Cunningham argued that it\u2019s overwhelmingly in the public\u2019s interest to let the people of Michigan decide this matter at the ballot box.<strong><br \/><\/strong><\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Judge Jacob James Cunningham sides with abortion rights advocates and grants an injunction to block enforcement of Michigan\u2019s 1931 law banning abortion:<\/p>\n<p>\u201cThe harm to the body of women \u2026 in not issuing the injunction could not be more real, clear, present, and dangerous.\u201d <a href=\"https:\/\/t.co\/lnt59yEdoA\">pic.twitter.com\/lnt59yEdoA<\/a><\/p>\n<p>\u2014 The Recount (@therecount) <a href=\"https:\/\/twitter.com\/therecount\/status\/1560661639875203073?ref_src=twsrc%5Etfw\">August 19, 2022<\/a><\/p>\n<\/blockquote>\n<blockquote>\n<p><strong>\u201cAs currently applied, the court finds the statute dangerous and chilling to our state\u2019s population of child-bearing people and the medical professionals who care for them,\u201d he said.<\/strong><\/p>\n<\/blockquote>\n<p>The law has been on the books since 1931. It went back into effect after the Supreme Court overturned Roe v. Wade in June. It would have allowed abortion providers to be charged with a felony, including manslaughter. The measure was never enforced after Governor Gretchen Whitmer (D-Mich.) filed a suit to uphold protections in April. She asked Michigan\u2019s Supreme Court to determine if abortion is constitutionally protected in the state.<strong><br \/><\/strong><\/p>\n<blockquote>\n<p><strong>\u201cWeaponizing the criminal law against providers to force pregnancy on our state\u2019s women is simply contrary to notions of due process, equal protection and bodily autonomy in this court\u2019s eyes,\u201d Judge Cunningham said.<\/strong><\/p>\n<\/blockquote>\n<p>Republican prosecutors in Kent, Macomb and Jackson counties said they should be able to enforce the law. Attorney David Kallman announced that an appeal is in the works.<\/p>\n<p>Outside the courthouse, he told reporters that the judge ignored all of the clear legal errors and problems in the case.
