Lhamon was infamous in the Obama administration for using Title IX to implement campus \u201c<a href=\"https:\/\/thefederalist.com\/2021\/07\/22\/are-campus-kangaroo-courts-coming-back-under-biden\/\" target=\"_blank\" rel=\"noreferrer noopener\">kangaroo courts<\/a>\u201d that even the late, left-leaning Justice Ruth Bader Ginsburg <a href=\"https:\/\/www.washingtontimes.com\/news\/2018\/feb\/20\/ruth-bader-ginsburg-campus-sexual-assault-trials-e\/\" target=\"_blank\" rel=\"noreferrer noopener\">critiqued<\/a> for \u201cnot giving the accused person a fair opportunity to be heard.\u201d<\/p>\n<p>As The Federalist\u2019s Emily Jashinsky noted, \u201cThe guidance issued in 2011 and enforced adamantly by Lhamon made federal funding contingent upon schools denying due process rights to accused students, denying cross-examinations, requiring a \u2018preponderance of the evidence\u2019 standard over \u2018clear and convincing\u2019 or \u2018beyond a reasonable doubt,\u2019 and defining sexual violence broadly to include \u2018rape, sexual assault, sexual battery, and sexual coercion,\u2019 but with zero definitions.\u201d<\/p>\n<p>When DeVos took charge of the Department of Education under former President Donald Trump, she revamped the Title IX rules for handling sexual assault cases, restoring basic protections of due process for the accused. Now, the Biden DOE under Secretary Miguel Cardona is seeking to reverse those reforms. Some of the proposed changes include removing requirements that the accused be allowed to see the evidence against them and cross-examine their accusers, as well as reinstituting the <a href=\"https:\/\/nypost.com\/2022\/07\/04\/team-bidens-obama-era-title-ix-kangaroo-court-nixes-fairness\/\" target=\"_blank\" rel=\"noreferrer noopener\">system<\/a> of a \u201csingle investigator [who can] adjudicate charges by conducting private interviews with the parties,\u201d a legal sidestep that earned the moniker \u201ckangaroo courts.\u201d<\/p>\n<p>In addition, the Biden administration is attempting to stretch the definition of \u201csex\u201d in Title IX to include \u201cgender identity\u201d and \u201csexual orientation,\u201d which could see students accused of \u201csexual harassment\u201d for simply referring to other students by the \u201cwrong\u201d pronouns, as <a href=\"https:\/\/thefederalist.com\/2022\/05\/20\/under-bidens-title-ix-changes-wisconsins-sexual-harassment-circus-over-trans-pronouns-would-ensnare-students-in-every-state\/\">happened<\/a> in Wisconsin in May.<\/p>\n<p>\u201cThis administration is so bent on trying to politicize and weaponize a law that was meant to protect women and to give them access to education, not to weaponize it to harm others,\u201d DeVos explained to Kelly. \u201cThis is a really, really bad direction that they\u2019re taking.\u201d<\/p>\n<hr class=\"wp-block-separator\" \/>\n<p>\n  Elle Reynolds is an assistant editor at The Federalist, and received her B.A. in government from Patrick Henry College with a minor in journalism.
