The law was <a href=\"https:\/\/usjf.net\/wp-content\/uploads\/2022\/03\/Complaint-Filed.pdf\">challenged<\/a> by various groups, including the California Public Policy Foundation and the United States Justice Foundation.<\/p>\n<p>\u201cThe State of California has a long-standing requirement that voters must be United States citizens,\u201d the plaintiffs <a href=\"https:\/\/californiaglobe.com\/articles\/california-judge-overturns-san-francisco-law-allowing-noncitizens-to-vote\/\">argued<\/a>. \u201cThis requirement applies to every election in the state, even those conducted by charter cities, because determining voter qualifications is a matter of statewide concern where state law supersedes conflicting charter city ordinances.\u201d<\/p>\n<p>The court agreed.<\/p>\n<p>\u201cTranscendent law of California, the Constitution \u2026 reserves the right to vote to a United States citizen, contrary to (the) San Francisco ordinance,\u201d San Francisco Superior Court Judge Richard Ulmer <a href=\"https:\/\/www.documentcloud.org\/documents\/22123680-2202-07-29-lacy-order-granting-writ-of-mandate?responsive=1&#038;title=1\">said<\/a> in a ruling that will prohibit the city from counting non-citizen votes.<\/p>\n<p>The lawsuit also argued that because the San Francisco Unified School District receives money from state taxpayers, the entire state has an interest in the qualifications of its voters, and the city does not have unlimited autonomy to redefine who is eligible to vote.<\/p>\n<p>A similar law in New York City, which would have allowed up to 800,000 non-citizens to vote in city elections, was <a href=\"https:\/\/www.nytimes.com\/2022\/06\/27\/nyregion\/noncitizen-voting-ruling-nyc.html\">struck down<\/a> in June.<\/p>\n<p>San Francisco has not indicated whether or not it plans to appeal the case.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>In a ruling released on Friday, a judge struck down a San Francisco city ordinance allowing non-citizens to vote in school board elections.
