The idea that we even have to do this is ridiculous.\u201d<\/p>\n<p dir=\"ltr\">\u201cThis law by the way goes into effect immediately. Because decent human beings, people with common sense, know that we should not be allowing this kind of disgusting marketing to go on another day.\u201d<\/p>\n<p dir=\"ltr\">Unsurprisingly, the legislation won\u2019t deter crimes involving firearms. Instead, it\u2019s expected to trample on lawful gun advertising, which is protected under the First Amendment. Additionally, the law is already forcing youth organizations to disband.\u00a0<\/p>\n<p dir=\"ltr\">Professor Eugene Volokh of the Volokh Conspiracy <a href=\"https:\/\/reason.com\/volokh\/2022\/04\/26\/california-bill-aimed-at-gun-advertising-that-supposedly-targets-children\/?comments=true&#038;\">challenged<\/a> the constitutionality of the law and argued commercial marketing is \u201cattractive\u201d to both youths and adults. He <a href=\"https:\/\/reason.com\/volokh\/2022\/04\/26\/california-bill-aimed-at-gun-advertising-that-supposedly-targets-children\/?comments=true&#038;\">remarked<\/a>, \u201cEven as to commercial advertising, the law is unconstitutionally vague: It covers any ads that are &#8220;attractive to minors,&#8221; even if they are equally attractive to legal adult buyers. And the specific examples don&#8217;t resolve the vagueness problem\u2026\u201d<\/p>\n<p dir=\"ltr\">Additionally, The Reload revealed a youth shooting sports league has ceased operations altogether, citing the new anti-marketing bill.\u00a0<\/p>\n<p dir=\"ltr\">It <a href=\"https:\/\/thereload.com\/california-youth-shooting-sports-league-shuts-down-in-wake-of-advertising-ban\/\">reports<\/a>, \u201cThe California State High School Clay Target League (CASHCTL) <a href=\"https:\/\/www.claytargetscoring.com\/site_down.php\">folded<\/a> last week following passage of Assembly Bill 2571, which imposes $25,000 civil fines on \u201cfirearm industry members\u201d advertising \u201cany firearms-related product\u201d in a way that could be seen as \u201cappealing to minors.\u201d The statewide league, which operated under the nonprofit USA Clay Target League, has removed everything on the site except a message saying it was \u201cforced by law to suspend all operations.\u201d\u201d<\/p>\n<p dir=\"ltr\">In response, legal challenges have come from various gun rights and hunting organizations.\u00a0<\/p>\n<p dir=\"ltr\">One suit filed in Los Angeles on July 8th\u00a0<a href=\"https:\/\/www.reuters.com\/world\/us\/gun-groups-challenge-california-ban-firearms-marketing-kids-2022-07-08\/\">argues<\/a> the First Amendment rights of shooting sports leagues is being violated under AB 2571.<\/p>\n<p dir=\"ltr\">Another suit filed by a coalition of sportsmen\u2019s groups\u2014specifically\u00a0Sportsmen\u2019s Alliance, Safari Club International, SoCal Top Guns, and Congressional Sportsmen\u2019s Foundation\u2014 also\u00a0<a href=\"https:\/\/congressionalsportsmen.org\/the-media-room\/news\/hunting-coalition-sues-california-over-firearm-marketing-law\">challenged<\/a> the law on \u201c1st, 2nd, 5th and 14th Amendment\u201d grounds.<\/p>\n<p dir=\"ltr\">\u201cThis law is a prime example of rushing action without fully understanding the consequences,\u201d Jeff Crane, president &#038; CEO of the Congressional Sportsmen\u2019s Foundation,\u00a0<a href=\"https:\/\/congressionalsportsmen.org\/the-media-room\/news\/hunting-coalition-sues-california-over-firearm-marketing-law\">said<\/a> in a news release. \u201cBy significantly impacting the sporting-conservation community\u2019s ability to effectively recruit and train the next generation of sportsmen and women, this law will have far-reaching consequences on the very funding structure that underwrites the conservation of California\u2019s wildlife and their habitats. All people of the state, not just hunters, should be outraged that this law is now on the books.\u201d<\/p>\n<p dir=\"ltr\">\u201cThis law is a travesty that clearly violates several constitutional protections at once, while, ironically, undermining well established safety programs and education,\u201d\u00a0<a href=\"https:\/\/sportsmensalliance.org\/news\/hunting-coalition-sues-california-over-firearm-marketing-law\/\">added<\/a> Todd Adkins, Sportsmen\u2019s Alliance vice president of government affairs. \u201cIn their haste to politicize firearms, Gov. Newsom and the legislature have destroyed youth education and firearm-safety programs that have long been supported by Californians.\u201d<\/p>\n<p dir=\"ltr\">Before patting themselves on the back, California Democrats must answer for deliberately undermining conservation efforts in a state that\u2019s hemorrhaging hunting participants. Without hunters, the conservation funding model would\u00a0<a href=\"https:\/\/www.npr.org\/2018\/03\/20\/593001800\/decline-in-hunters-threatens-how-u-s-pays-for-conservation\">cease<\/a> to exist.<\/p>\n<p dir=\"ltr\">In 1970, California\u00a0<a href=\"https:\/\/www.mercurynews.com\/2020\/02\/21\/the-decline-of-hunting-in-california\/\">had<\/a> 764,000 licensed hunters. As of April 2022,\u00a0<a href=\"https:\/\/www.outdoorlife.com\/conservation\/can-hunting-survive-in-california\/\">approximately<\/a> 290,000 Californians hunt. That\u2019s a whopping 63% decrease. Today, fewer than 1% of Californians go hunting\u2014the lowest per capita rate of any U.S. state. And those numbers are expected to further decline under AB 2571.<\/p>\n<p dir=\"ltr\">Why? Given this \u201cgun safety\u201d bill, the California Department of Fish and Wildlife\u2019s December 2019 R3 (Recruitment, Retention, and Reactivation) Plan, which contains marketing for youth shooting sports and hunting, will be\u00a0<a href=\"https:\/\/nrm.dfg.ca.gov\/FileHandler.ashx?DocumentID=177571&#038;inline\">jeopardized<\/a>. The 2019 plan\u00a0<a href=\"https:\/\/nrm.dfg.ca.gov\/FileHandler.ashx?DocumentID=177571&#038;inline\">says<\/a> it will \u201ccreate, support and promote marketing and outreach materials that more fully embrace the shooting sports\u2014archery, target shooting, rifle, shotgun and pistol ranges, youth shooting leagues and activities\u2014as worthwhile, important and valuable activities linked to hunting and hunter recruitment, retention and reactivation starting in July 2020.\u201d<\/p>\n<p dir=\"ltr\">Much to Governor Newsom and his party\u2019s chagrin, AB 2571 won\u2019t mitigate or stop crime involving guns. Rather, it will undermine the future of hunting and shooting sports in the formerly Golden State.<\/p>\n<p dir=\"ltr\">California is a net exporter of terrible policies. Don\u2019t be surprised if copycat laws come before your state legislature soon.
