Joe Manchin of West Virginia sponsored his party\u2019s spending bill shortly before his party leaders promised to expedite permits for crucial energy infrastructure; however, the arrangement could easily fall apart as little protections exist to make permitting reform a reality.<\/p>\n<p>President Joe Biden, House Speaker Nancy Pelosi and Majority Leader Chuck Schumer promised Manchin that they would pass the speed-up permitting for pipeline projects, particularly for the Mountain Valley Pipeline in West Virginia, in addition to their $369-billion climate and tax package, Reuters <a href=\"https:\/\/www.reuters.com\/world\/us\/manchin-secures-commitment-completion-troubled-pipeline-project-2022-08-01\/\" target=\"_blank\" rel=\"noopener noreferrer\">reported<\/a> Monday. Despite the party\u2019s promises, permitting reform will not be easy to institute, and even if the Democrats cooperate as the companion bill will still face numerous legal and legislative challenges. <strong><a href=\"https:\/\/dailycaller.com\/2022\/08\/01\/manchin-climate-deal-fund-epa-quietly-circumvent-scotus\/\" target=\"_blank\" rel=\"noopener noreferrer\">(RELATED: Manchin May Be Handing EPA The Ability To Circumvent SCOTUS, Throttle The Coal Industry)<\/a><\/strong><\/p>\n<p>\u201cHe has not guaranteed anything,\u201d Steve Milloy, a former scholar at the Competitive Enterprises Institute and member of former President Donald Trump\u2019s EPA transition team, told the Daily Caller News Foundation.<\/p>\n<p>The Democratic senator\u2019s deal with his party will make sure appeals go to the U.S. Court of Appeals for the District of Columbia Circuit instead of the Fourth Circuit Court which <a href=\"https:\/\/www.ca4.uscourts.gov\/opinions\/201971.P.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">blocked<\/a> Mountain Valley\u2019s permits in February, <a href=\"https:\/\/news.bloomberglaw.com\/environment-and-energy\/mountain-valley-pipeline-shield-in-manchin-deal-raises-hackles\" target=\"_blank\" rel=\"noopener noreferrer\">according<\/a> to Bloomberg Law.<\/p>\n<p>However, since legislators could be potentially directing the judiciary to permit the project, the action could face further legal challenges, Bloomberg reported. Picture taken September 30, 2019.<\/p>\n<\/div>\n<p>Manchin defended his support of the bill and touted the advancement of \u201ccommon sense\u201d permitting reform that will protect American energy security in a <a href=\"https:\/\/www.manchin.senate.gov\/newsroom\/press-releases\/manchin-supports-inflation-reduction-act-of-2022\" target=\"_blank\" rel=\"noopener noreferrer\">press release<\/a> last Wednesday.<\/p>\n<p>Republican Sen. Shelley Moore Capito of West Virginia emphasized examining whether the exact text of the bill would enable a final vote on permitting reform in a press conference on Tuesday.<\/p>\n<p>\u201cLet\u2019s see the legislative text as to what they\u2019re going to do,\u201d she said.<\/p>\n<p>\u201cI\u2019ve never seen anybody here that can actually guarantee a final vote\u2026 on permitting reform,\u201d she said of the Democrats\u2019 alleged deal.<\/p>\n<p>Republican Sen. Kevin Cramer of North Dakota also expressed doubts about Manchin\u2019s pipeline permitting deal in a <a href=\"https:\/\/www.grandforksherald.com\/opinion\/columns\/plain-talk-sen-kevin-cramer-talks-fufeng-controversy-pact-act-same-sex-marriage-and-more\" target=\"_blank\" rel=\"noopener noreferrer\">podcast<\/a> last Friday.<\/p>\n<p>\u201cHere\u2019s the problem with permitting reform, it takes 60 votes not 50 to pass\u2026even if we had a vote on it,\u201d said Cramer. \u201cYou cannot trust the Left with permitting reform\u2026 they will never do it,\u201d he continued.<\/p>\n<p>Some provisions that could accelerate pipeline projects \u201cinclude codifying permitting reforms like the Trump Administration\u2019s One Federal Decision rule which allows infrastructure projects to be completed in a more expeditious manner,\u201d Kramer\u2019s office told the DCNF. \u201cIt also allows for expedited permitting of gathering lines on federal land and energy-producing tribal land for those who choose to participate.\u201d<\/p>\n<p>The White House and the offices of Manchin, Pelosi and Schumer did not immediately respond to the DCNF\u2019s request for comment.<\/p>\n<p>Content created by The Daily Caller News Foundation is available without charge to any eligible news publisher that can provide a large audience.
