But making them public now \u201cwould not \u2018impair court functions,\u2019 including the government\u2019s ability to execute the warrant, given that the warrant has already been executed,\u201d the government lawyers said <a href=\"https:\/\/www.documentcloud.org\/documents\/22130690-doj-motion-to-unseal\">in the new filing<\/a>.<\/p>\n<p>However, the request only asks to Reinhart to unseal the warrant and two attachments, in addition to the receipt.<\/p>\n<p>Andrew Crespo, a professor of criminal law and procedure at the Harvard Law School, said that as best he can tell, the government is not asking to unseal the affidavit submitted to the judge. The affidavit, likely signed by an FBI agent, would contain crucial information on why authorities believed a warrant was necessary.<\/p>\n<p>The government\u2019s motion seems to be an attempt to try to respond to the outrage from many Republicans over the raid,\u00a0John Malcolm, director of the Meese Center for Legal and Judicial Studies at The Heritage Foundation, told The Epoch Times.<\/p>\n<p>\u201cI think that this is an attempt by the Department of Justice\u2014who may have underestimated the reaction to this through this raid\u2014to try to get out a little bit ahead of it by saying, \u2018Oh, see, what we did here was perfectly on the up and up,&#8217;\u201d Malcolm said.<\/p>\n<p>\u201cIf they really wanted to do that, in a more fulsome way, they would share that affidavit,\u201d he added.<\/p>\n<figure id=\"attachment_4655703\" class=\"wp-caption alignnone\"><a href=\"https:\/\/img.theepochtimes.com\/assets\/uploads\/2022\/08\/10\/Trump-GettyImages-1242419266-1200x800.jpg\"><figcaption class=\"wp-caption-text\"><noscript><img loading=\"lazy\" decoding=\"async\" class=\"size-large wp-image-4655703\" src=\"https:\/\/img.theepochtimes.com\/assets\/uploads\/2022\/08\/10\/Trump-GettyImages-1242419266-1200x800.jpg\" alt=\"Trump waves\" width=\"640\" height=\"427\" \/><\/noscript><\/figcaption><\/a> Former President Donald Trump waves while walking to a vehicle outside of Trump Tower in New York on Aug. 10, 2022. (Stringer\/AFP via Getty Images)<\/figure>\n<h2>Circumstances Favor Unsealing<\/h2>\n<p>The DOJ told Reinhart that matter at hand\u00a0\u201cplainly \u2018concerns public officials or public concerns,&#8217;\u201d since agents took action at the property of a former president, and that the public\u2019s \u201cclear and powerful interest in understanding what occurred under these circumstances weighs heavily in favor of unsealing.\u201d<\/p>\n<p>Still, the lawyers said they would provide a copy of the motion to Trump, and that he should have an opportunity to respond and lodge objections, perhaps over privacy concerns.<\/p>\n<p>Reinhart ordered the government to immediately give a copy of its motion to Trump and notify the court by 3 p.m. on Aug. 12 as to whether Trump opposed the motion.<\/p>\n<p>Reinhart is a judge at the U.S. District Court for the Southern District of Florida. Magistrate judges are picked by other judges.\u00a0Reinhart signed off on the warrant on Aug. 5, according to the court docket.<\/p>\n<p>After the raid took place, the nonprofit Judicial Watch and several media organizations asked Reinhart to unseal the materials, arguing that the public and press have the right to the records, particularly in light of <a href=\"https:\/\/www.theepochtimes.com\/fbi-trump-home-raid-improperly-intrusive-circumstances-indicate_4653940.html\">the unprecedented circumstances surrounding the raid<\/a>. The judge ordered the government to respond to the requests.<\/p>\n<p>Bobb, who did not respond to a request for comment, has said that\u00a0the former president would request the court unseal the materials underpinning the warrant, including the affidavit outlining why officials thought the warrant should be approved.
