Law schools that failed to boost the enrollment of &#8220;underrepresented groups&#8221; would have been at risk of losing their accreditation.<\/p>\n<p>The proposal underwent three rounds of revisions before finally being withdrawn by the association\u2019s house of delegates, which did not rule out revisiting the proposal at a later date. An early draft had warned that U.S. anti-discrimination laws were &#8220;not a justification&#8221; for &#8220;non-compliance&#8221; with the diversity standard, a line that drew criticism from many in the legal community, including from elite universities.<\/p>\n<p>Ten Yale Law School professors said in a public comment filed in June 2021 that the proposal &#8220;instructs schools to risk violating state or federal law in order to retain certification.&#8221; As late as February 2022, law professors were raising &#8220;legal concerns&#8221; about the &#8220;use of racial balancing or quotas,&#8221; according to a <a href=\"https:\/\/mailtrack.io\/trace\/link\/02a8fcf4664f1d5381794331fe807ce04da7929e?url=https%3A%2F%2Fwww.americanbar.org%2Fcontent%2Fdam%2Faba%2Fadministrative%2Flegal_education_and_admissions_to_the_bar%2Fcouncil_reports_and_resolutions%2Ffeb22%2F22-feb-council-final-recs-with-exhibit.pdf&#038;userId=6348687&#038;signature=87c60677a9db2da9\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/mailtrack.io\/trace\/link\/02a8fcf4664f1d5381794331fe807ce04da7929e?url%3Dhttps%253A%252F%252Fwww.americanbar.org%252Fcontent%252Fdam%252Faba%252Fadministrative%252Flegal_education_and_admissions_to_the_bar%252Fcouncil_reports_and_resolutions%252Ffeb22%252F22-feb-council-final-recs-with-exhibit.pdf%26userId%3D6348687%26signature%3D87c60677a9db2da9&#038;source=gmail&#038;ust=1660250401338000&#038;usg=AOvVaw2juEJYlsAZlPhK9yTIecD2\">memo<span id=\"m_5701042460076501407gmail-m_3219756029557601869mt-tracked-link_1660162887669\"><\/span><\/a> from the bar association summarizing the feedback it received.<\/p>\n<p>The decision to withdraw the proposal comes as the Supreme Court is <a href=\"https:\/\/www.supremecourt.gov\/docket\/docketfiles\/html\/public\/20-1199.html\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.supremecourt.gov\/docket\/docketfiles\/html\/public\/20-1199.html&#038;source=gmail&#038;ust=1660248561178000&#038;usg=AOvVaw3DIBYaH97mCKW_Co1QTIEb\">gearing up for oral arguments<\/a> in a landmark affirmative action case, <em>Students for Fair Admissions<\/em> v. <em>Harvard<\/em>, that could outlaw racial preferences throughout higher education. It also comes as something of a surprise given the association\u2019s relentless focus on diversity.<\/p>\n<p>The association, which accredits almost every law school in the United States, has <a href=\"https:\/\/www.nytimes.com\/2022\/05\/06\/us\/standardized-testing-american-bar-association.html#:~:text=No%20more%20LSATs%3F,a%20test%20if%20they%20wish.%E2%80%9D\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.nytimes.com\/2022\/05\/06\/us\/standardized-testing-american-bar-association.html%23:~:text%3DNo%2520more%2520LSATs%253F,a%2520test%2520if%2520they%2520wish.%25E2%2580%259D&#038;source=gmail&#038;ust=1660248561178000&#038;usg=AOvVaw0LhnzH4d9IR_GROCPvUHjT\">made noise<\/a> about eliminating the LSAT, a test <a href=\"https:\/\/news.bloomberglaw.com\/us-law-week\/killing-the-lsat-in-the-name-of-diversity-wont-cure-the-problem\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/news.bloomberglaw.com\/us-law-week\/killing-the-lsat-in-the-name-of-diversity-wont-cure-the-problem&#038;source=gmail&#038;ust=1660248561178000&#038;usg=AOvVaw3CKnsOFcFjV3dKqcVZM5ua\">some say<\/a> disadvantages minority applicants. And in February, it <a href=\"https:\/\/freebeacon.com\/campus\/how-the-american-bar-association-just-radicalized-law-school\/\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/freebeacon.com\/campus\/how-the-american-bar-association-just-radicalized-law-school\/&#038;source=gmail&#038;ust=1660248561178000&#038;usg=AOvVaw2ijgFacy_XhBQVyc_SN5Mp\">voted to require<\/a> law schools to educate students &#8220;on bias, cross-cultural competency, and racism,&#8221; over the objections from law professors who said the requirement would threaten academic freedom.<\/p>\n<p>The curricular mandate was nonetheless popular among law school administrators, with 150 deans <a href=\"https:\/\/taxprof.typepad.com\/files\/aba-bias-cultural-awareness-and-anti-racist-practices-education-and-training-letter-7.30.20-final.pdf\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/taxprof.typepad.com\/files\/aba-bias-cultural-awareness-and-anti-racist-practices-education-and-training-letter-7.30.20-final.pdf&#038;source=gmail&#038;ust=1660248561178000&#038;usg=AOvVaw1ookvj02PhMXLPAV4DxO58\">calling on<\/a> the American Bar Association to implement it. There has been much less administrative agitation for rules about minority enrollment, which law schools have <a href=\"https:\/\/www.startribune.com\/law-schools-struggle-to-attract-minorities\/90055572\/\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.startribune.com\/law-schools-struggle-to-attract-minorities\/90055572\/&#038;source=gmail&#038;ust=1660248561178000&#038;usg=AOvVaw0rnRACYzvC_aMxGciSPnl7\">long struggled<\/a> to boost.<\/p>\n<p>There has also been little consensus on what sort of diversity the American Bar Association should prioritize.
