Version: 4.0.47--><p>A parents advocacy group is suing an <a href=\"https:\/\/www.dailywire.com\/topic\/iowa\">Iowa<\/a> school district for allegedly hiding children\u2019s <a href=\"https:\/\/www.dailywire.com\/topic\/transgender\">gender transitions<\/a> from parents.<\/p>\n<p>Parents Defending Education is\u00a0suing the\u00a0Linn-Mar Community School District near Cedar Rapids over so-called \u201cgender support plans,\u201d which the group says were concealed from parents.<\/p>\n<p>\u201cNearly a century of Supreme Court precedent makes two things clear: parents have a constitutional liberty interest in the care, custody, and control of their children, and students do not abandon their First Amendment rights at the schoolhouse gate,\u201d states the <a href=\"https:\/\/defendinged.org\/wp-content\/uploads\/2022\/08\/Parents-Defending-Education-V-Linn-Mar-Community-School-District.pdf\">lawsuit<\/a>, which was filed Tuesday in the U.S. District Court for the Northern District of Iowa.<\/p>\n<p>The Linn-Mar district is \u201cflouting both of these constitutional guarantees,\u201d the lawsuit claims, by allowing children to make \u201cfundamentally important decisions concerning their gender identity without any parental involvement and to then hide these decisions from their parents.\u201d<\/p>\n<p>Students as young as 12 can work with their school to put together a \u201cgender support plan\u201d under a district <a href=\"http:\/\/policy.linnmar.k12.ia.us\/policy\/50413-r-administrative-regulations-regarding-transgender-and-students-nonconforming-gender\">policy<\/a> dubbed \u201cTransgender and Students Nonconforming to Gender Role Stereotypes.\u201d<\/p>\n<p>\u201cAny student in seventh grade or older will have priority of their support plan over their parent\/guardian,\u201d the policy states.<\/p>\n<p>Parents cannot be alerted about their child\u2019s gender identity change unless the student explicitly gives his or her consent, the district says.<\/p>\n<p>\u201cThe district shall not disclose information that may reveal a student\u2019s transgender status to others including but not limited to other students, parents, and school staff unless legally required to do so (such as national standardized testing, drivers permits, transcripts, etc.), or unless the student has authorized such disclosure,\u201d\u00a0says the policy.<\/p>\n<p>The policy also specifies that gender support plans will be kept in the student\u2019s \u201ctemporary\u201d records rather than their permanent records.<\/p>\n<p>Parents Defending Education argues that the district made this move on purpose so that \u201crecords related to the gender support plan\u00a0will never be accessible to parents\u201d since parents have the right to access their children\u2019s permanent records\u00a0<a href=\"https:\/\/www2.ed.gov\/policy\/gen\/guid\/fpco\/ferpa\/index.html\">under<\/a> the federal Family Educational Rights and Privacy Act\u00a0(FERPA).<\/p>\n<p>Additionally, school staff and other students must use students\u2019 preferred pronouns.<\/p>\n<p>\u201cEvery student has the right to be addressed by a name and pronoun that corresponds to their gender identity,\u201d the school\u2019s gender policy states.<\/p>\n<p>\u201cAn intentional and\/or persistent refusal by staff or students to respect a student\u2019s gender identity is a violation of school board policies,\u201d the gender policy says, citing the district\u2019s Anti-Bullying and Anti-Harassment <a href=\"http:\/\/policy.linnmar.k12.ia.us\/policy\/104-anti-bullyingharassment-policy\">policy<\/a>, Equal Education Opportunity <a href=\"http:\/\/policy.linnmar.k12.ia.us\/policy\/1051-equal-educational-opportunity\">policy<\/a>, and the district\u2019s Title IX <a href=\"http:\/\/policy.linnmar.k12.ia.us\/policy\/1043-prohibition-discrimination-andor-harassment-based-sex-title-ix\">policy<\/a>.<\/p>\n<p>Students can be suspended or even expelled, and staff can be fired for violating those policies.<\/p>\n<p>\u201cLinn-Mar\u2019s gender policy demonstrates a deep contempt for the constitutional rights of its students and families,\u201d said Parents Defending Education President Nicole Neily in a <a href=\"https:\/\/defendinged.org\/lawsuits\/parents-defending-education-files-federal-lawsuit-challenging-linn-mar-community-school-districts-parental-exclusion-and-compelled-speech-policies\/\">statement<\/a>.<\/p>\n<p>\u201cIt has been clearly established by the federal court system over the past 100 years that parents have a right to direct the upbringing of their children, and we are proud to fight on behalf of our members to put a stop to these unconstitutional policies,\u201d Neily said.<\/p>\n<p>The school board <a href=\"https:\/\/www.youtube.com\/watch?v=-h-BQ5BEaO8\">voted<\/a> for the policy in April despite passionate opposition from parents who showed up to the school board meeting to protest it.<\/p>\n<p>\u201cLook at your track record, guys.
