If those institutions fail yet again, and target the leader of Joe Biden\u2019s political opposition in doing so, this looks like banana republic stuff.\u201d<\/p>\n<p>\u201cIf Sandy Berger shoves classified documents in his pants, that\u2019s unqualifiedly a legal violation,\u201d Shapiro added, referring to the Clinton administration\u2019s national security adviser\u2019s actions. \u201cBut the president has the ability to declassify materials before leaving the White House. So this is even more dicey for the FBI and DOJ than usual, requiring real specifics.\u201d<\/p>\n<p>Shapiro also addressed reports that a conviction would bar Trump from holding political office again by saying those reports are false.<\/p>\n<p>\u201c[By the way], for those claiming that a violation of law regarding classified documents would prevent Trump from running, nope \u2014 the statutory penalties for any such violation do not overcome the Constitution definition of qualifications for eligibility,\u201d Shapiro wrote.<\/p>\n<p>The New York Times <a href=\"https:\/\/www.nytimes.com\/live\/2022\/08\/08\/us\/trump-fbi-raid#trump-fbi-mar-a-lago\">reported<\/a> that Trump delayed returning the approximately 15 boxes of material to the National Archives which included documents that were \u201cmarked as classified national security information.\u201d<\/p>\n<p>Federal prosecutors opened a grand jury\u00a0<a href=\"https:\/\/www.dailywire.com\/news\/feds-open-grand-jury-investigation-into-trump-over-activities-at-his-florida-home-report\">investigation<\/a>\u00a0back in May into Trump over whether classified material that ended up at his home in Mar-a-Lago was mishandled.<\/p>\n<p>The main purpose of these types of investigations is usually for federal authorities to determine if any classified material was compromised so that intelligence officials can take steps to protect sensitive sources and methods.
