President and Fellows of Harvard College<\/a><\/em>\u00a0and\u00a0<em><a href=\"https:\/\/www.scotusblog.com\/case-files\/cases\/students-for-fair-admissions-inc-v-university-of-north-carolina\/\">Students for Fair Admissions v. University of North Carolina<\/a><\/em>, both of which challenge whether or not higher education can legally consider race in its application approval process.<\/p>\n<p>\u201cEnding the consideration of race in college admissions would ignore the country\u2019s ongoing challenge of racial inequality and threaten diversity and inclusion on campuses everywhere,\u201d Sarah Hinger, senior staff attorney with the ACLU Racial Justice Program, <a href=\"https:\/\/www.aclu.org\/press-releases\/aclu-files-amicus-brief-supreme-court-supporting-universities-ability-consider-race\">said<\/a> in a press release.<\/p>\n<p>\u201cRace-conscious admissions practices help create a diverse student body and enrich the educational experiences of all students,\u201d Hinger argued. \u201cThe Supreme Court\u2019s holdings have recognized this for decades, and we urge the court to protect universities\u2019 ability to consider race in the admissions process.\u201d<\/p>\n<p>The ACLU also tweeted, \u201cAll students deserve equitable access to higher education.\u201d<\/p>\n<p lang=\"en\" dir=\"ltr\">All students deserve equitable access to higher education.<\/p>\n<p>Along with <a href=\"https:\/\/twitter.com\/ACLU_Mass?ref_src=twsrc%5Etfw\">@ACLU_Mass<\/a> and <a href=\"https:\/\/twitter.com\/ACLU_NC?ref_src=twsrc%5Etfw\">@ACLU_NC<\/a>, we are fighting to protect academic freedom and universities\u2019 ability to grow a diverse student body.<\/p>\n<p>\u2014 ACLU (@ACLU) <a href=\"https:\/\/twitter.com\/ACLU\/status\/1554151351780839424?ref_src=twsrc%5Etfw\">August 1, 2022<\/a><\/p>\n<p>Proponents of race-based admissions claim that it helps minorities, but opponents point out that such policies often harm Asian Americans.<\/p>\n<p>\u201cIt\u2019s been argued that Asian Americans have to score as much as 450 points higher on the SAT to have a similar chance of admission as black students,\u201d Kenny Xu, author of \u201cAn Inconvenient Minority,\u201d <a href=\"https:\/\/nypost.com\/2021\/07\/04\/a-chance-for-supremes-to-end-harvards-asian-discrimination\/\">wrote<\/a> in 2021. \u201cIn 2020, Duke economics professor Peter Arcidiacono found that a black student in the fourth-lowest academic decile has a higher chance of admissions than an Asian in the top decile.\u201d<\/p>\n<p>\u201cHarvard disproportionately scores Asian Americans the lowest on \u2018personality\u2019 to justify this discrimination \u2014 a case of blatant snobbery not backed up by data: Asians score just as well as whites and other minorities in alumni interviews,\u201d Xu noted.<\/p>\n<p>In reaction to the ACLU\u2019s support for affirmative action, columnist David Marcus tweeted, \u201cI want to see the head of the @aclu sit down with the Asian kid whose immigrant parents operate a small bodega that can\u2019t go to Harvard even though he earned it and explain why it\u2019s for the best. Not best for him maybe, but for somebody else. <a href=\"https:\/\/t.co\/LD5aNc2D3j\">https:\/\/t.co\/LD5aNc2D3j<\/a><\/p>\n<p>\u2014 David Marcus (@BlueBoxDave) <a href=\"https:\/\/twitter.com\/BlueBoxDave\/status\/1554511750673956864?ref_src=twsrc%5Etfw\">August 2, 2022<\/a><\/p>\n<p>Legal experts like Alex Deise, an attorney and policy manager at FreedomWorks, have also argued that the two cases present an opportunity for the High Court to undo decades of bad legal precedent.<\/p>\n<p>\u201cBy taking these cases, the Supreme Court has a historic opportunity to eliminate the ability of colleges and universities to explicitly discriminate on the basis of race in their admissions process,\u201d Deise <a href=\"https:\/\/www.dailywire.com\/news\/attorney-supreme-court-has-historic-opportunity-to-end-race-based-college-admissions\">told<\/a> The Daily Wire in January.<\/p>\n<p>Deise noted that a 2003 case that allowed affirmative action to stand was not only not based on the Constitution, but it was also a bad way to stop race-based discrimination.<\/p>\n<p>\u201cThe Court made a serious mistake in <a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/539\/306\/#tab-opinion-1961291\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/supreme.justia.com\/cases\/federal\/us\/539\/306\/%23tab-opinion-1961291&#038;source=gmail&#038;ust=1643221213087000&#038;usg=AOvVaw1o1AwJIdjrlFm5xRaqFD0E\">Grutter v Bollinger<\/a> (2003) when it upheld these processes under the false notion that the educational benefits from a diverse student body was more important than the Equal Protection Clause\u2019s central command of race neutrality,\u201d he added. \u201cThe Court should overrule Grutter\u00a0and heed Chief Justice Roberts advice from a similar case that \u2018[t]he way to stop discrimination on the basis of race is to stop discriminating on the basis of race.\u2019\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"<p>In the name of equity, the American Civil Liberties Union (ACLU) announced on Monday that it supports allowing colleges to racially discriminate when deciding the admission of certain applicants.
