The complaint argues that Racine\u2019s mobile voting unit does not comply with a Wisconsin\u00a0<a href=\"https:\/\/docs.legis.wisconsin.gov\/statutes\/statutes\/6\/iv\/855\" target=\"_blank\" rel=\"noreferrer noopener\">statute<\/a>\u00a0that prohibits absentee balloting locations that confer a partisan advantage.\u00a0<\/p>\n<p>According to a\u00a0<a href=\"https:\/\/will-law.org\/wp-content\/uploads\/2022\/08\/Racine_PB_Formatted8.8.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">report<\/a>\u00a0by WILL, Racine purchased an absentee voting van using funds it received in 2020 from the Center for Tech and Civic Life (CTCL) \u2014 a\u00a0<a href=\"https:\/\/thefederalist.com\/2021\/10\/12\/the-2020-election-wasnt-stolen-it-was-bought-by-mark-zuckerberg\/\" target=\"_blank\" rel=\"noreferrer noopener\">Mark Zuckerberg-funded left-wing nonprofit<\/a>\u00a0\u2014 in anticipation of the 2022 elections. Leading up to the Aug. 9, 2022, primary, the voting van visited 21 designated locations around the city \u201cdistributing and collecting ballots at each over the 14-day period of in-person absentee voting prior to Election Day.\u201d<\/p>\n<p>But as the report states, the absentee voting van was assigned to wards that vote at a higher percentage for Democrats, thereby conferring an advantage to the Democratic Party in direct violation of Wisconsin state law. Furthermore, the law states that absentee voting sites must \u201cbe located as near as practicable to the office of the municipal clerk or board of election commissioners.\u201d The WILL report found that Racine did not follow this statute in choosing the voting van\u2019s designated locations.<\/p>\n<p>\u201cRacine\u2019s use of mobile voting sites violates clear directives in state law on the collection of absentee ballots at alternative sites. WEC must make clear that Racine is violating the law and ensure that clerks across the state understand what is, and is not permitted in Wisconsin law,\u201d WILL Deputy Counsel Anthony LoCoco said in a\u00a0<a href=\"https:\/\/will-law.org\/will-files-wec-complaint-over-illegal-racine-election-van\/\" target=\"_blank\" rel=\"noreferrer noopener\">press release<\/a>.\u00a0<\/p>\n<p>Additionally, state law stipulates that if the city uses alternative voting sites, then \u201cno function related to voting and return of absentee ballots that is to be conducted at the alternate site may be conducted in the office of the municipal clerk or board of election commissioners.\u201d However, for two weeks leading up to the Aug. 9 primary, early absentee voting also took place at the city clerk\u2019s office at Racine\u2019s city hall.<\/p>\n<p>Other watchdog groups have raised concerns about Racine\u2019s use of the mobile voting van and its potential for fraud and abuse. The Election Transparency Initiative\u00a0<a href=\"https:\/\/mobile.twitter.com\/ETI_now\/status\/1557391214319640576\" target=\"_blank\" rel=\"noreferrer noopener\">tweeted<\/a>, \u201cIs casting a ballot on the side of the road and in parking lots\u2014just like ordering lunch\u2014a recipe for fraud, abuse &#038; mismanagement?\u201d<\/p>\n<figure class=\"wp-block-image size-large\"><\/figure>\n<p>Such a mobile voting unit will also make it difficult to enforce a Wisconsin statute that prohibits electioneering within 100 feet of a polling place, the WILL report argues. The legality of using a transitory vehicle for absentee voting is also suspect, as Wisconsin law only references \u201c<a href=\"https:\/\/casetext.com\/statute\/wisconsin-statutes\/elections\/chapter-5-elections-general-provisions-ballots-and-voting-systems\/subchapter-i-general-provisions\/section-525-polling-places\" target=\"_blank\" rel=\"noreferrer noopener\">buildings<\/a>\u201d when describing polling places.\u00a0<\/p>\n<p>WILL\u2019s complaint comes after the Wisconsin Supreme Court\u00a0<a href=\"https:\/\/thefederalist.com\/2022\/07\/08\/wisconsin-supreme-court-drops-hammer-on-2020-election-shenanigans-ballot-drop-boxes-are-illegal-under-wisconsin-law\/\" target=\"_blank\" rel=\"noreferrer noopener\">ruled<\/a>\u00a0in July that absentee ballot drop boxes are illegal under state law.\u00a0<\/p>\n<hr class=\"wp-block-separator\" \/>\n<p>\n  Victoria Marshall is a staff writer at The Federalist.
