Harvard\u2019s Office of Dispute Resolution concluded that most of those allegations\u2014including an allegation of sexual assault\u2014were without merit. It found only a minor violation of Title IX, an off-color comment by Comaroff that investigators <a href=\"https:\/\/www.nytimes.com\/2022\/02\/08\/us\/harvard-sexual-harassment-lawsuit.html\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.nytimes.com\/2022\/02\/08\/us\/harvard-sexual-harassment-lawsuit.html&#038;source=gmail&#038;ust=1659644369703000&#038;usg=AOvVaw2HY9gJ5CBvJEQssz-z-pKI\">conceded<\/a> had &#8220;no romantic or sexual intention,&#8221; according to Comaroff\u2019s lawyers.<\/p>\n<p>The petition nonetheless accuses Comaroff of sexual &#8220;violence&#8221; and argues that his presence in the classroom would pose &#8220;a serious risk of continued harm.&#8221; Its signatories include Harvard Law professor Nikolas Bowie, who sits on the board of the American Civil Liberties Union in Massachusetts, as well as a dozen law students who\u2019ve worked for public defenders.<\/p>\n<p>&#8220;It is shocking that an employee union is calling for a Harvard employee to be summarily punished and cast out of the University community based upon allegations that the University\u2019s process found him not responsible for or that have never been investigated,&#8221; one of Comaroff\u2019s lawyers, Ruth O&#8217;Meara-Costello, said in a statement on Friday. &#8220;And it is shocking that signatories to the union\u2019s petition, including law students and a law professor, would join in this demand to substitute mob justice for due process.&#8221;<\/p>\n<p>Both ironies reflect a broader identity crisis within legal nonprofits and labor unions, which have begun to take positions at odds with their core missions. The American Civil Liberties Union, for example, has <a href=\"https:\/\/www.aclu.org\/press-releases\/aclu-sues-betsy-devos-allowing-schools-ignore-sexual-harassment-and-assault\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.aclu.org\/press-releases\/aclu-sues-betsy-devos-allowing-schools-ignore-sexual-harassment-and-assault&#038;source=gmail&#038;ust=1659644369703000&#038;usg=AOvVaw1pGOgXXzN6wzJXolluzbLo\">challenged efforts<\/a> to strengthen due process protections in campus Title IX proceedings. And from the<em> <a href=\"https:\/\/freebeacon.com\/media\/union-or-woke-activist-group-new-york-times-employees-raise-questions-about-guilds-role-in-recent-dismissals\/\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/freebeacon.com\/media\/union-or-woke-activist-group-new-york-times-employees-raise-questions-about-guilds-role-in-recent-dismissals\/&#038;source=gmail&#038;ust=1659644369703000&#038;usg=AOvVaw1UP0YBRxwiTChovYmd3Eeh\">New York Times<\/a><\/em> to the <a href=\"https:\/\/freebeacon.com\/culture\/how-racial-anxiety-conquered-an-orchestra-and-crushed-a-career\/\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/freebeacon.com\/culture\/how-racial-anxiety-conquered-an-orchestra-and-crushed-a-career\/&#038;source=gmail&#038;ust=1659644369703000&#038;usg=AOvVaw236JZ5oyZhB056rHokcERo\">Nashville Symphony Orchestra<\/a>, unions at liberal institutions have welcomed the termination of employees who run afoul of progressive shibboleths, as activist organizers replace the old guard.<\/p>\n<p>Harvard\u2019s Graduate Student Union is a microcosm of that process.\u00a0 The three women who accused Comaroff of harassment\u2014Lilia Kilburn, Amulya Mandava, and Margaret Czerwienski\u2014are all active in the union, which has for years <a href=\"https:\/\/www.washingtonpost.com\/education\/2019\/04\/12\/harvards-graduate-student-union-demands-better-sexual-harassment-protections\/\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.washingtonpost.com\/education\/2019\/04\/12\/harvards-graduate-student-union-demands-better-sexual-harassment-protections\/&#038;source=gmail&#038;ust=1659644369703000&#038;usg=AOvVaw1uBAzERW6oZwUpI5twnz3d\">lobbied Harvard<\/a> to take a tougher stand on sexual misconduct. In February, Mandava and Czerwienski were elected as the union\u2019s vice president and sergeant-at-arms, respectively, amid a well-publicized battle with the university over its handling of the Comaroff case.