Judge Diana Gribbon Motz, a Clinton appointee, sided with Williams and rejected a lower court\u2019s dismissal of the initial lawsuit. <strong><a href=\"https:\/\/dailycaller.com\/2022\/06\/07\/transgender-crimes-murder-abuse-prison-gender\/\" target=\"_blank\" rel=\"noopener noreferrer\">(RELATED: Men Keep Committing Heinous Crimes, Then Identifying As Women After Being Arrested. The Media Is Playing Along)<\/a><\/strong><\/p>\n<p>Candice Jackson, attorney and former assistant U.S. secretary of education for civil rights, told the Daily Caller News Foundation it was unclear how this decision would play out in practice, explaining that the ADA requires reasonable accommodations for disabilities, but not necessarily the accommodations an individual wants.<\/p>\n<p>\u201cRecognition of gender dysphoria as a disability under the ADA is not inherently problematic; depending on the severity of distress and how it manifests, objectively GD can be easily seen as a disability on par with any number of other conditions,\u201d she told the DCNF.<\/p>\n<p>\u201cThe relevant question then becomes, \u2018Is access to opposite-sex spaces a reasonable accommodation for GD?\u2019 There are many reasons to argue against that, because usually an accommodation can\u2019t harm or violate the rights of others and still be considered reasonable,\u201d she said. \u201cThe more justifiable accommodation for GD would be private\/separate accommodation.\u201d<\/p>\n<p>The prison has a policy of housing inmates with male genitals in the men\u2019s section; Williams was initially placed in the women\u2019s section until a medical evaluation determined that the men\u2019s facility would be more appropriate, according to the lawsuit. Williams allegedly experienced harassment from men while in prison and didn\u2019t have consistent access to hormonal medications used in the sex-change process, which the lawsuit described as a treatment for gender dysphoria.<\/p>\n<p>Williams served six months at the Fairfax County Adult Detention Center after confessing to playing a role in a drug deal, <a href=\"https:\/\/www.washingtonpost.com\/dc-md-va\/2022\/08\/17\/trans-jail-fourth-circuit\/\" target=\"_blank\" rel=\"noopener noreferrer\">according<\/a> to The Washington Post.<\/p>\n<p>Gender dysphoria is the sense of discomfort with one\u2019s biological sex and body which leads some individuals to identify as transgender; not everyone with gender dysphoria goes on to identify as transgender, and not all transgender people pursue medical interventions to present as the opposite sex. Transgender activists argue that these drugs may help prevent suicide for people with gender dysphoria, although studies on \u201cgender-affirming\u201d drugs generally struggle with serious methodological issues such as lack of control groups and inability to determine causality, <a href=\"https:\/\/dailycaller.com\/2022\/08\/05\/lgbt-study-transgender-falls-apart-social-contagion-theory-scrutiny\/\" target=\"_blank\" rel=\"noopener noreferrer\">multiple<\/a> DCNF <a href=\"https:\/\/dailycaller.com\/2022\/03\/06\/transgender-activism-pharmaceutical-studies-children\/\" target=\"_blank\" rel=\"noopener noreferrer\">investigations<\/a> have found.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">Proud to work with <a href=\"https:\/\/twitter.com\/NCLRights?ref_src=twsrc%5Etfw\">@NCLRights<\/a> to co-author our brief in support of transgender protections under the ADA! <a href=\"https:\/\/t.co\/GEvwOC7r2G\">https:\/\/t.co\/GEvwOC7r2G<\/a><\/p>\n<p>\u2014 GLAD (@GLADLaw) <a href=\"https:\/\/twitter.com\/GLADLaw\/status\/1560401159956754432?ref_src=twsrc%5Etfw\">August 18, 2022<\/a> <\/p>\n<\/blockquote>\n<p>The ADA explicitly excludes gender identity disorders that don\u2019t result from physical impairments, but Motz determined that the language in the ADA was outdated and shouldn\u2019t be interpreted to exclude gender dysphoria. The case opens the door for future court decisions requiring special accommodations for transgender people under the ADA, including potentially allowing males to be housed in women\u2019s prisons at a larger scale than <a href=\"https:\/\/dailycaller.com\/2022\/06\/07\/transgender-crimes-murder-abuse-prison-gender\/\" target=\"_blank\" rel=\"noopener noreferrer\">is<\/a> <a href=\"https:\/\/dailycaller.com\/2022\/04\/26\/transgender-inmate-rape-rikers-island-new-york\/\" target=\"_blank\" rel=\"noopener noreferrer\">currently<\/a> <a href=\"https:\/\/dailycaller.com\/2022\/04\/14\/inmates-pregnant-consensual-relationship-trans-convict\/\" target=\"_blank\" rel=\"noopener noreferrer\">occurring<\/a>.<\/p>\n<p>\u201cIn light of the \u2018basic promise of equality \u2026 that animates the ADA,\u2019 we see no legitimate reason why Congress would intend to exclude from the ADA\u2019s protections transgender people who suffer from gender dysphoria,\u201d Motz wrote.<\/p>\n<p>\u201cThis opinion goes a long way toward removing social and cultural barriers that keep people with treatable, but misunderstood, medical conditions from being able to thrive,\u201d Jennifer Levi, transgender rights project director at GLBTQ Legal Advocates &#038; Defenders, said in a statement.<\/p>\n<p>Williams\u2019 attorney did not respond to the DCNF\u2019s request for comment.<\/p>\n<p>Content created by The Daily Caller News Foundation is available without charge to any eligible news publisher that can provide a large audience.
