The law bans all abortions except for when the mother\u2019s life is at risk.<\/p>\n<p>Two county prosecutors responded by suing to allow the law to go into effect.<\/p>\n<p>The Michigan Court of Appeals ruled Monday that the preliminary injunction blocking the law \u201cdoes not apply to county prosecutors,\u201d meaning they can enforce the abortion ban effective August 22. State-level officials are still not permitted to enforce the ban. Meanwhile, Governor Gretchen Whitmer (D-MI) is requesting a ruling, from the state supreme court, that would declare abortion access as constitutionally protected.<\/p>\n<p>The original case against the abortion ban was brought by Planned Parenthood of Michigan, which is seeking to have a court declare the 91-year-old abortion ban unconstitutional \u2014 a law pro-lifers are defending.<\/p>\n<p>\u201cWe\u2019re ecstatic. It\u2019s wonderful. That\u2019s exactly what we\u2019ve been saying all along,\u201d <a href=\"https:\/\/www.freep.com\/story\/news\/politics\/2022\/08\/01\/michigan-abortion-injunction-court-appeals\/7744390001\/\">said<\/a> attorney\u00a0David Kallman of the conservative Great Lakes Justice Center, which is representing Michigan prosecutors who challenged the injunction.<\/p>\n<p>Planned Parenthood of Michigan released a statement saying it would continue performing abortions.<\/p>\n<p>\u201cI want to make one thing abundantly clear: Abortion is still safe and legal in Michigan today,\u201d said\u00a0Paula Thornton Greear, president and CEO of Planned Parenthood of Michigan.<\/p>\n<p>\u201cWe\u2019re committed to protecting abortion access in Michigan. We believe that the Court of Appeals order is wrong,\u201d she said.<\/p>\n<p>While some prosecutors evidently wanted the abortion ban to go into effect, others from several counties across Michigan say they will not enforce the ban, even though they are now permitted to do so.<\/p>\n<p>\u201cAs Michigan\u2019s elected prosecutors, we are entrusted with the health and safety of the people we serve. We believe that duty must come before all else. For that reason, we are reassuring our communities that we support a woman\u2019s right to choose and every person\u2019s right to reproductive freedom,\u201d <a href=\"https:\/\/www.waynecounty.com\/elected\/prosecutor\/joint-statement-seven-michigan-prosecutors-pledge-to.aspx\">said<\/a> prosecutors from the Michigan counties of\u00a0Oakland, Ingham, Washtenaw, Genesee, Wayne, Marquette and Kamalazoo.<\/p>\n<p>On Monday evening, Whitmer slammed the court\u2019s ruling and said she has filed a temporary restraining order against its enforcement.<\/p>\n<p class=\"gnt_ar_b_p\">\u201cToday\u2019s\u00a0dangerous\u00a0decision by the Michigan Court of Appeals\u00a0clears a path for\u00a0county prosecutors to\u00a0use Michigan\u2019s extreme 1931 abortion ban to\u00a0prosecute\u00a0doctors and nurses\u00a0and jail\u00a0them\u00a0for doing their jobs,\u201d Whitmer said.<\/p>\n<p class=\"gnt_ar_b_p\">\u201cWe cannot risk further confusion for\u00a0women,\u00a0health care providers,\u00a0and all\u00a0Michiganders.\u00a0As today\u2019s unexpected action proves, the overturn of\u00a0Roe v Wade\u00a0in June\u00a0has left reproductive freedom hanging by a thread in Michigan,\u201d the governor added.<\/p>\n<p>The Supreme Court overturned Roe vs. Wade on June 24, essentially turning the issue of abortion over to individual states to decide how permissive or stringent they want to be on the issue.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Michigan\u2019s local prosecutors can now enforce the state\u2019s 1931 abortion ban, a court ruled Monday.
