It has to be more than that because the Department of Justice and the FBI have already set a standard that makes it virtually impossible to prosecute a case like that,&#8221; Ratcliffe told Fox Business&#8217;s Larry Kudlow, who is another former Trump administration official. <\/p>\n<p>Although no president has ever been prosecuted for mishandling classified material, some experts dispute the notion that one could suddenly deem something declassified and argue that the president must instead follow a formal process. <\/p>\n<p>\u201cI\u2019ve seen thousands of declassified documents. They\u2019re all marked \u2018declassified\u2019 with the date they were declassified,\u201d Richard Immerman, assistant deputy director of national intelligence in the Obama administration, <a class=\"Link\" href=\"https:\/\/www.nbcnews.com\/politics\/donald-trump\/trump-allies-say-declassified-mar-lago-documents-experts-say-unclear-w-rcna42311\" target=\"_blank\" rel=\"noopener\">told<\/a> NBC News. <\/p>\n<p>During a Monday raid, FBI agents carried out a search warrant of Trump&#8217;s lavish Mar-a-Lago resort and <a class=\"Link\" href=\"https:\/\/www.wsj.com\/articles\/fbi-recovered-eleven-sets-of-classified-documents-in-trump-search-inventory-shows-11660324501\" target=\"_blank\" rel=\"noopener\">reportedly<\/a> retrieved some 20 boxes of material while <a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/policy\/defense-national-security\/fbi-records-nuclear-weapons-trump-raid\">seeking<\/a> documents with details about nuclear weapons. <\/p>\n<p>A <a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/read-in-full-fbi-unsealed-search-warrant-trump-mar-a-lago-raid\" target=\"_blank\" rel=\"noopener\">warrant released<\/a> to the public Friday revealed that authorities were looking for material retained in violation of three federal laws, including the Espionage Act. <\/p>\n<div class=\"Enhancement\">\n<div class=\"Enhancement-item\">\n<blockquote class=\"twitter-tweet\">\n<p lang=\"en\" dir=\"ltr\">Reporters: please listen to me.<\/p>\n<p>The Espionage Act encompasses a ton of crimes that have nothing to do with &#8220;spying&#8221;. It&#8217;s a stupid name for the law that is a century old. Remember the Department of Justice and the FBI took the official position that Hillary Clinton, who was in possession of classified documents &#8230; that in possession of that \u2014 that wasn&#8217;t enough and that being grossly negligent &#8230; that&#8217;s not enough under the Espionage Act,&#8221; Ratcliffe continued. <\/p>\n<p>&#8220;The Department of Justice and FBI said six years ago, you gotta be able to prove intent. He&#8217;s already denied that he had the intent to do it,&#8221; he added. <\/p>\n<p>During the 2016 campaign, Clinton faced controversy after it was revealed that she conducted government work as secretary of state, including the handling of classified information, on a private email server, <a class=\"Link\" href=\"https:\/\/www.nytimes.com\/2016\/07\/06\/us\/politics\/hillary-clinton-fbi-email-comey.html\" target=\"_blank\" rel=\"noopener\">per<\/a> the <i>New York Times. <\/i>Although Clinton was criticized for the handling of her emails, she was not charged. <\/p>\n<p><b><a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/\">CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER<\/a><\/b> <\/p>\n<p>Ratcliffe, a former Republican congressman from Texas, served as Trump&#8217;s DNI from May 2020 until 2021. He argued that the FBI does not have &#8220;clean hands&#8221; and lamented that people &#8220;have lost faith and trust&#8221; in institutions such as the FBI and Justice Department. <\/p>\n<p>&#8220;The American people are so upset and so outraged is that for the last six years &#8230; what they&#8217;ve seen from the FBI and the Department of Justice is essentially the FBI acting as the muscle or the strong arm of the Democratic Party.
