Headlines generally didn\u2019t acknowledge the baby\u2019s late gestational age, the concealment of the corpse or the suspicious autopsy that led the the warrant for their Facebook messages.<\/p>\n<p>Vice, <a href=\"https:\/\/www.nbcnews.com\/tech\/tech-news\/facebook-turned-chat-messages-mother-daughter-now-charged-abortion-rcna42185\" target=\"_blank\" rel=\"noopener noreferrer\">NBC News<\/a>, <a href=\"https:\/\/www.thedailybeast.com\/facebook-fuels-abortion-charges-against-celeste-burgess-and-jessica-burgess-in-nebraska\" target=\"_blank\" rel=\"noopener noreferrer\">Daily Beast<\/a>, <a href=\"https:\/\/www.usatoday.com\/story\/news\/nation\/2022\/08\/09\/facebook-messages-used-cops-nebraska-abortion-charges\/10283170002\/\" target=\"_blank\" rel=\"noopener noreferrer\">USA Today<\/a>, <a href=\"https:\/\/www.bloomberg.com\/news\/articles\/2022-08-09\/facebook-user-s-messages-lead-to-abortion-charges-in-nebraska\" target=\"_blank\" rel=\"noopener noreferrer\">Bloomberg<\/a> and <a href=\"https:\/\/www.cbsnews.com\/news\/jessica-burgess-nebraska-woman-charged-teen-daughter-abortion\/\" target=\"_blank\" rel=\"noopener noreferrer\">CBS News<\/a> also ran headlines that emphasized Facebook\u2019s compliance with the police warrant and failed to note the baby\u2019s late gestational age and the alleged attempts to conceal and destroy the corpse.<\/p>\n<p>\u201cFacebook Gave Nebraska Cops A Teen\u2019s DMs. They Used Them To Prosecute Her For Having An Abortion,\u201d a Forbes headline <a href=\"https:\/\/www.forbes.com\/sites\/emilybaker-white\/2022\/08\/08\/facebook-abortion-teen-dms\/?sh=5051f7cd579c\" target=\"_blank\" rel=\"noopener noreferrer\">said<\/a>; in reality the teen who had the abortion was charged for her handling of the corpse and failure to report what she told police had been a stillbirth, and only her mother was charged with the abortion. Vice similarly said the data was being used to \u201cProsecute a Teenager for Abortion\u201d in its headline, and NBC\u2019s headline said \u201cmother and daughter now charged over abortion.\u201d<\/p>\n<p>\u201cAbortion rights activists, digital privacy experts, and anyone who is concerned about privacy in the United States have raised fears that people\u2019s digital communications, location data, period app tracking information, or other private data will be used against them to criminalize abortion,\u201d the Vice article read.<\/p>\n<p>\u201cMuch of the reporting about Meta\u2019s role in a criminal case against a mother and daughter in Nebraska is plain wrong,\u201d Meta wrote in a press release. \u201cWe received valid legal warrants from local law enforcement on June 7, before the Supreme Court\u2019s decision in Dobbs v. Jackson Women\u2019s Health Organization. The warrants did not mention abortion at all. Court documents indicate that police were at that time investigating the alleged illegal burning and burial of a stillborn infant.\u201d<\/p>\n<p>Jessica Burgess allegedly gave the teen abortion pills when she was 28 weeks pregnant, then the two of them allegedly concealed the baby\u2019s corpse and discussed a plan to dig it up and burn it over Facebook messages, prosecutors said, <a href=\"https:\/\/www.vice.com\/en\/article\/n7zevd\/this-is-the-data-facebook-gave-police-to-prosecute-a-teenager-for-abortion\" target=\"_blank\" rel=\"noopener noreferrer\">according<\/a> to Vice. Nebraska has the same 20-week abortion limit it had before Roe v. Wade was overturned; children have survived after being delivered at as young as 21 weeks and routinely survive at 24 weeks.<\/p>\n<p>Celeste and Jessica Burgess initially told police the baby had unexpectedly been delivered stillborn, but an autopsy was unable determine whether the child was stillborn or had suffocated to death in the bag the baby was buried in, according to Vice.<\/p>\n<p>The authorities then sought a warrant for the women\u2019s communications to determine whether the child had been stillborn or suffocated, according to Vice.
