The Fifth amendment is to protect people against an oppressive government. You don\u2019t have to speak to the government. You don\u2019t have to say anything that could potentially incriminate you.\u201d<\/strong><\/p>\n<\/blockquote>\n<p><span>Bobb explained that the burden of responsibility in this situation falls on the government.<\/span><\/p>\n<blockquote>\n<p><strong>\u201cIt\u2019s the government\u2019s responsibility,\u201d said Bobb. \u201cIf they believe you\u2019ve done something wrong and want to take away your liberties by throwing you in jail or doing something to you, it\u2019s their responsibility to figure it out. And you have no obligation to help them.\u201d<\/strong><\/p>\n<\/blockquote>\n<p><span>James scheduled the deposition to question Trump as part of a three-year civil lawsuit regarding the Trump Organization\u2019s business dealings, specifically whether the business improperly inflated the value of its assets.<\/span><\/p>\n<blockquote>\n<p><strong>\u201cIf there\u2019s anybody in this country that has an oppressive government after them, it is Donald Trump,\u201d Bobb explained. \u201cI think it\u2019s a great symbol of where we are in this nation. He is relying on our constitutional rights and freedoms, and he is bringing us as a nation. He\u2019s bringing us back to why, why this nation is so great and the founding principles. And I think he was absolutely right to invoke his rights.\u201d<\/strong><\/p>\n<\/blockquote>\n<p><span>Trump took to Truth Social to levy attacks on James, arguing she was running a partisan campaign against him.<\/span><\/p>\n<blockquote>\n<p><span><strong>\u201cAttorney General Letitia James openly campaigned on the policy of \u2018Get and Destroy Trump,\u2019\u201d Trump wrote. \u201cThis politic<\/strong>al attack on me, my family, and my great company is her despicable attempt to fulfill that cynical, and very corrupt promise.<\/span><\/p>\n<\/blockquote>\n<p><span>Bobb echoed this sentiment from Trump. She explained if Trump did testify, he would\u2019ve fallen directly into James\u2019 trap.<\/span><\/p>\n<blockquote>\n<p><strong>\u201cThey would somehow find something that they could say he perjured himself,\u201d Bobb said. \u201cAnything you say can and will be used against you. That\u2019s why they advise you of that in your Miranda rights, because they can take anything you say and make it a crime. The president in this case did exactly the right thing. He invoked his rights. I don\u2019t think anybody even questions that everybody knows that when you have an attorney general, who makes a statement just as you explained that she is out to get you, why would he talk to her? She\u2019s not cooperating. She\u2019s not trying to be, uh, you know, just tough on crime and do what\u2019s right for the people of New York. She\u2019s an activist with an agenda.
