It received this power from the state\u2019s Rule 2.13.<\/p>\n<p>Legislators never voted to allow the New York Commissioner of Health to put any individual into quarantine for any length of time.<\/p>\n<p>Gov. Kathy Hochul and the Department of Health ordered the rule\u2019s protocols during the <a href=\"https:\/\/www.theepochtimes.com\/t-covid-19\">COVID-19<\/a> pandemic.<\/p>\n<p>Then, the state renewed Rule 2.13 every 90 days. The commissioner wanted to make the rule permanent, respondents told the court.<\/p>\n<p> <a href=\"https:\/\/img.theepochtimes.com\/assets\/uploads\/2022\/01\/28\/woman-looking-out-window-e1647642564710-1200x729.jpeg\"><\/a> Health authorities say mask mandates and social distancing have helped contain COVID-19, but a court has ruled indefinite quarantining of people is unenforceable.\u00a0 (Tatyana Blinova\/Shutterstock) <\/p>\n<p>The court overturned Rule 2.13, stating that the executive branch had wrongly used legislative authority.<\/p>\n<p>\u201cInvoluntary detention is a severe deprivation of individual liberty, far more egregious than other health safety measures, such as requiring mask wearing at certain venues,\u201d the court\u2019s opinion read.<\/p>\n<p>\u201cInvoluntary quarantine may have far-reaching consequences such as loss of income [or employment] and isolation from family.\u201d<\/p>\n<p>The court barred state enforcement of Rule 2.13 because the executive branch lacked the authority to introduce it. But the court decision also condemned the rule for its failure to consider individual freedom or due process.<\/p>\n<p>\u201cThe commissioner has unfettered discretion to issue a quarantine or isolation for anyone, even if there is no evidence that person is infected or a carrier of the disease.
