Few of the Democrats\u2019 \u201cloopholes\u201d meet this definition. Indeed, in most cases, the \u201cloopholes\u201d they\u2019re talking about were <em>deliberately<\/em> written to exist in their present form.<\/p>\n<p>Take the \u201ccarried-interest loophole,\u201d which <a href=\"https:\/\/www.realclearpolitics.com\/articles\/2022\/08\/02\/there_is_no_private_equity_loophole_147979.html\" target=\"_blank\" rel=\"noreferrer noopener\">intentionally functions<\/a> in tax code as a means of incentivizing investment, risk, and \u201csweat equity\u201d\u2014ownership stakes generated through work rather than just capital investment. Manchin might be looking for ways to raise \u201crevenue\u201d so he can tell constituents his bill won\u2019t add to the deficit. And those who subscribe to zero-sum populist economics might want to punish private equity and redistribute wealth (though the American Investment Council <a href=\"https:\/\/www.barrons.com\/articles\/senate-reconciliation-bill-carried-interest-51658966982\" target=\"_blank\" rel=\"noreferrer noopener\">says<\/a> more than 74 percent of private equity investment went to small businesses in 2021). Whatever the case, no matter what Manchin  says, none of the new taxes found in the reconciliation bill are now \u201cowed to the Treasury and the United States people.\u201d<\/p>\n<p>That goes for the 15 percent corporate minimum tax, as well. First off, it needs repeating that corporate taxes are passed on to consumers or employees. Moreover, manufacturing companies, who spend lots on up-front capital investments\u2014not the euphemistic \u201cinvestments\u201d preferred by politicians when talking about subsidies, but the real kind\u2014are the ones who are going to end up being hurt (the Tax Foundation <a href=\"https:\/\/taxfoundation.org\/build-back-better-plan-reconciliation-bill-tax\/\" target=\"_blank\" rel=\"noreferrer noopener\">says<\/a> this tax will kill 27,000 jobs). The bill Manchin supports will also <a href=\"https:\/\/news.bloombergtax.com\/daily-tax-report\/hill-tax-briefing-superfund-tax-on-oil-reemerges-in-senate-deal\" target=\"_blank\" rel=\"noreferrer noopener\">reinstate<\/a> the long-expired, <a href=\"https:\/\/www.perc.org\/1996\/05\/01\/superfund-the-shortcut-that-failed\/\" target=\"_blank\" rel=\"noreferrer noopener\">failed<\/a> superfund tax on crude and imported oil, which will also be tacked onto your energy bills. It\u2019s unclear what \u201cloophole\u201d Manchin is claiming the superfund tax is closing. \u00a0<\/p>\n<p>That said, the \u201cloophole\u201d charade isn\u2019t new. It\u2019s been most effectively deployed in attacking gun rights, which, let\u2019s face it, the left sees as a loophole in the Constitution. There is no \u201c<a href=\"https:\/\/thefederalist.com\/2015\/10\/07\/7-gun-control-myths-that-just-wont-die\/\" target=\"_blank\" rel=\"noreferrer noopener\">gun-show loophole<\/a>,\u201d since the law was written so that only commercial transfers, and not private ones, would require a federal background check. If the Senate rejects your efforts to accommodate your preferred background check policies, <a href=\"https:\/\/www.senate.gov\/legislative\/LIS\/roll_call_votes\/vote1131\/vote_113_1_00097.htm\" target=\"_blank\" rel=\"noreferrer noopener\">as it did in 2013<\/a>, it\u2019s not a \u201cloophole\u201d it\u2019s just \u201cthe law.\u201d There is no \u201cCharleston loophole,\u201d since the shooter <a href=\"https:\/\/thefederalist.com\/2022\/05\/25\/dont-surrender-to-do-somethingism-on-guns\/\" target=\"_blank\" rel=\"noreferrer noopener\">didn\u2019t exploit existing law<\/a>, he took advantage of a data entry mistake. The three-day waiting period for background checks was negotiated and then intentionally written into law that way at the time of passage. And there isn\u2019t any \u201c<a href=\"https:\/\/nymag.com\/intelligencer\/2015\/12\/obama-calls-no-fly-list-gun-loophole-insane.html\" target=\"_blank\" rel=\"noreferrer noopener\">No-Fly List Gun-Ownership Loophole<\/a>,\u201d either. There <a href=\"https:\/\/www.nationalreview.com\/2022\/03\/yes-mr-president-people-on-secret-government-lists-should-be-able-to-buy-guns\/\" target=\"_blank\" rel=\"noreferrer noopener\">are<\/a> the Second, Fourth, Fifth, and Sixth amendments of the Constitution.<\/p>\n<p>Framing these debates as a struggle between those who support closing \u201cloopholes\u201d and those who want to keep them, as the media always does, is a way of circumventing debate and advocating for policy. It\u2019s intentional. After all, the word \u201cloophole\u201d strongly insinuates a policy is unjust. Reporters wouldn\u2019t call laws that legalize abortion into the ninth month of pregnancy \u2014 as a number now do \u2014 a \u201cviable-baby termination loophole\u201d simply because Republicans say it is. <\/p>\n<p>Now, it\u2019s a senator\u2019s prerogative to vote for a bill that pumps hundreds of billions more into an economy experiencing spiking inflation or raise taxes on consumers, energy producers, and manufacturers during a recession.
