Lindsey Graham\u2019s (R-S.C.) request to stay an order to appear before a special grand jury in <a href=\"https:\/\/www.theepochtimes.com\/t-georgia\">Georgia<\/a> investigating allegations of criminal misconduct related to the 2020 federal elections.<\/p>\n<p>Graham\u2019s lawyers attempted to argue that he was exempt from testifying because he\u2019s a U.S. senator protected by the U.S. Constitution, including the speech or debate clause. But\u00a0U.S. District Judge Leigh Martin May, an Obama appointee, disagreed and ordered\u00a0Graham to honor his subpoena.<\/p>\n<p>Graham\u2019s attorneys appealed that order to the 11th U.S. Circuit Court of Appeals and asked May to stay her ruling and prohibit the special grand jury from questioning him while that appeal plays out.<\/p>\n<p>May declined that request in her order on Friday.<\/p>\n<p>\u201cUnder the circumstances, further delay of Senator Graham\u2019s testimony would greatly compound the overall delay in carrying out the grand jury\u2019s investigation,\u201d\u00a0May wrote\u00a0in her decision (<a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.gand.305825\/gov.uscourts.gand.305825.37.0.pdf\">pdf<\/a>).<\/p>\n<p>\u201cFurther delay thus poses a significant risk of overall hindrance to the grand jury\u2019s investigation, and the Court therefore finds that granting a stay would almost certainly result in material injury to the grand jury and its investigation.\u201d<\/p>\n<p>Graham\u2019s testimony is scheduled for Tuesday. But he still has another motion to stay May\u2019s ruling pending before the 11th Circuit.<\/p>\n<p>The senator told reporters\u00a0in South Carolina earlier this week that\u00a0he would appeal if the U.S. judge ruled against him.<\/p>\n<p>\u201cI was chairman of the Senate Judiciary Committee and had to vote on certifying an election.
