{"id":1621171,"date":"2022-08-25T18:03:53","date_gmt":"2022-08-25T22:03:53","guid":{"rendered":"https:\/\/www.conservativenewsdaily.net\/breaking-news\/?p=1621171"},"modified":"2022-08-25T18:03:57","modified_gmt":"2022-08-25T22:03:57","slug":"kenosha-pledges-to-stop-using-ballot-drop-boxes-after-wisconsin-supreme-court-ruled-theyre-illegal","status":"publish","type":"post","link":"https:\/\/www.conservativenewsdaily.net\/breaking-news\/kenosha-pledges-to-stop-using-ballot-drop-boxes-after-wisconsin-supreme-court-ruled-theyre-illegal\/","title":{"rendered":"Kenosha Pledges To Stop Using Ballot Drop Boxes After Wisconsin Supreme Court Ruled They\u2019re Illegal"},"content":{"rendered":"<aside class=\"mashsb-container mashsb-main mashsb-stretched\"><div class=\"mashsb-box\"><div class=\"mashsb-count mash-medium\" style=\"&quot;\"><div class=\"counts mashsbcount\">30<\/div><span class=\"mashsb-sharetext\">SHARES<\/span><\/div><div class=\"mashsb-buttons\"><a class=\"mashicon-facebook mash-medium mash-nomargin mashsb-noshadow\" href=\"https:\/\/www.facebook.com\/sharer.php?u=https%3A%2F%2Fwww.conservativenewsdaily.net%2Fbreaking-news%2Fkenosha-pledges-to-stop-using-ballot-drop-boxes-after-wisconsin-supreme-court-ruled-theyre-illegal%2F\" target=\"_top\" rel=\"nofollow\"><span class=\"icon\"><\/span><span class=\"text\">Facebook<\/span><\/a><a class=\"mashicon-twitter mash-medium mash-nomargin mashsb-noshadow\" href=\"https:\/\/twitter.com\/intent\/tweet?text=&amp;url=https:\/\/www.conservativenewsdaily.net\/breaking-news\/?p=1621171&amp;via=ConservNewsDly\" target=\"_top\" rel=\"nofollow\"><span class=\"icon\"><\/span><span class=\"text\">Twitter<\/span><\/a><a class=\"mashicon-subscribe mash-medium mash-nomargin mashsb-noshadow\" href=\"#\" target=\"_top\" rel=\"nofollow\"><span class=\"icon\"><\/span><span class=\"text\">Subscribe<\/span><\/a><div class=\"onoffswitch2 mash-medium mashsb-noshadow\" style=\"display:none\"><\/div><\/div>\n            <\/div>\n                <div style=\"clear:both\"><\/div><\/aside>\n            <!-- Share buttons by mashshare.net - Version: 4.0.47--><p>Following a contentious legal battle with Wisconsin voters, the city of Kenosha has agreed to stop using unmanned ballot drop boxes in future elections, according to a <a href=\"https:\/\/thomasmoresociety.org\/voters-victory-as-city-of-kenosha-agrees-to-discontinue-use-of-illegal-ballot-drop-boxes\/\" target=\"_blank\" rel=\"noreferrer noopener\">press release<\/a> from the Thomas More Society.<\/p>\n<p>In a May lawsuit filed by the Thomas More Society on behalf of the Wisconsin Voter Alliance, the plaintiffs argued that Kenosha\u2019s policy \u201cconcerning the use of absentee ballot drop boxes violated state law.\u201d<\/p>\n<p>\u201cAttorneys representing Kenosha had filed a motion in June 2022 to dismiss the complaint, but the July 8, 2022, ruling by the Wisconsin Supreme Court banned the use of the drop boxes,\u201d the press release reads. \u201cAn August 23, 2022, hearing for the case began with Kenosha changing the argument to \u2018mootness\u2019 with nothing left to argue, thereby handing the victory to the voters.\u201d<\/p>\n<p>While Kenosha Assistant City Attorney Bryan Charbogian reportedly indicated that the city would stop its use of ballot drop boxes, Thomas More Society Special Counsel Erick Kaardal \u201crefuted the dismissal, pointing out that the city had not changed their 2020 policies concerning drop boxes\u201d and argued that the case \u201cshould not be dismissed for mootness until such time the Kenosha Common Council repeals the current drop box policy.\u201d<\/p>\n<p>In agreeing with Charbogian\u2019s motion to dismiss the case, a Kenosha County Circuit Court judge informed the city that it would have \u201cto comply with the Wisconsin Supreme Court\u2019s interpretation of the drop box laws,\u201d while also leaving the door open for Kaardal and Wisconsin voters to return with additional lawsuits should the city violate the high court\u2019s July ruling. <\/p>\n<p>Following statements by Kenosha\u2019s legal representation claiming the city would \u201cnever use absentee ballot drop boxes again,\u201d the case was dismissed without prejudice.<\/p>\n<p>\u201cThis was a big win for rule of law. The City of Kenosha, a serial violator of election law, promised to comply with election law,\u201d said Kaardal in a <a href=\"https:\/\/thomasmoresociety.org\/voters-victory-as-city-of-kenosha-agrees-to-discontinue-use-of-illegal-ballot-drop-boxes\/\" target=\"_blank\" rel=\"noreferrer noopener\">statement<\/a>. \u201cThat is winning.\u201d<\/p>\n<p>Back in July, the Wisconsin Supreme Court ruled that the state\u2019s previous use of unmanned ballot drop boxes violated state law, with the high court <a href=\"https:\/\/thefederalist.com\/2022\/07\/08\/wisconsin-supreme-court-drops-hammer-on-2020-election-shenanigans-ballot-drop-boxes-are-illegal-under-wisconsin-law\/\" target=\"_blank\" rel=\"noreferrer noopener\">saying<\/a> all absentee ballots \u201cmust be returned by mail or the voter must personally deliver it to the municipal clerk at the clerk\u2019s office or a designated alternate site.\u201d<\/p>\n<p>\u201cThe record evidence [the Wisconsin Elections Commission] cited does not support its argument that ballot drop boxes have been in common and longstanding use in this state,\u201d the court said.<\/p>\n<hr class=\"wp-block-separator\" \/>\n<p>\n  Shawn Fleetwood is a Staff Writer for The Federalist and a graduate of the University of Mary Washington.
