Not only may the act violate federal law against using funds for purposes unapproved by Congress, but the order politicizes the election process itself. <strong><a href=\"https:\/\/dailycaller.com\/2022\/07\/08\/democrats-sabotage-north-carolina-election-aggressive-methods-third-party-candidate\/\">(RELATED:\u00a0Democrats Tried To Sabotage North Carolina Election With Aggressive Methods, Third-Party Candidate And Analyst Claim)<\/a><\/strong><\/p>\n<p>In September of the same year the executive order was issued, the White House <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/statements-releases\/2021\/09\/28\/fact-sheet-biden-administration-promotes-voter-participation-with-new-agency-steps\/\" target=\"_blank\" rel=\"noopener noreferrer\">issued a \u201cfact sheet\u201d<\/a> detailing the ways in which federal agencies were complying with the order. In the fact sheet, the White House called the order a, \u201ccall for all-of-government action\u201d on elections.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">Joe Biden said during this speech that people who disagree with his bill to federalize elections are \u201cdomestic enemies\u201d and are on the side of George Wallace, Bull Connor, and Jefferson Davis.<\/p>\n<p>What you see here is truly the soul of nation being restored. <a href=\"https:\/\/t.co\/P2gZi5K0nS\">pic.twitter.com\/P2gZi5K0nS<\/a><\/p>\n<p>\u2014 Greg Price (@greg_price11) <a href=\"https:\/\/twitter.com\/greg_price11\/status\/1481021777606328325?ref_src=twsrc%5Etfw\">January 11, 2022<\/a><\/p>\n<\/blockquote>\n<p>\u201cEmployees throughout the federal government who are carrying out President Joe Biden\u2019s executive order directing them to get involved in state elections are likely all violating the Anti-Deficiency Act, besides interfering in the election process and using federal resources in what seems to be a get-out-the-vote operation for the party in power in the White House,\u201d said senior legal fellow at the Heritage Foundation and former commissioner on the Federal Election Commission <a href=\"https:\/\/www.dailysignal.com\/2022\/08\/03\/the-latest-federal-takeover-of-elections-violates-federal-law\/\">Hans von Spakovsky.<\/a>\u00a0<strong><a href=\"https:\/\/dailycaller.com\/2022\/01\/11\/biden-filibuster-georgia-voting-rights\/\">(RELATED:\u00a0Biden Calls For Ending The Filibuster To Pass Election Laws)<\/a><\/strong><\/p>\n<p>The <a href=\"https:\/\/www.gao.gov\/legal\/appropriations-law\/resources\">Anti-Deficiency Act<\/a> prohibits the use of federal funds beyond what has been approved by Congress. Federal employees who violate the Anti-Deficiency Act are subject to imprisonment, fines and suspension without pay.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">Tonight, Chuck Schumer and Joe Biden led the left in an attempt to blow up the Senate rules to federalize elections. The so-called \u201c<a href=\"https:\/\/dailycaller.com\/2019\/03\/08\/house-democrats-hr1-act\/\">For The People Act<\/a>\u201d failed in the Senate <a href=\"https:\/\/www.dailysignal.com\/2021\/06\/22\/huge-win-for-democracy-gop-blocks-federal-election-takeover\/\">in June of last year<\/a>, which, among other things, would <a href=\"https:\/\/www.dailysignal.com\/2022\/02\/10\/biden-bureaucracy-secretly-plans-to-turn-out-voters-after-failure-of-election-takeover-bills\/\">eliminate<\/a> most states\u2019 Voter ID laws.<\/p>\n<p>After Democrats\u2019 voting rights legislation failed, Vice President Kamala Harris revealed the Democrats\u2019 fallback strategy. Since the legislation hadn\u2019t worked, the Biden Administration was resorting to executive orders. <strong><a href=\"https:\/\/dailycaller.com\/2022\/01\/20\/kamala-harris-joe-biden-midterm-elections-legitimate\/\">(RELATED:\u00a0\u2018If I May Finish\u2019: VP Harris Gets Testy After NBC Anchor Says It\u2019s \u2018Astonishing\u2019 Biden\u2019s Doubting US Elections)<\/a><\/strong><\/p>\n<p>\u201cAnd then it is a matter of continuing to do the work of executive orders, doing the work through the Department of Justice, which has been litigating these cases in the various states,\u201d <a href=\"https:\/\/www.realclearpolitics.com\/video\/2022\/01\/20\/kamala_harris_people_in_elected_offices_in_states_are_making_it_more_difficult_to_vote.html\">Harris told CBS News<\/a>, \u201cbecause we believe they are a violation of the spirit of the Constitution of the United States.