(AP Photo\/Kathy Willens, File)<\/p>\n<\/div>\n<h5>Daniel Baldwin \u2013OAN White House Correspondent<br \/>UPDATED 9:24 AM PT \u2013 Friday, August 12, 2022<\/h5>\n<p><span>In a week defined by legal battles, former President Donald Trump sidestepped one possible landmine by invoking his Fifth Amendment rights in New York Wednesday.<\/span><\/p>\n<blockquote>\n<p><strong>\u201cI once asked, \u2018If you\u2019re innocent, why are you taking the Fifth Amendment?\u2019 Now I know the answer to that question,\u201d Trump said in a statement on Truth Social. \u201cWhen your family, your company, and all the people in your orbit have become the targets of an unfounded, politically motivated Witch Hunt supported by lawyers, prosecutors, and the Fake News Media, you have no choice.\u201d<\/strong><\/p>\n<\/blockquote>\n<p><span>Attorney General Letitia James scheduled the <\/span><a href=\"https:\/\/www.oann.com\/trump-invokes-fifth-amendment-in-n-y-deposition-blasts-ag-james\/\"><span>deposition<\/span><\/a><span> to question the 45th president as part of a three-year civil lawsuit regarding the Trump Organization\u2019s business dealings, specifically whether the business improperly inflated the value of its assets. Director of Investigations at Judicial Watch, Chris Farrell praised the 45th president for this decision.<\/span><\/p>\n<blockquote>\n<p><strong>\u201cWhen faced with a prosecutor who has taken such an extraordinarily aggressive position, one that arguably could result in some sort of sanction or BAR complaint against her because it\u2019s so excessive,\u201d explained Farrell in an exclusive interview with One America News. \u201cIt\u2019s not unreasonable for the former president to say, \u2018Look I\u2019m not going to cooperate at all with whatever it is that you\u2019re trying to do.\u2019\u201d\u00a0<\/strong><\/p>\n<\/blockquote>\n<p><span>Farrell says given James\u2019 <\/span><a href=\"https:\/\/truthsocial.com\/@realDonaldTrump\/108798611892907735\"><span>past history<\/span><\/a><span> of promising to target Trump as a prosecutor, it is a reasonable response to simply refuse to answer any questions.\u00a0<\/span><\/p>\n<blockquote>\n<p><strong>\u201cIf this is some sort of legal fishing expedition, where you\u2019re gonna ask 101 questions and just see where it goes, you don\u2019t really have any charge or claim,\u201d Farrell said. \u201cYou just want to get me under oath and sit me down and see how many times you can ask a certain number of questions.\u201d<\/strong><\/p>\n<\/blockquote>\n<p><span>Farrell explained Trump would have been assuming significant risk by answering questions from James.<\/span><\/p>\n<blockquote>\n<p><strong>\u201cBefore my 23 years of Judicial Watch, I was a US army counterintelligence officer,\u201d said Farrell. \u201cAnd I can tell you that if I sit you down, and I interview you under oath for two hours, if I want to, I will be able to find some instance where you purportedly or allegedly would\u2019ve engaged in some sort of, not necessarily perjury, but a contradictory statement.\u201d\u00a0<\/strong><\/p>\n<\/blockquote>\n<p><span>Farrell explains even the slightest word variation from the subject could open him or herself up to possible legal trouble.<\/span><\/p>\n<blockquote>\n<p><strong>\u201cIn one instance, you use the expression of, and another time you say from, and I pointed out that inconsistency in the statements,\u201d explained Farrell. \u201cI say, \u2018You see, you\u2019re being misleading. You\u2019re attempting to deceive me. You\u2019ve made a false and misleading statement to a federal law enforcement officer. I can now charge you under 18 U.S. Code \u00a7 1001.\u201d<\/strong><\/p>\n<\/blockquote>\n<p><span>Under <\/span><a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/18\/1001\"><span>18 U.S. Code \u00a7 1001<\/span><\/a><span>, anyone who \u201cmakes any materially false, fictitious, or fraudulent statement or representation\u2026shall be fined under this title, imprisoned not more than 5 years.\u201d Save America Christina Bobb <\/span><a href=\"https:\/\/www.oann.com\/trump-attorney-smart-by-trump-to-invoke-5th-amendment-against-activist-ag\/\"><span>agreed<\/span><\/a><span> with Farrell\u2019s assessment in an exclusive interview with One America News saying Trump had \u201cno obligation\u201d to help James.\u00a0<\/span><\/p>\n<blockquote>\n<p><strong>\u201cPeople don\u2019t realize that when they\u2019re under oath,\u201d Farrell said. \u201cAnd they\u2019re being questioned like that. Very minor discrepancies in how they\u2019re being questioned opens the door to legal jeopardy \u2026 It\u2019s low hanging fruit.
