivably arise for restroom usage, employer-provided housing, task and shift assignments, and leaves of absence for medical treatment,\u201d adding employees would be protected from any discrimination, harassment, and retaliation based on gender dysphoria under the ADA.<\/p>\n<p><span data-preserver-spaces=\"true\">Judge A.
