The American Civil Liberties Union (ACLU) got involved and <a href=\"https:\/\/www.aclu-in.org\/sites\/default\/files\/field_documents\/dkt_61_-_preliminjorder.pdf\" target=\"_blank\" rel=\"noopener\">filed a lawsuit on behalf of the student<\/a>.<\/p>\n<p>The bill specifically states that \u201cA male, based on a student\u2019s biological sex at birth in accordance with the student\u2019s genetics and reproductive biology, may not participate on an athlete team or sport designated under this section as being a female, women\u2019s, or girls\u2019 athletic team or sport.\u201d<\/p>\n<p>U.S. District Court Judge Jane Magnus-Stinson moved against HB 1041 by arguing that the bill looked to have violated the federal Title IX which involves sex-based discrimination in sports as well as previous SCOTUS decisions which treat the discrimination of transgender individuals no different than the legal definition of sex discrimination.<\/p>\n<figure id=\"attachment_3055\" aria-describedby=\"caption-attachment-3055\" class=\"wp-caption aligncenter\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-3055 size-full\" src=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2022\/07\/2022.07.28-03.46-themixnet-62e2af41dc590.png\" alt=\"\" width=\"2396\" height=\"1120\" \/><figcaption id=\"caption-attachment-3055\" class=\"wp-caption-text\">ACLU Court Filing<\/figcaption><\/figure>\n<p><strong>Related: <a href=\"https:\/\/www.boundingintosports.com\/2022\/06\/new-poll-reveals-majority-of-americans-are-opposed-to-transgender-athletes-competing-in-womens-sports\/\">New Poll Reveals Majority Of Americans Are Opposed To Transgender Athletes Competing In Women\u2019s Sports<\/a><\/strong><\/p>\n<p><a href=\"https:\/\/www.documentcloud.org\/documents\/22121425-magnus-stinson-preliminary-injunction?responsive=1&#038;title=1\" target=\"_blank\" rel=\"noopener\">According to Magnus-Stinson\u2019s ruling, HB 1041<\/a> \u201craises controversial issues regarding the boundaries of Title IX and whether and how those boundaries should stretch and shift in an ever-changing world,\u201d and that the transgender student in question \u201chas established that she has a strong likelihood of succeeding on the merits\u201d of her suit\u2019s claim.<\/p>\n<p>\u201cShe has also established that she would suffer irreparable harm for which there is no adequate legal remedy,\u201d the judge continued.<\/p>\n<figure id=\"attachment_3056\" aria-describedby=\"caption-attachment-3056\" class=\"wp-caption aligncenter\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-3056\" src=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2022\/07\/2022.07.28-03.46-themixnet-62e2af4493018.png\" alt=\"\" width=\"1734\" height=\"874\" \/><figcaption id=\"caption-attachment-3056\" class=\"wp-caption-text\">Judge Jane Magnus-Stinson via United States District Court Southern District of Indiana YouTube<\/figcaption><\/figure>\n<div class=\"email-signup inarticle\">\n<h4>Subscribe and get our daily emails and follow us on social media.<\/h4>\n<div class=\"terms-privacy\">\n<p>By opting in, you agree to receive emails from TheMix.net.