\u201d<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">Democrat narratives of \u201cvoter suppression\u201d are a \u201cbig lie\u201d used to \u201cmake it easier to cheat\u201d in elections, Hans von Spakovsky said. <a href=\"https:\/\/t.co\/T0CO8NHHfx\">https:\/\/t.co\/T0CO8NHHfx<\/a><\/p>\n<p>\u2014 Breitbart News (@BreitbartNews) <a href=\"https:\/\/twitter.com\/BreitbartNews\/status\/1481631698790064138?ref_src=twsrc%5Etfw\">January 13, 2022<\/a><\/p>\n<\/blockquote>\n<p>Republican Rep. Ted Budd of North Carolina introduced a bill to combat just this.<\/p>\n<p>\u201cThe legislation would prevent the Biden administration from using the power, resources, and reach of the federal executive branch, and federal offices located in states across the country, from engaging in voter registration and mobilization efforts designed to benefit Democrats,\u201d <a href=\"https:\/\/budd.house.gov\/news\/documentsingle.aspx?DocumentID=1519\">according to Budd\u2019s website<\/a>.<\/p>\n<p>Russ Vought, former Director of the Office of Management and Budget (OMB) and president of the Center for Renewing America (CWA), wrote a letter to current OMB director Shalanda Young criticizing the order for its federal overreach.<\/p>\n<p>\u201cWhat we have seen thus far is of deep concern. Some of these plans provide that agencies will expend federal taxpayer funds or other resources and partner with preapproved outside organizations in order to satisfy the Biden Administration\u2019s directive to engage in voter registration efforts,\u201d <a href=\"https:\/\/federalnewsnetwork.com\/wp-content\/uploads\/2022\/06\/Vought-OMB-Final.docx.pdf\">the letter read<\/a>.<\/p>\n<p>The letter notes that these actions directly conflict with the Anti-Deficiency Act.<\/p>\n<p>The order also potentially violates the Hatch Act, which prohibits civil service employees from engaging in partisan political activity.<\/p>\n<p>Stewart Whitson, a former FBI supervisory agent <a href=\"https:\/\/www.dailysignal.com\/2022\/06\/01\/3-laws-that-bidens-voter-registration-order-could-break\/\">told the Daily Signal<\/a> that the circumstances under which the Anti-Deficiency Act was passed are, \u201cstrikingly similar\u201d to the acts encouraged by Biden\u2019s order now.<\/p>\n<p>\u201cIt was based on a 1939 scandal where the national Democratic Party was using the government to get more votes,\u201d he said. <strong><a href=\"https:\/\/dailycaller.com\/2022\/06\/20\/justice-department-watchdog-refers-fbi-agents-anti-trump-hatch-act-special-counsel\/\">(RELATED:\u00a0\u2018Potential Violations Of The Hatch Act\u2019: DOJ Inspector General Refers Top FBI Agent To Special Counsel\u2019s Office)<\/a><\/strong><\/p>\n<p>\u201cExecutive Order 14019 seems designed to target voters that are more likely to vote Democrat,\u201d Whitson continued. \u201cVoter participation means voter mobilization. If the federal employees are engaged in getting people to the polls, that is political activity.\u201d<\/p>\n<p>Republican Rep. Claudia Tenney of New York told the Daily Signal, \u201cWe\u2019re looking at potential Hatch Act violations.\u201d<\/p>\n<p>\u201cWe have these former political operatives now, and actually even government agencies, engaging in political operations to get votes out, which are roles reserved to the states and not to these federal operatives.\u201d<\/p>\n<p>Biden\u2019s executive order requires federal employees to engage in potentially illegal and partisan activity. As multiple experts point out, the order is a likely violation of both the Anti-Deficiency Act and the Hatch Act.
