Wade<\/em>.<\/p>\n<p>Attorney General <a href=\"https:\/\/www.dailywire.com\/topic\/merrick-garland\">Merrick Garland<\/a> announced the lawsuit in a press conference on Tuesday afternoon. The Biden administration\u2019s chief prosecutor claimed that the Idaho law illegally restricts access to abortion in some cases where the life of the mother is at risk.<\/p>\n<p>\u201cIf a patient comes into the emergency room with a medical emergency jeopardizing the patient\u2019s life or health, hospitals must provide the treatment necessary to stabilize that patient,\u201d Garland said, according to <a href=\"https:\/\/www.wsj.com\/articles\/justice-department-files-lawsuit-challenging-idaho-abortion-law-11659463607\">The Wall Street Journal<\/a>. \u201cThis includes abortion when that is the necessary treatment.\u201d<\/p>\n<p>Idaho\u2019s <a href=\"https:\/\/legislature.idaho.gov\/statutesrules\/idstat\/title18\/t18ch6\/sect18-622\/\">law<\/a> is set to take effect later this month, banning all abortions except where the life of the mother is in danger, rape, and incest. Though the state law has an exception for abortion if the life of the mother is in danger, the Justice Department\u2019s lawsuit says the exception is too narrow and runs the risk of forcing doctors to violate federal law.<\/p>\n<p>\u201cThe State of Idaho, however, has passed a near-absolute ban on abortion. Once the Idaho law takes effect on August 25, 2022, Idaho Code \u00a7 18-622 will make it a felony to perform an abortion in all but extremely narrow circumstances,\u201d the <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.idd.50547\/gov.uscourts.idd.50547.1.0_1.pdf\">lawsuit<\/a> states. \u201cThe Idaho law would make it a criminal offense for doctors to comply with [Emergency Medical Treatment and Labor Act] requirement to provide stabilizing treatment, even where a doctor determines that abortion is the medical treatment necessary to prevent a patient from suffering severe health risks or even death.\u201d<\/p>\n<p>Governor Brad Little (R-ID)\u00a0<a href=\"https:\/\/twitter.com\/GovernorLittle\/status\/1554560383641235456\">said<\/a> the lawsuit amounted to \u201cfederal meddling\u201d in the state\u2019s newly-secured authority to set abortion law. Biden \u201ccontinues to ignore issues that really should demand his attention \u2013 like crushing inflation and the open border with Mexico,\u201d Little said.<\/p>\n<p>Idaho Attorney General Lawrence Wasden issued a separate <a href=\"https:\/\/www.ag.idaho.gov\/newsroom\/wasden-issues-statement-following-u-s-doj-abortion-lawsuit\/\">statement<\/a> saying the federal government is misinterpreting federal law to find conflict where none exists.<\/p>\n<p>\u201cContrary to the carefully edited assertion in paragraph 25 of the Department\u2019s complaint that Idaho\u2019s laws are preempted, EMTALA actually states: \u2018The provisions of this section do not preempt any State or local law requirement, except to the extent that the requirement directly conflicts with a requirement of this section,\u2019\u201d Wasden said.<\/p>\n<p>\u201cInstead of complying with the requirements of this provision and reconciling Idaho\u2019s law with EMTALA, or even attempting to engage Idaho in a meaningful dialogue on the issue, the federal government has chosen to waste taxpayer dollars on an unnecessary lawsuit,\u201d he added.<\/p>\n<p>The Supreme Court overturned its 1973 decision on\u00a0<em>Roe<\/em> in June, ruling in <em>Dobbs v.