<\/p>\n<p>At least 12 of the law students who\u2019ve joined their cause have worked with groups that promote due process rights for the accused, according to the students\u2019 LinkedIn profiles and personal websites. The petition\u2019s signatories include <a href=\"https:\/\/www.linkedin.com\/in\/christopherkdietz\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.linkedin.com\/in\/christopherkdietz&#038;source=gmail&#038;ust=1659644369703000&#038;usg=AOvVaw1JKKO2bll9t7beSRKXf5pF\">Christopher Dietz<\/a>, a former paralegal for the Innocence Project; <a href=\"https:\/\/www.linkedin.com\/in\/dane-underwood-2b8b4015b\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.linkedin.com\/in\/dane-underwood-2b8b4015b&#038;source=gmail&#038;ust=1659644369703000&#038;usg=AOvVaw3hv-VD1p0Oy2rU1MwxUKRB\">Dane Underwood<\/a>, a former law clerk for the Los Angeles Legal Aid Society; <a href=\"https:\/\/www.linkedin.com\/in\/alex-brown-3ab00191\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.linkedin.com\/in\/alex-brown-3ab00191&#038;source=gmail&#038;ust=1659644369703000&#038;usg=AOvVaw1OIFng0SlDsRa0OwhMaqKN\">Alex Brown<\/a>, who has clerked for public defenders in four different states; and <a href=\"https:\/\/sici.hks.harvard.edu\/person\/sarah-blatt-herold\/\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/sici.hks.harvard.edu\/person\/sarah-blatt-herold\/&#038;source=gmail&#038;ust=1659644369703000&#038;usg=AOvVaw1K9RiynsEjImCuH8v2zJvE\">Sarah Blatt-Herold<\/a>, who has worked with the Brooklyn Defender Services as well as the &#8220;prison abolitionist&#8221; group Black and Pink.<\/p>\n<p>Reached for comment, Underwood defended his decision to sign the petition.<\/p>\n<p>&#8220;I see no tension between my work in legal services\u2014which supports people caught in systems over which they have little power\u2014and my opposition to the class taught by John Comaroff\u2014a tenured professor at a $53 billion university, who used his position of power to sexually harass students,&#8221; Underwood said. Bowie and the other students did not respond to requests for comment.<\/p>\n<p>The Comaroff controversy began in May 2020 when Kilburn, Mandava, and Czerwienski lodged a Title IX complaint against the 77-year-old anthropologist. The complaint contained a litany of lurid allegations: that Comaroff had kissed and touched Kilburn without her consent; that he\u2019d fantasized aloud about her being raped; and that he retaliated against Mandava and Czerwienski for attempting to bring his conduct to light.<\/p>\n<p>Harvard investigators determined that Comaroff never touched Kilburn inappropriately, but had warned her against traveling to Cameroon with her same-sex partner\u2014because, he said, gay people in the country are often targeted for &#8220;corrective rape,&#8221; a practice that has been documented extensively by <a href=\"https:\/\/www.reuters.com\/article\/us-cameroon-lgbt-rape\/lesbian-witches-chained-and-raped-by-families-in-cameroon-idUSKCN1MC001\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.reuters.com\/article\/us-cameroon-lgbt-rape\/lesbian-witches-chained-and-raped-by-families-in-cameroon-idUSKCN1MC001&#038;source=gmail&#038;ust=1659644369703000&#038;usg=AOvVaw3DcKxAXnccCP3ZV8DktcYT\">human rights groups<\/a> and the <a href=\"https:\/\/www.justice.gov\/eoir\/page\/file\/1249766\/download\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.justice.gov\/eoir\/page\/file\/1249766\/download&#038;source=gmail&#038;ust=1659644369703000&#038;usg=AOvVaw3kIfzEDev0zJHEZzgu7IFf\">U.S. government<\/a>.<\/p>\n<p>The school also found that Comaroff, who grew up in South Africa and studies African society, violated Title IX by conveying that warning in an inappropriate tone, and that some of his comments to Mandava violated the school\u2019s guidelines for &#8220;professional conduct.&#8221; It did not find that he retaliated against any of the women. Harvard placed Comaroff on leave in January for the Spring 2022 semester and barred him from teaching required courses for at least a year.<\/p>\n<p>But those sanctions didn\u2019t satisfy Comaroff\u2019s accusers, who in February <a href=\"https:\/\/www.nytimes.com\/2022\/02\/08\/us\/harvard-sexual-harassment-lawsuit.html\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.nytimes.com\/2022\/02\/08\/us\/harvard-sexual-harassment-lawsuit.html&#038;source=gmail&#038;ust=1659644369703000&#038;usg=AOvVaw2HY9gJ5CBvJEQssz-z-pKI\">filed a lawsuit<\/a> alleging that Harvard had &#8220;ignored&#8221; their harassment.
